Dear Ms. Bradshaw:
The North Andover Planning Board held a public hearing on
October 3, 1995 in the Senior Center behind the Town Building, upon
the application of Coolidge Construction, 401 Andover Street, North
Andover, MA 01845 requesting a Special Permit under Section 7.2.1
of the North Andover Zoning Bylaw. The legal notice was properly
advertised in the North Andover Citizen on September 13 and
September 20, 1995 and all parties of interest were duly notified.
The following members were present: Joseph Mahoney, Chairman,
Richard Rowen, Vice Chairman, Alberto Angles, Associate Member,
Alison Lescarbeau, Clerk, John Simons and Richard Nardella..
Kathleen Bradley Colwell, Town Planner, was also present.
Ms. Lescarbeau read the legal notice to open the public hearing.
Dave Zaloga and John McGarry, from Coolidge Construction, were
present with their plan. They are requesting access to the lot
from Hawthorne Street due to the fact that there are wetlands on
Halifax Street that would be filled if this special permit is
denied.
The Fire Department is in favor of the access from Hawthorne as
Halifax does not have a cul-de-sac, it just ends, making it
difficult for fire trucks to turn around.
There was some general discussion about a sprinkler system being
installed in the home. It was decided that a sprinkler system
would be required.
Ms. Colwell will be sure to obtain an access easement before she
signs off on this.

Staff has been directed to draft a decision for the October 17,
1995 meeting.
The North Andover Planning Board held a regular meeting on
October 17, 1995. The following members were present: Richard
Rowen, Vice Chairman, Alison Lescarbeau, Clerk, Alberto Angles,
Associate Member, John Simons and Richard Nardella.
Ms. Colwell to specify clearly reasons for issuing the special
permit: wetlands and public safety. No bond is required.
On a motion by Mr. Nardella, seconded by Ms. Lescarbeau, the Board
voted unanimously to approve the special permit as amended.
Attached are those conditions.

special Permit Approval - Access other than over street frontage
The Planning Board makes the following findings regarding the
application of Coolidge Construction, 401 Andover Street, North
Andover, MA , dated September 8, 1995, requesting a Special Permit
under Section 7.2.1 of the North Andover Zoning Bylaw to allow
-access to Lot 2A Halifax Street other than over its street
frontage.
This decision hereby allows the applicant to access the property
located at Lot 2A Halifax Street across property located at Lot 8A
Hawthorne Place as shown on the Plan referenced in Condition 1.
FINDINGS OF FACT:
The Planning Board makes the following findings:
A. "A Wetland Resource Area exists between the street
frontage on Halifax Street and the buildable portion of
the lot. If this special permit is not granted., wetlands
will be filled.
B. Halifax Street is not constructed to Town standards and
does not end with a cul-de-sac thereby making it
dif f icult for emergency vehicles to access the end of the
street. Hawthorne Place is constructed to town standards
and is therefore accessible by emergency vehicles.
C. The access will not adversely affect the neighborhood as
Hawthorne Place is currently under construction.
D. There will be no nuisance or serious hazard to vehicles
or pedestrians.
E. The access, is in harmony with the general purpose and
intent of this Bylaw.
Upon reaching the above findings, the Planning Board GRANTS this
Special Permit based upon the following conditions:
SPECIAL CONDITIONS:
1. This decision must be filed with the North Essex Registry of
Deeds. Included as part of this decision is the following
plan:

Any changes made to these plans must be approved by the Town
Planner. Any changes deemed substantial by the Town Planner
will require a public hearing and modification by the Planning
Board.
2. Prior to any work on site:
a. The location of the driveway must be marked in the field
and reviewed by the Town Planner. The pavement width of
the individual driveway must be a minimum of twelve (12)
feet in order to accommodate public safety vehicles.
b. The decision of the Planning Board must be recorded at
the Registry of Deeds and a copy of the recorded decision
"filed with the Planning office.
C. Tree clearing must be kept to a minimum.
This site shall have received all necessary permits and
approvals from the North Andover Board of Health,
Conservation Commission, and the Department of Public
Works.
3. Prior to FORM U verification (Building Permit issuance) for
the proposed dwelling,
a. This site shall have received all necessary permits and
approvals from the North Andover Board of Health,
Conservation Commission, and the Department of Public
Works.
4. Prior to a certificate of Occupancy being issued for either
dwelling,
a. This lot shall have its legal address on Hawthorne Place.
b. Easements pertaining to the rights of access for the
driveway across Lot 8A Hawthorne Street shall be recorded
with the Registry of Deeds Of f ice and a copy of the
recorded document filed with the Planning office.
C. The proposed dwelling must have a residential fire
sprinkler systems installed in accordance with the
provisions of Standard 13D, N.F.P.A..
5. The contractor shall contact Dig Safe at least 72 hours
prior to commencing any excavation.

6. Gas, Telephone, Cable and Electric utilities shall be
installed as specified by the respective utility companies.
7. No open burning shall be done except as is permitted during
;; burning season under the Fire Department regulations.
8. No underground fuel storage shall be installed except as
may be allowed by Town Regulations.
9. The provisions of this conditional approval shall apply to
and be binding upon the applicant, its employees and all
successors and assigns in interest or control.
10. This permit shall be deemed to have lapsed after a two (2)
year period from the date on which the Special Permit was
granted unless substantial use or construction has commenced.
Therefore the permit will lapse on *
