The Board of Appeals held a public hearing on May 10i 1988 upon the application of
Patob Realty Trust requesting a variance from the requirements of Section 8 and
Table 2 of the Zoning ByLaws so as t6 permit 32 off-street parking spaces on 60,000'
bf land on the premises located at 3 Massachusetts Avenue. The following members
were present and voting: Frank Serio, Jr., Chairman, Augustine Nickerson, Clerk,
Walter Soule, Raymond Vivenzio and Anna O'Connor.
The hearing was advertised in the North Andover Citizen on April 21 and April 28,
1988 and all abutters were notified by regular mail.
Upon a motion made by Mr. Nickerson and seconded by Mr. Soule, the Board VOTED,
unanimously, to GRANT the variance subject to the following conditions:
1. Steel Guard rails be installed on the property at 3 Mass Avenue
to prevent vehicles from rolling into the Shawsheen River.
2. A crosswalk be installed on Mass Avenue and that a sign be in-
stalled to indicate its presence. The crosswalk should be located
opposite the Mobil Service Station at 12 Mass Avenue.
3. A 6' stockade fence be put along the eastern side that abuts
Commonwealth Avenue, with appropriate landscaping along entire
length of stockade fence.
4. The thirty-two (32) off-street parking spaces be limited to
passenger vehicles only, during the normal banking hours.

This is to inform you that officer Rand and I have viewed the area of
the Merrimack Valley Oil Company at 3 Massachusetts Avenue and we have no
opposition to the issuance of an off-street parking facility permit provided
that the following conditions are met;.
1. That a yield sign be installed at the end of the off -ramp from Route 495
by the State Department of Public Works.
2. That steel guard rails be installed on the property at 3 Massachusetts
Avenue to prevent vehicles from rolling into the Shawsheen River.
3. That a crosswalk be installed on Massachusetts Avenue and that a sign be
installed to indicate its presence. The crosswalk should be located oppo-
site the Mobil Service Station at 12 Massachusetts Avenue.
Officer.Rand is planning to attend the meeting on Tuesday night and will
be available to answer any questions that may be raised by the board.

As a result of a complaint received by the Board of Selectmen from
Dawn Sull ivan, of 11 Commonwealth Avenue, in regards to employees of the
Lawrence Savings Bank parking their vehicles on Commonwealth Avenue during
the day.'. -
on March 31, Officer Edson and I checked Commonwealth Avenue and found
three vehicles that did not belong to residents of the street parked in the
area, one of which was parked within twenty feet of an intersection in vio-
lation of parking regulations, vehicle ticket for the offense. The other
.two vehicles were legally parked and obstructing traffic in any way.
On April 1, Officer Crane and I spoke to Jeffrey W. Leeds, Executive
Vice -President and Chief Operating officer of the Lawrence Savings Bank. He
assured us that he would issue a memorandum to -all employees requesting that
they do not park on Commonwealth Avenue. Mr. Leeds went on to tell us that
they provided parking facilities to accomodate their employees at the North
Andover Shell and Baron oil Company directly across the street from their
facility. At this time I expressed my concern for the employees' safety while
corssong Massachusetts Avenue, as there are no -traffic lights or crosswalks in
the area. Mr. Leeds informed me that he would look into the problem.
-I have also contacted the Building Inspector, D. Robert Nicetta, to see
..,if the operation of any off-street parking facility in the.area was in viola-
tion of the building code. On April 6, 1 received a letter from,Mr. Nicetta
informing that they were in violation of Section 8, papagraph 8.1 of the
North Andover Zoning By -Law.'
have also received information that William O'Brien of the Merrimack
'Valley oil will be requesting a variance from.the Zoning Board of Appeals.
.:I have no.lopposition to off-street parking in the area as long as adequate
..:protection is provided for pedestrains.crossing the street.
:I have also checked Commonwealth Avenue during the past two weeks and found
..that the parking problem there has been resolved. I have also spoken to the
�complaintant and severa:1-of her neighbors and they are satisfied with the results.

The Board of Appeals held a public hearing on May 10, 1988 upon the application of
Patob Realty Trust requesting a variance from the requirements of Section 8 and
Table 2 of the Zoning ByLaws so as to permit 32 off-street parking spaces on 60,000'
of land on the premises located at 3 Massachusetts Avenue. The following members
were present and voting: Frank Serio, Jr., Chairman, Augustine Nickerson, Clerk,
Walter Soule, Raymond Vivenzio and Anna O'Connor.
The hearing was advertised in the North Andover Citizen on April 21 and April 28,
1988 and all abutters were notified by regular mail.
Upon a motion made by Mr. Nickerson and seconded by Mr. Soule, the Board VOTED,
unanimously, to GRANT the variance subject to the following conditions:
1. Steel Guard rails be installed on the property at 3 Mass Avenue
to prevent vehicles from rolling into the Shawsheen River.
2. A crosswalk be installed on Mass Avenue and that a sign be in-
stalled to indicate its presence. The crosswalk should be located
opposite the Mobil Service Station at 12 Mass Avenue.
3. A 6' stockade fence be put along the eastern side that abuts
Commonwealth Avenue, with appropriate landscaping along entire
length of stockade fence.
4. The thirty-two (32) off-street parking spaces be limited to
passenger vehicles only, during the normal banking hours.
The Board finds that the petitioner has satisfied the provisions of Section 10,
Paragraph 10.3 of the Zoning ByLaws and the granting of this variance will not
derogate from the intent and purposes of the Zoning ByLaws nor will it adversely
affect the neighborhood.

This is to inform you that officer Rand and I have viewed the area of
the Merrimack Valley oil Company at 3 Massachusetts Avenue and we have no
opposition to the issuance of an off-street parking facility permit provided
that the following conditions are met;
1. That a yield sign be installed at the end of the off -ramp from Route 495
by the State Department of Public Works.
2. That steel guard rails be installed on the property at 3 Massachusetts
Avenue to prevent vehicles from rolling into the Shawsheen River.
3. That a crosswalk be installed on Massachusetts Avenue and that a sign be

As a result of a complaint received by the Board of Selectmen from
Dawn Sullivan, of 11 Commonwealth Avenue, in regards to employees of the
'Lawrence Savings Bank parking their vehicles on Commonwealth Avenue during
�.the day.,,
on March 31, officer Edson and I checked Commonwealth Avenue and found
three vehicles that did not belong to residents of the street parked in the
area, one of which was parked within twenty feet of an intersection in vio-
lation of parking regulations, vehicle ticket for the offense. The other
Awo vehicles were legally parked and obstructing traffic in any way.
on April 1, officer Crane and I spoke to Jeffrey 11. Leeds, Executive
Vice -President and Chief operating officer of the Lawrence Savings Bank. He
assured us that he would issue a memorandum to.all employees requesting that
they do not park on Commonwealth Avenue. Mr. Leeds went on to tell us that
they provided parking facilities to accomodate their employees at the North
Andover Shell and Baron oil company directly across -the street from their
facility. At this time I expressed my concern for the employees, safety while
corssong Massachusetts Avenue, as there are Vo -traffic lights or crosswalks in
the area. Mr. Leeds informed me that he Would look into the problem.
have also contacted the Building Inspector, D. Robert Nicetta, to see
�.if the operation of any off-street parking facility in the,area was in viola
tion of the building code. on April 6, 1 received a letter from Mr. Nicetta
informing that they were in violation of Section 8, papagraph 8.1 of the
North Andover Zoning By -Law.,
I have also received information that William O'Brien of the Merrimack
Valley Oil will be requesting a variance from.the Zoning Board of Appeals.
I have no opposition to off-street parking in the area as long as adequate
..protection is provided for.pedestrains crossing the street.
I have also checked Commonwealth Avenue during the past two weeks and found
that the parking problem there has been resolved. I have also spoken to the
.complaintant and severa:l-of her neighbors and they are satisfied with the results.
