Evidently,there is a problem with the neighbor who abuts the - property at 303 Hillside Avenue,Bob Anderson. He maintains a duck pen and feeds approximately 1/2 dozen ducks,which is also attracting large amounts of pigeons. The pigeons are congregating on the rooftops of the condo homes,and becoming a nuisance. Ms.Schubart and her associates have worked with Mr.Anderson amicably in the past,but the situation is getting to the point where it is becoming a problem. Her main question is this: When does a situation like this become a health hazard,and at what point should action be taken. She does not want to cause problems. They responded back with a phone call claiming they do not feed the pigeons. They admit to having 6 ducks, and they feed them. He claims that the warm roof vents cause the pigeons to roost on our roofs. He also claimed never to see pigeons eating any of the duck or small bird food that he puts out. We do have a video of him putting out food. The Andersons also responded with a letter stating that we should complain to Merrimack College about the pigeons also. He said he understand that the property has roof heaters (which we did not- we are in the process of installing those now)and that the Audobon Society told him that pigeons will use that heat. They deny ever feeding the pigeons, but say they will continue to feed the small birds&ducks. The complainant alleged that the property owner of 303 Hillside Avenue was causing an attractive nuisance. The owner had birds in a pen and many bird feeders. The food was attracting pigeons. On march 17, 2006, Health Department and Building Department personnel went to 33 Alcott Way and met with residents, received photos and observed the neighbor's birds from the occupants building. No pigeons were seen on that day. They also offered video evidence of the pigeons which was declined at the time. The nuisance appeared clear to the inspectors. As an attempt to mediate the situation, and supported by the Alcott Village residents, before issuing an Order Letter the inspectors decided to visit 303 Hillside and speak to the owner, Robert Anderson.Discussion of the complaint ensued.Mr. Anderson was granted a week to see if a solution to the complaint could be found.A reinspection by the Bldg.Insp.found that the bird feeders had been removed and the bird pen had been enclosed with wire. The Health Dept.contacted Great North Management,who informed us that the complainant was pleased with the action taken by the neighbor. In good faith,the Health and Bldg Departments have determined that there is to be no additional action taken at this time.If at a later date the pigeons become a nuisance again,action to have the birds removed may be initiated by the Building Department and an Order to Correct will come from the Health Dept. RECEIVED MAR 13 2006 Board Of Health Department North Andover,Massachusetts TOWN OF NORTH ANDOVER March 8, 2006 HEALTH DEPARTMENT To whom it may concern: I have been a resident of 33 Alcott Way, a townhouse in the Alcott Village community, since June 2004. Since then I have had a daily influx of up to 3-dozen pigeons, loudly swooping onto the back of my roof and chimney after feeding in the adjacent yard throughout the morning. This is not only disruptive,but has caused a large amount of bird dropping on the roof and patio. In the property adjacent to the rear of my unit resides a Mr. Robert Anderson(303 Hillside Rd.), who has a duck/geese pen that sits at the far end of his yard, which is next to the Alcott fence. I have watched him feed not only the geese,but he deliberately places abundant amounts of food on the ground accessible to the pigeons. These pigeons roost on my roof on a daily basis and repeatedly dive for visible food. I have brought this to the attention of the Alcott Board of Directors and they initially visited Mr. Anderson requesting that he stop feeding the pigeons. He denied feeding pigeons,but suggested that they may feed on the geese feed. He verbally told the Board members that he would try to devise something that would keep the pigeons from feeding on the geese food. This never happened. Since then the Board has had a lawyer contact Mr. Anderson in writing the same request which he responded by denying that the pigeons feed on his property. I have documented him feeding the pigeons with photos and video. Many approaches have been made to deter the pigeons from landing on the roof. An Owl figure was installed on the roof, a pest control agency tried trapping cages, an Ultra sound machine, a predator sound machine, and recently fishing wire installed on the roof to disrupt the flight pattern. Unfortunately, none of these endeavors have worked. The issue became even more prominent this winter with a significant roof leak with contaminated water, which entered my residence and three episodes of dead pigeons on my property with blood and tissue splattered over my driveway atci lawn. I have found out that these droppings may contain spores, as well as other organisms, which if become airborne can present a significant health risks such as histoplasmosis . Not only am I concerned for myself, and my neighbors,but also when the landscapers maintain the property the organism will become airborne and they too will be at risk. I am aware that Great North Management,the management company for Alcott Village, has contacted the Board of Health in the past on this issue. I'm sure it can be appreciated my concern in this manner. At this time I am pleading, as a resident and taxpayer of North Andover, for the Board of Health to intervene with this problem. You were previously notified via a letter sent to you by my client on January 4, 2005 that your actions on your property, which include the daily feeding of large amounts of birds, including numerous pigeons, have created damage to my client's buildings and property. Specifically, the Alcott Village Condominium has been damaged by the large amount of bird droppings on its buildings and by the large numbers of pigeons that congregate on my client's property and structures as a result of your feedings. Moreover, the residents of the Alcott Village Condominium have also been disturbed by the large numbers of pigeons overhead and their numerous droppings on their property. Your actions clearly constitute a private nuisance under Massachusetts law. A private nuisance is an "invasion of another's interest in the private use and enjoyment of land" LeClair v. Mazzaferro, 1994 WL 879976 at *3 (Mass. Superior Court). You could be held legally liable under the nuisance theory for permitting an activity on your "property which causes a substantial or unreasonable interference with the use and enjoyment of the property of another." Id. at *4. He maintains a duck pen and feeds approximately 1/2 dozen ducks,which is also attracting large amounts of pigeons. The pigeons are congregating on the rooftops of the condo homes,and becoming a nuisance. Ms.Schubart and her associates have worked with Mr.Anderson amicably in the past,but the situation is getting to the point where it is becoming a problem. Her main question is this: When does a situation like this become a health hazard,and at what point should action be taken. She does not want to cause problems. She has a board meeting tomorrow night,and would like to give the association some information. So,before,anyone from the Health Dept.Goes out,she would like to speak with Susan first.
