This is a follow up letter pertaining to your request to remove one (1) Red maple (Acer rubrum) tree which is in close proximity to and is leaning over the yard and towards your home at 30 Summer Street. The tree was identified during a site visit by the Conservation Department on December 13, 2012. It was determined that the tree is located within the 25' No-Disturbance Zone pursuant to the North Andover Wetlands Protection Bylaw (C. 178 of the Code of North Andover). Removal of vegetation, including pruning and cutting, is prohibited within the No- Disturbance Zone except in rare circumstances, such as for safety. The tree is in close proximity to the house and leans heavily over the yard near the play set posing a safety hazard. The tree which is permitted to be removed is identified in the attached photos. The tree is located very near to an intermittent stream and associated Bordering Vegetated Wetland (BVW) and as such extreme care shall be taken when removing the tree. Due to the potential danger imposed by the tree, the Conservation Department will permit the removal to prevent possible injury or property damage. The tree cutting activities shall be limited to the one tree identified and shown in the attached photographs. Mr. Greenwood has also requested to prune some branches of two additional trees which overhang the play structure. Gentle pruning of these branches is allowed. Pruning must be completed in a manner which will ensure the survival of the trees. During the site visit, boards were observed to be placed over the bed of the intermittent stream leading to an area of lawn, leaf and brush dumping which is occurring within the BVW (see attached photos). The debris is to be removed from this area by hand only and properly disposed of and the boards are to be removed. 1600 Osgood Street,North Andover.,Massachusetts 01845 Phone 918.688.9530 fax 978.688.9542 Web www.townofnorthandover.com I� The approved cutting will be subject to the following conditions: ❖ The work approved in this letter shall be completed by March 31, 2013. ❖ No machinery shall enter the 25' No Disturbance Zone. ❖ No work shall occur in resource areas. ❖ All tree limbs, brush, and other debris materials shall be taken off site and disposed of properly. ❖ The stump of the tree shall not be removed and shall be left in place. Stumps may be ground down or cut flush with the landscape. ❖ Care shall be taken to prevent damage to surrounding trees during removal of the approved tree. ❖ Limbs of two additional trees which overhang the play set may be gently pruned. ❖ Upon completion of the tree removal, all disturbed areas shall be properly stabilized. ❖ The applicant shall notify this department immediately following completion of work for a final site inspection. Areas within 100-feet of wetland resource areas shall remain in a natural state and no further vegetation shall be removed without the prior approval of the Conservation Department/Commission.
