t!� 1. Plaintiff is an individual who resides in Revere, Massachusetts.
!� 2. The Defendants, Frank Serio, Jr. , Alfred E. Frizelle, William J. Sullivan,
Augustine Nickerson, are members or associate members of the. Zoning Board
!i of Appeals of the Town of North Andover, who rendered the decision.being
t appealed from.
3. Plaintiff filed an application for a zoning variance on property located at
308 Campbell Road in North Andover, Massachusetts.
} 4. This variance sought to allow the Plaintiff to keep a horse on the land with less I
�! than the required three acres.
5. On September 5, 1980, the North Andover Board of Appeals held a hearing on
Plaintiff's application and there was no opposition to the application. On
October 23, 1980, the Defendants issued a decision denying the variance,
a certified copy of which is attached as Exhibit "A" .
6. In its decision, the Defendants made findings of fact which are erroneous
i� and exceed the authority of the Board in that they were not supported by any
credible evidence.
7. The Defendent, Zoning Board of Appeals, failed to make and provide specific
' reasons for its decision as required by General Laws, Chapter 40A.
j 8. The Board exceeded its authority by erring in the application of the laws
pertinent to this petition.

9. The Plaintiff asserts that the Defendants', Zoning Board of Appeals decision
is contrary to both the law and the facts submitted.

!, WHEREFORE, the Plaintiff requests the following relief.
1. That the Court annul the decision of the Board.
