North Andover, MA
This office was contacted during the week of August 14, 2006 by Daniel Leary of Nex
Gen Energy Solutions, LLC. to discuss the above referenced proposed project, which
entails the installation of a 10 kW solar electric array in the vicinity of the main barn
consisting of 88 5' x 2' panels (8 rows of 11), totaling approximately 1,200 s.f. Each row
of panels would be supported by a lightweight aluminum structure and mounted on 4
6" concrete footings. These solar panels are being proposed to support agricultural
farming activities including the electric load of the barn, the high-efficiency drip
irrigation system, and the electric vehicle.
A site inspection was requested and conducted on August 17, 2006 for further review.
Present during this site meeting was Daniel Leary. I was also able to speak with you
briefly during this site review. The purpose of the inspection was to identify the
location of the proposed work and to determine if the work would require a filing with
the Conservation Commission or if the work was considered an exempt activity under
the Agricultural provisions and definitions set forth in the Wetlands Protection Act
(M.G.L. 131, section 40, 310 CMR 10.04).
In review of the project narrative and accompanying plan details provided, on-site
discussions, and the ensuing agricultural regulations, the Conservation Department has
determined that the although work is being proposed adjacent to a jurisdictional
wetland resource area, the work as described would be considered normal
improvement of land in agricultural use and therefore an exempt activity pursuant to
the Wetlands Protection Act(310 CMR 10.04 (c) 1. c.). Therefore, work as proposed is
allowable without a permit from the North Andover Conservation Commission or the
Department of Environmental Protection respectively.

The Conservation Department and the North Andover Conservation Commission are
extremely supportive of this environmentally sound initiative for renewable, emissions-
free energy and respectfully requests a site inspection upon completion of the project

Hi Scott,
I hope you had a great weekend. Here is the narrative on Smolak's Solar project.
FYI (which I think is of great importance, but not obvious as written below)-A total of 32 6"concrete sonotubes
would need to be installed (4 posts per panel=4 x 8).
Also,the narrative below does not indicate that the work is proposed pretty much directly adjacent to a wetland
resource area. We are talking about just feet away literally. It appears to me that the sonotubes need to be
placed within the 25'.
1 am certainly not against this project, but it is proposed in a location that the Commission would not normally
allow. I am told that the location as proposed is the location where the panels need to be.
Please advise. Thanks

main barn(50 ft west). The array consists of 88 5'x2'panels(8 rows of 11),totaling approximately 1200 gross
square feet. Each row of panels is supported by a lightweight aluminum structure, and mounted on four 6"
concrete footings,similar to fence posts. These posts will range from 3'-4'deep. The posts will be dug by hand
and with the assistance of the farms posthole auger(used for planting fruit trees). Construction will last
approximately 2 weeks, though the footings will be complete and covered in 3-5 days. The process will involve
limited ground-breaking,with only postholes required. The site is adjacent to a seasonal stream, optimally set to
reduce the impacts to agriculture(the size of this land makes it difficult to cultivate),while maintaining the greatest
possible distance from the stream.
Programmatic Intent. The array will be used to support agricultural activities at the farm, specifically
supplementing the electric load of the barn, high-efficiency drip irrigation system, and electric vehicle. The solar
array will also be incorporated into the farm's educational program. This system is expected to produce over
13,000 kilowatt-hours of renewable,emissions-free electricity per year, and is currently funded in part through a
rebate from the Massachusetts Technology Collaborative. Mike Smolak has discussed this project in detail with
the USDA and has their support. This solar project is monumental as it is the largest project of its type on a
private farm in the region.

that the work has been conducted as shown on the plan(s) and documents
referenced above, and as conditioned by the Commission.
i. An"As-Built" plan prepared and signed and stamped by a Registered
Professional Civil Engineer (and/or Registered Professional Land Surveyor)
of the Commonwealth,for the public record. This plan will include:
➢ "As-Built" post-development elevations of all drainage & stormwater
management structures constructed within 100 feet of any wetland
resource area. NOTE: If portions of the stormwater systems exist
partially within the Buffer Zone than the entire structure must be
depicted to accurately verify compliance.
➢ "As-Built" post-development elevations and grades of all filled or
altered wetland resource areas including the encompassing buffer
zone, which is regulated as a resource area under the local Wetland
Protection Bylaw.
➢ Distances from structures to wetland resource areas. Structures
include (but are not limited to) septic systems, additions, fences, sheds,
stone walls, pools, retaining walls, subsurface utilities and decks.
➢ A line showing the limit of work and the extent of existing erosion
control devices. "Work" includes any disturbance of soils or
vegetation.
➢ Location of all subsurface utilities entering the property.
76. The following special conditions shall survive the issuance of a Certificate of
Compliance (COC) for this project:
➢ 25' No-Disturbance Zone and a 50' No-Construction Zone shall be
established from the edge of adjacent wetland resource areas except in
those locations approved under this filing. Future work within 100' of
existing wetland resource areas will require a separate filing with the
NACC. The Conservation Administrator and/or other agents of the
NACC do not have the authority to waive these setbacks as established
under the local Bylaw (Condition #32);
➢ Discharge or spillage of pollutants (Condition #70);
➢ Prohibition of underground fuels (Condition #71);
➢ Limitations on the use of fertilizers, herbicides and pesticides
(Conditions #72).
