Floor is porous as the paint is worn; Old wooden pallets are directly on walk in floor. These absorb water and odors. Please attempt to pry them up and use non porous shelving that is 6 inches above the floor. Megan,the ice cream stand will open in a couple of weeks and the farm stand after that. I looked back at some of the inspections and also did a walk through.This is the list I came up with at this time. I can add to it if you have some thoughts. First of all, we are in the process of connecting to the town sewer and expect to be done within a month's time or sooner. The water from the ice cream area will be pumped into the grease trap and then pumped into our system into the sewer. I have enclosed a copy of the equipment that we have planned for thus far and will include anything else you suggest. We will, of course, have a hand wash sink, a triple basin sink, dip sinks at each of the sliding windows and a hot water heater. The refrigeration equipment will consist of a refrigerator, a walk in freezer, two 17 top dip cabinets with room for expansion, along with air conditioning. The floor will drain into a pump chamber and will be able to be hosed down and drained completely. The walls will be impervious panels and the ceiling will be washable as well. I have consulted with Paul Richardson of Richardson's Ice Cream and he has review- ed my plans and added suggestions. We will be using them as our supplier of ice cream and will not be making any ourselves. I have enclosed a check for$60 that your secretary has told me is the fee for reviewing the plan. Enclosed is a floorplan of the stance. I have designed the stand to be open from mid-August to Christmas. First, I am going to produce cider in our farmstand building, We haveconstructed the cider area in accord with the design the cider mill producer has given us as well as information given to us by the state. All of our cider will be sold retail at the s*and. The waste water will be simply wash water which will go through floor -to drains to a dry well which is already installed. Earlier in the year I spoke with Mike Graff and I told him I would check with the state about the dry well. I did 9-nd out from my brother John who spoke to DEQEand found there was no approval required. As a matter of convenience for our customers as well as ourselves we are renting a portable toilet. ,Ve also will be producing pies and donuts. The area for this will be smrrounded by nonporous walls, floor and ceiling. Baked products will be covered. I hope this sheds some light on what I am doing. Carcinogenicity Chlorothalonil: No evidence of carcinogenicity in dogs after administration for up to one year. Treament related increases in the incidence of renal tubular adenoma and carcinoma were observed in rats and male mice. Squamous cell adenomas and carcinomas were also observed in the forestomach of both species. The forestomach tumors seen in rodent studies are not relevant to human health,as humans do not possess an anatomical equivalent of the rodent forestomach. The relevance of renal tumors to human health is unclear,although metabolism data suggest that the dog,a species that is resistant to chlorothalonil-induced renal injury,may be more representative of humans than the rat. IARC identifies chlorothalonil as a 213 carcinogen(possibly carcinogenic to humans). Other Toxicity Information Studies on rats and mice have suggested that technical chlorothalonil(97%),when fed at high levels in the diet,may have oncogenic potential to these laboratory animals. However,neither chlorothalonil nor its metabolites interact with DNA and thus are not mutagenic. Tumor formation has been related to a non-genotoxic mechanism of action for which threshold levels have been established in rats and mice. Comprehensive dietary and worker exposure studies have shown exposure levels for humans to be well below these threshold levels. In addition,surveillance of chlorothalonil plant workers for over twenty years has not demonstrated any increase in oncogenic potential to humans. TOXICITY OF FLUMIOXAZIN TECHNICAL SUBCHRONIC: Compound related effects of Flumioxazin Technical noted in rats following subchronic exposures at high dose levels were hematotoxicity including anemia, and increases in liver, spleen, heart, kidney and thyroid weights. In dogs, the effects produced at high dose levels included a slight prolongation in activated partial thromboplastin time, increased cholesterol and phospholipid, elevated alkaline phosphatase, increased liver weights and histological changes in the liver. The lowest no-observable-effect-level (NOEL) in subchronic studies was 30 ppm in the three-month toxicity study in rats. CHRONIC/CARCINOGENICITY: In a one year dog feeding study, Flumioxazin Technical produced treatment-related changes in blood chemistry and increased liver weights at 100 and 1000 mg/kg/day. Minimal treatment-related histological changes were noted in the livers of animals in the 1000 mg/kg/day group. Based on these data the NOEL is 10 mg/kg/day. Dietary administration of Flumioxazin Technical for 18 months produced liver changes in mice of the 3000 and 7000 ppm groups. There was no evidence of any treatment-related oncogenic effect. The NOEL for this study is 300 ppm. Dietary administration of Flumioxazin Technical for 24 months produced anemia and chronic nephropathy in rats of the 500 and 1000 ppm groups. The anemia lasted throughout the treatment period, however, it was not progressive nor aplastic in nature. No evidence of an oncogenic effect was observed. The NOEL for this study is 50 ppm. The developmental effects noted consisted primarily of decreased number of live fetuses and fetal weights, cardiovascular abnormalities, wavy ribs and decreased number of ossified sacrococcygeal vertebral bodies. The developmental NOEL in the rat oral and dermal developmental toxicity studies were 10 and 100 mg/kg/day, respectively. The response in rabbits was very different from that in rats. No developmental toxicity was noted in rabbits at doses up to 3000 mg/kg/day, a dose well above the maternal NOEL of 1000 mg/kg/day. REPRODUCTION: Reproductive toxicity was observed in F1 males, P1 females and F1 females at 300 ppm Flumioxazin Technical, the highest dose tested and a dose that also produced signs of systemic toxicity. MUTAGENICITY: Flumioxazin Technical was not mutagenic in most in vitro assays: gene mutation and a chromosome aberration assay in the absence of metabolic activation. In three in vivo assays, chromosome aberration, unscheduled DNA synthesis and micronucleus assay, Flumioxazin Technical was not mutagenic. The only positive response was observed in the in vitro chromosome aberration assay in the presence of metabolic activation. Overall, Flumioxazin Technical does not present a genetic hazard. Ingestion: The acute oral toxicity of a 43.5% formulation of paraquat dichloride is 265 mg/kg for male rats and 175 mg/kg for female rats expressed as paraquat dichloride. An emetic is included in the formulation to induce vomiting. Signs and symptoms following ingestion include burning sensations, ulcerations of the mouth, tongue, pharynx and esophagus; vomiting, retching, and diarrhea may then ensue. A 1 to 3 week period of progressive kidney failure, liver complications, and pulmonary insufficiency may follow. Death is usually due to respiratory failure secondary to pulmonary fibrosis. Eye contact: Severe acute inflammatory changes may be the result of eye contact, reaching maximum effect in 12 to 24 hours. Surfactants tend to potentiate effects that develop after eye contact; the effects represent chemical burns. Although the eye injury may appear to be extensive, a slow but complete recovery usually occurs. Skin contact: Repeated and/or prolonged skin contact with the concentrated product can cause skin damage, including erythema, edema, and ulceration. Repeated and/or prolonged skin contact with the spray dilution may cause mild skin irritation. Contact of concentrated paraquat solutions with finger and toe nails may result in cracking and shedding; normal regrowth follows. Skin absorption: The intact skin is an effective barrier to paraquat. Paraquat penetrates intact human skin very slowly at a rate of less that 0.5% in 24 hours. The dermal toxicity in rabbit following a 24-hour skin exposure to a 43.5% formulation of paraquat dichloride is 83.9 mg/kg expressed as paraquat dichloride. A single application of this product is considered "moderately toxic" by skin absorption. Inhalation: Paraquat is not volatile; therefore, exposure to paraquat vapor is not applicable. The odor of this product is not paraquat; it is an added odorant intended to deter ingestion of the product. Prolonged inhalation or overexposure to aerosolized paraquat can cause irritation of the upper respiratory tract mucosa, as evidenced by a burning sensation, nose bleeds, and sore throat. These symptoms remit on cessation of exposure. Systemic toxicity is unlikely to develop following inhalation because typical spray droplets are not likely to be of respirable size. Effects of overexposure: The greatest hazards of paraquat exposure exist when the concentrated product (i.e. undiluted) is swallowed or allowed to remain in contact with the skin for a prolonged period. These circumstances can result in systemic poisoning which is severe, progressive, and frequently terminates in irreversible lung damage and death. The concentrated product can cause adverse local effects on eyes, skin, and nails. These problems are not normally seen with spray dilutions. No zoning ordinance or by-law shall regulate or restrict the interior.area of a single family residential building nor shall any such ordinance or by=law prohibit;regulateor restrict the use of land or structures for religious purposes or for educational purposes on land owned orleased by. the commonwealth or any of its agencies, subdivisions or bodies politic or by a religious sect or denomination,or by a nonprofit educational corporation;provided,however,that such land or structures may be subject to reasonable regulations concerning the bulk and height.of.structures and determining yard sizes,lot area,setbacks;open space,parking and building coverage requirements. Lands or structures used,or to be used by a public service corporation maybe . exempted in particular respects from the operation of a zoning ordinance or by-law if,upon petition of the corporation, the department of telecommunications and energy shall,after notice given pursuant to section eleven and public hearing in the town or city,determine the.exemptions required and find that the present or proposed use of.the land or.structure is reasonably necessaryy for the convenience or welfare of the public;provided however,thaf if lands:or structures used or to be. used by a public service corporation are located in more than one municipality such lands or structures may be exempted in particular respects from the operation of any zoning-ordinance or, by-law if,upon petition of the corporation,the department of telecommunications and energy shall after notice to all affected communities and public hearing in one of said municipalities,detemune the exemptions required and find that the present or proposed use of the land or structure is reasonably necessary for the convenience or welfare of the public. No zoning ordinance or bylaw in any city or town shallprohibit,.or require a special permit for,the use of land or structures,or the expansion of existing structures,for the primary,accessory or incidental purpose of operating a child care facility;provided,however,that such land or structures http://WWW.STATE.MA.US/LEGIS/LAWS/MGL/40A-3.HTM Page 1 of 2 M.G.L - Chapter 40, Section 3. 4/9/03 10:38 AM may be subject to reasonable regulations concerning the bulk and height of structures and determining yard sizes, lot area, setbacks, open space, parking and building coverage requirements. As used in this paragraph, the term ""child care facility" shall mean a day care center or a school age child care program, as those terms are defined in section nine of chapter twenty-eight A. Notwithstanding any general or special law to the contrary, local land use and health and safety laws, regulations, practices, ordinances, by-laws and decisions of a city or town shall not discriminate against a disabled person. Imposition of health and safety laws or land-use requirements on congregate living arrangements among non-related persons with disabilities that are not imposed on families and groups of similar size or other unrelated persons shall constitute discrimination. The provisions of this paragraph shall apply to every city or town, including, but not limited to the city of Boston and the city of Cambridge. Family day care home and large family day care home, as those terms are defined in section nine of chapter twenty-eight A, shall be an allowable use unless a city or town prohibits or specifically regulates such use in its zoning ordinances or by-laws. No provision of a zoning ordinance or by-law shall be valid which sets apart districts by any boundary line which may be changed without adoption of an amendment to the zoning ordinance or by-law. No zoning ordinance or by-law shall prohibit the owner and occupier of a residence which has been destroyed by fire or other natural holocaust from placing a manufactured home on the site of such residence and residing in such home for a period not to exceed twelve months while the residence is being rebuilt. Any such manufactured home shall be subject to the provisions of the state sanitary code. No dimensional lot requirement of a zoning ordinance or by-law, including but not limited to, set back, front yard, side yard,rear yard and open space shall apply to handicapped access ramps on private property used solely for the purpose of facilitating ingress or egress of a physically handicapped person, as defined in section thirteen A of chapter twenty-two. No zoning ordinance or by-law shall prohibit or unreasonably regulate the installation of solar energy systems or the building of structures that facilitate the collection of solar energy, except where necessary to protect the public health, safety or welfare. No zoning ordinance or by-law shall prohibit the construction or use of an antenna structure by a Federally licensed amateur radio operator. Zoning ordinances and by-laws may reasonably regulate the location and height of such antenna structures for the purposes of health, safety,or aesthetics; provided, however, that such ordinances and by-laws reasonably allow for sufficient height of such antenna structures so as to effectively accommodate amateur radio communications by federally licensed amateur radio operators and constitute the nunimum practicable regulation necessary to accomplish the legitimate purposes of the city or town enacting such ordinance or by-law.
