Dear Mr . Long :
The Board of Appeals held a public hearing on ,Monday evening , De -
cember 12 , 1983 upon the application of C . Hale and Margaret M ,
Cochran . The hearing was advertised in the North Andover Citizen
on -November . 23 and December 1 , 1983 and all abutters were notified
by reg.ular mail . The =.following _ members were present and voting :

The petitioner-- seeks a v-ariance from the provisions of Section .-7 ,
Paragra.p-h =7 . 3 and -Table-=.2- of -the--Zoning By--Law --to permi-t relief
from the side -setback requ-.i-rement - to all.ow the continued existence--.
of a shed.
The .- petitioner - testified -through counsel that the shed was constructed
too close to the- lot --line and when a recent plot plan was drawn for
the sale of the property the violation was discovered . Denial of the
.vari.ance would- create--a- hardship to the petitioner ;
Upon a motion _made- -by -14r • _ Fri zelIe and seconded _by _ Mr . Soule,-.the Board
voted- unanimously to--grant the variance as requested :
The Board -finds = that -Section 10 . 4 of the Zoning By Law h-as been - satis -
fied-. - In particular , the Board finds that the granting of . the variance
wil-17not derogate -from the intent and purpose of the By Law and 'that . -
a hardship will be incurred by the -petitioner if the varianceis - denied.

Every application for action by the Board shall be made on a form
approved by the Board. Thet.e_Jorms shall be furnished by the clerk,
upon request . Any communication purporting to be an application
shall be treated as . mere notice of intention to seek relief until
such time as it i`s . made on the official application form. All in-
formation called for by the form shall be furnished by the applicant
in the manner therein prescribed.

The petitioners recently purchased their Nome located
at 301 Summer Street , North Andover,. The engineers plot plan
done for the real estate closing disclosed that the small shed
located on the parcel was erected fourteen ( 14) feet from the
southerly lot line. The petitioners seek a variance from the
side yard set back requirement of the Zoning -By-Law in order
that the shed may be allowed to remain as originally constructed.
The shed is a small., aesthetically attractive structure ,
built of stone and wood frame . The area surrounding the shed
is nicely landscaped, with a buffer of trees running between
the shed and the main dwelling on the premises . The topo-
graphy of the parcel is such that the land slopes downward
toward the southerly side of the parcel where the shed stands .
The petitioners believe that a literal enforcement of
the By-Law in this instance would involve substantial hardship.
Due to the stone construction, the shed cannot be moved; and
due to the slope and shape of the lot, any re-placement of the.
shed would involve the cutting of trees and placing the shed
on an awkward location. Also, the relief sought would in no
way be a detriment to the public good, nor would it nullify
or substantially derogate from the intent or purpose of the
By-Law.
Wherefore , the petitioners respectfully request that
this Board grant a variance from the side-yard set back re-
quirement from thirty feet ( 30) to fourteen feet ( 14)-.
