Dear Attorney Autieri:
The Board of Appeals held a public hearing on Tuesday evening, February 14, 1989
upon the application of Houston Builders, Inc. requesting a variance for street
frontage on the premises located at Lot 30 and Lot 46 on Jetwood Street. The
following members were present and voting: Frank Serio, Jr., Chairman, Alfred
Frizelle, Vice-chairman, Augustine Nickerson, Clerk, William Sullivan and Walter
Soule.
The hearing was advertised in the North Andover Citizen on January 26, 1989 and
February 2, 1989 and all abutters were notified by regular mail.
The Board voted, unanimously, to ALLOW YOU TO WITHDRAW WITHOUT PREJUDICE, as
requested in your letter dated March 7, 1989, at our meeting on March 14, 1989.

The following plans and information were available to and reviewed by
the North'Andover Conservation Commission (NACC) in reaching this
decision:
a. Notice of Intent submitted by Houston Bruilders,
prepared by Merrim�,.ck Engineering Services, Inc.,
dated January 10, 1989. Nine (9) pages.
b. Plan entitled "Site Develo PT ent Plan in North Andover
drawn for Houston Builders, prepared by Merrimack
Engineering Services, Inc., dated December 1988,
revised January 1989. One (1) sheet.
c. Letter to Conservation Commission from Building
Inspector dated January 31, 1989. One (1) piiigel..
FINDINGS:
1. The following wetland resource areas are affected by the proposed work:
bordering land subject to flooding. These resource areas are significant
to the interests of the Act and Town Bylaw as noted above. The applicant
has not attempted to overcome the significance of these resource areas
to the identified interests.
2. The NACC agrees with the applicant's delineation of the wetland
resource areas at the site.
3. The NACC finds that the proposed project may not meet the North Andover
Zoning Bylaws in that the proposed lot does not appear to have at least
75% (percent) of its area to be buildable (i.e., not a wetlard resource
area).
4. The NACC also finds that alternatives to the proposed work exist which
could provide the applicant with options for development of this
property without such a large extent of the work encroaching on the
Shawsheen River flood plain. In fact, some portions of the proposed
Work are within the 10 to 25 -year flood zone of this river.
5. The NACC finds that there are no feasible conditions or safeguards that
it can impose on the proposed activity.

For the reasons set forth above, the NACC denies this Notice of Intent.
However, the NACC has not considered and does not rule on at this time
other activities which are of a different size, materials, location,
design, or type which the applicant may propose at a later date. The
app�icant can file a new Notice of Intent proposing a smaller project,
different design, or different location.

ADDENDUM A
The Applicant, Houston Builders, Inc., is currently the
owner of Lot 30 of Map 11 of the Assessor's Map. (See enclosed
copy of section of said Assessor's Map. Lot 30 is colored in
yellow.) The Applicant is the prospective purchaser under a
Purchase and Sale Agreement concerning Lot 46 of Map 11 of the
Assessor's Map. (Said Lot 46 is colored in blue).
The Applicant proposes to subdivide both parcels of land to
create two (2) separate lots as detailed in the attached "Plan of
Land". Both of said Lots comply with all of the Town's Zoning
By -Laws except for frontage. The frontage requirement on Jetwood
Street is one hundred (1001) feet; the Applicant's plan is 75
feet. Therefore, the Applicant requests a variance of 25 feet
relative to the Street Frontage requirement of Section 7.2 and
Table 2 of the Town's Zoning By -Laws.
The Applicant is constrained from establishing frontage on
Kenwood Street as this street is not a paved public way, as is
Jetwood! but, rather, is merely a paper street at this time.
Further, there are wetland concerns and issues on and near the
Kenwood Street area; whereas, no such concerns exist relative to
Jetwood.
Therefore:
1. Due to the topography of the area and wetland concerns,
the Applicant is facing a hardship;
2. Granting the requested Variance would not be a
substantial detriment to the area and to the public
good, but rather a benef it to the area in terms of
protection of nearby wetlands;
3. Granting the requested variance will not cause
substantially more derogation from the interest and
purpose of the zoning ordinance.
