Notice is hereby given that the Board of Appeals will hold a
public hearing at the Senior Citizen's Center located at the
rear of Town Hall Building, 120 Main Street, North Andover,
MA. on Tuesday the 13 th day of August 1996 at 7:30
o'clock P.M. to all parties interested in the appeal of
Christine Dempsey requesting a Variance pursuant to Section
7, paragraph 7.3 for relief for front setback and a Special
Permit Section 9, paragraph 9.1, Table 2 of the Zoning Bylaw
for the purpose of extending a preexisting non -conforming
structure for a second level.
Said premise is located at 30 Innis Street which is in the
R-3 Zoning District. Plans are available for review at the
Office of Community Development & Services, Town Hall Annex,
146 Main Street.

The Board of Appeals held a regular meeting on Tuesday evening, Augusz
13, 1996 upon -the application of Scott and Christine Dempsey requesting
a VARIANCE from the reaui-rement of Section 7 Paragraph 3 and Table 2 of
the Zoning Bylaws so as to permit re-'eF of the lot dimension area
requirement setback of 25000' to 6025 relief requested 18,975, Street
frontage required setback of 125' to 60' relief requested 6S'and fronz:
setback requirement of 30' to !6' relief requested 14' . and a S2ECIA-L
PE�ZMIT under Section 9 Paragraph 9.1 of the Zoning Bylaws in order to
alter and extent a second level to a ncn-conforming legally existing
structure located at 30 Innis St. The following members were present and
voting: William Sullivan, Walter Soule, John Fallone, Scott Karpinsk-41
and Joseph Faris.
The hear . ing was advertised in the Lawrence Eagle TrIbune on 7.27.96 and
8/1/96 and all abutter were notified by regular mail.
Upon a motion by Walter Soule and seconded by John 2allone, the Board
voted unanimously to Grant the Variance and Special Permit as requested
The petitioner has satisfied the provisions of Section 10, Paragraph
10.4 of the Zoning Bylaw and that the granting of these variances will
not adversely affect the neighborhood or derogate from the
intent and purpose of the Zoning By law.
The Board finds that the applicant has satisfied the provisions of
section 9, paragraph. 9.1 of the Zoning Bviaw and that such change,
extensiori or alteration shall not be substantially more detrimental than
the existing non -conforming structure to the neighborhood.
Note: The granting of the Variance and/or Special Pe=mit as requested by
the applicant does not necessarily ensure the granting of a Building
perniit as the applicant must abide by all applicable local, state and
federal building codes and regulations, Prior to the issuance of a
build.ing pe=mit as required by the Building Comrmissioner.
