Our family has lived on Prospect Street forfour generations; it has stayed a small, quiet neighborhood consisting of one- and two-story small residences. We would like it to stay that way. Their property is small and half a third story would be architecturally unsightly and would affect the value of our property. We did not object to their deck or to the second story they built earlier. However, since their house is 13 feet from our property line, a two- or three-story addition looking down into our bedrooms greatly affects our privacy and enjoyment of our home. Based on my 25 -years of professional experience in the construction management industry, in both commercial and public construction, the existing attached breezeway and garage are sub -standard by today's building standards. We are not only proposing to build a new addition for a much needed living space, but also to create a safer structure, which will be built by today's standards and codes. The third floor that everyone is referring to is simply a utilization of the space created by the roof over the family room. The pitch of the roof was designed not only for snow load, but also to match as close as possible to the profile of the existing roof.on. the house. By creating a room above the family room, the height of the roof ridge never changes, plus the fact that the overall height is more than a foot lower than what's allowed for houses or structures in this R-4 ��"i�strict, which is 35 feet. 130ARD OF APPEALS Peter D. & Eleanor M. Cox -2- September 8, 2005 The concern over privacy should not be an issue. There is already a view of our neighbor's house from our daughter's bedroom, which can be reverse viewed from their house. We pull our shades down at night for privacy. The view from the family room and the bedroom in the new addition will be at a much steeper angle limiting the view into their house and ours. The proposed addition brings the building footprint more into conformance to the zoning requirements in this R-4 district. The front will be closer to the 30 foot setback allowed and the back will move in approximately 2 1/2 feet forward, bringing that closer to conformance than where it stands now. This will also create more space in the backyard for our children. We have lived on Prospect Street for 16 years and have watched the neighborhood change with addition s/renovations with the most recent being a newly built home behind our property. A great deal of thought was put into this- addition. After speaking with the Building Department, we met with our architect and framer numerous times, making minor changes to the design to create what we wanted as well as making sure that we took into consideration the privacy issue with our neighbors as well as making the footprint conform more to the dimensional table in the Zoning Town Bylaws.. We used the zoning bylaws and dimensional tables as a guide in our design. We are offended by the Lambert's reference that the addition is architecturally unsightly. My professional experience alone would disagree with that remark. We know that this addition will effect our house value in a positive way, but our house is not the only house that effects the property value in the neighborhood. Our neighbor, the Lambert's objected when we requested a permit to build the second, floor of our house when we asked at the same time Peter D. & Eleanor M. Cox -3- September 8, 2005 to be permitted to build a shed in our yard and they did not want this, therefore we did not build the shed. We would like to refer back to what was stated earlier in this letter with their concern about privacy and we fail to see how it would affect the enjoyment of their home. The side of their house facing the proposed addition is the shady side of the house receiving only morning sun and late afternoon sun as does the opposite side of our house. Building the addition would not have any impact on the amount of sun they would receive during the day. Finally, requesting that no windows be put on their side of the addition is ridiculous; because it is exactly what it is ""an addition.," The opposite side of it is attached to the house causing it to have no windows on that side. Two windows per floor on that side is a bare minimum for daylight and emergency fire access egress.. If we did not put in these windows we would need to have lights on all day long Just to see in those rooms, which is not being- very energy efficient and creating additional monthly expense in electric bills. In closing, we feel our neighbor's concerns have no basis for a negative impact to the neighborhood. As a matter of fact, there are six letters of support from neighbors on the abutters list, specifically, the Erb family who live on the other side of the Lambert's and the Burke Family who live on the other side of us.
