Mr.Brown,
This letter is prepared to support the recently issued Watershed Special Permit by the North Andover Planning
Board for the construction of an accessory inground pool and shed within the 100 foot Non-Discharge Zone of
the Lake Cochichewick watershed.
The property in question was created on November 26, 1986 and is shown as Parcel"B"on Plan No. 10519 at
the Essex North District Registry. Therefore,the lot is governed by Table 2 under Section 4.136"Watershed
Protection Division."under the Town of North Andover Zoning Bylaw which has a 100 foot"Non-
Disturbance"buffer zone from the edge of all wetland resource areas. The proposed inground pool and shed
fall within the 100 foot"Non-Disturbance zone.
Under Section 4.136-3(c)(ii)(6)...the following use is allowed by Special Permit;
`:
private association; outlets of all drainage swales; outlets of all detention ponds. All
storm water management systems shall employ Best Management Practices.
iii. Prohibited Uses: The following uses are specifically prohibited within the Non-Discharge
Buffer Zone.
(1) All of the Prohibited Use listed in Section 3(c)(iii) of this Watershed Protection District
Bylaw are prohibited in the Non-Discharge Zone.
(2) The use, or method of application of, any lawn care or garden product(fertilizer,
pesticide,herbicide)that may contribute to the degradation of the public water supply.
(3) The used of lawn care or garden products that are not organic or slow-release nitrogen.
iv. Building Requirements: All construction in the Watershed Protection District shall comply
with the best management practices for erosion, siltation, and storm water control in order
to preserve the purity of the ground water and the lake;to maintain the ground water table;
and to maintain the filtration and purification functions of the land.
c. Non-Disturbance Buffer Zone
There shall exist a Non-Disturbance Buffer Zone within the Watershed Protection District
which shall consist of all land areas located between one hundred fifty(150)feet and two
hundred fifty(250)feet horizontally from the annual mean high water mark of Lake
Cochichewick, and between seventy five (75) feet and one hundred fifty(15 0)feet
horizontally from the edge of all wetland resource areas (as defined in M.G.L. Chapter 131,
Section 40,and the Town Wetland Bylaw) located within the Watershed.
i. Allowed Uses:All of the Allowed Uses listed in Section 3 (a)(i) of this Watershed
Protection District Bylaw are allowed in the Non-Disturbance Zone except as noted.
ii. Uses allowed by Special Permit: The following uses shall be allowed within the Non-
Disturbance Buffer Zone only by Special Permit issued pursuant to Section 4 of this
Watershed Protection district Bylaw:
(1) Any activities which cause a change in topography or grade.
(2) Vegetation removal or cutting, other than in connection with agricultural uses or
maintenance of a landscape area.
(3) Construction of a new permanent structure only after a variance has been granted by
the Zoning Board if Appeals.
(4) Replacement of any permanent structure.-
(5) Any surface or sub-surface discharge, including but not limited to, storm water runoff;
drainage of any roadway that is maintained by the Division of Public Works or any
private association; outlets of all drainage swales; outlets of all detention ponds.
(6) Construction of any accessory structure or expansion of any existing structure by less
than twenty five (25)percent of the gross floor if the existing structure exceeds 2,500
square feet. (2006/41)
(7) Construction of any accessory structure or expansion of any existing structure by less
than fifty(50)percent of the gross floor area of the existing primary structure is less
then 2,500 square feet and the primary structure will be connected to municipal sewer
upon completion of the project. (2006/41)

Could you check into something for me. Recent decision by Planning Board for 316 Great Pond Road(Bill Karras)seems
to have some errors. First,he apparently did not apply for a variance but is placing a new permanent structure in the
Non-disturbance zone.Second,the lot is nonconforming(1.26 acres) in a R1 zone,and would have either had to get a
letter from you or go before the Board.The Planning Board in their findings of fact 1 b. specifically state that the lot is
conforming.So what's up?

After a public hearing given on the above date, and upon a motion by D.Kellogg and 2!d by R.Rowen to

The public hearing on the above referenced application was opened on April 15,2014 closed by the North
Andover Planning Board on May 6,2014.
On May 6,2014, upon a motion made by D.Kellogg and seconded by R.Rowen to GRANT a Watershed
Special Permit so as to allow the installation of an inground swimming pool, patio, shed, fence,
landscaping and associated grading and utilities within 100 feet of a wetland in the Non-Disturbance Zone
of the Watershed Protection District under the requirements of Section 4.136.3.c.ii.6 & 10.3 of the North
Andover Zoning Bylaw. This Special Permit was requested by Bill Karras, 316 Great Pond Road,North
Andover, MA 01845 on March 12, 2014. The applicant submitted a complete application, which was
noticed and reviewed in accordance with Section 10.52 of the Town of North Andover Zoning Bylaw and
MGL Chapter 40A, Section 9. The motion to approve was subject to the FINDINGS OF FACTS and
SPECIAL CONDITIONS set forth in this decision.
The Planning Board vote was unanimous. A special permit issued by the special permit granting
authority requires a vote of at least four members of a five-member board.
The applicant is hereby notified that should the applicant disagree with this decision, the applicant has the
right, under MGL Chapter 40A, Section 17, to appeal this decision within twenty days after the date this
decision has been filed with the Town Clerk.
In accordance with 4.136 the Planning Board makes the finding that the intent of the Bylaw, as well as its
specific criteria are met. This decision specifically stated by the Planning Board makes the following
FINDINGS OF FACT:
1) That as a result of the proposed construction in conjunction with other uses nearby,there will not be any
significant degradation of the quality or quantity of water in or entering Lake Cochichewick. The project
is located within an extremely environmental sensitive area and in close proximity to Lake
Cochichewick.The final design reflects extensive discussions between the Town and applicant to ensure
the continued protection of Lake Cochichewick and the safety and welfare of the residents of North
Andover.
a) The construction has been reviewed by Town Staff and the Town's consulting engineer, Lisa
Eggleston,and with the application of the erosion control measures and modifications to the drainage
and stormwater management designs, the consultant concluded that there will not be significant
degradation to the quality or quantity of water in or entering Lake Cochichewick. The site drainage
system and stormwater management design are designed in accordance with the Town Bylaw
requirements and Best Engineering and Management Practices. The plan has been reviewed by
the outside consulting engineer, Lisa Eggleston, as evidenced email correspondences dated April
8, 2014 and April 16, 2014. Further, adequate safeguards have been provided to mitigate
pollutants from entering Lake Cochichewick through the installation/implementation of the
following Best Management Practices relative to an inground pool and patio:
i) The new project will create approximately 1,038 sq. ft. of new impervious area that will
include the pool and the pool deck. All stormwater runoff will be routed to a 2' by 2'
infiltration trench on the southeastern side of the pool and the pool patio and the trench has
the capacity to store and infiltrate all stormwater runoff.
ii) The patio will be constructed using pavers with spaces to allow water flow.
iii) Best Management Practices (BMP)will be followed with regard to maintenance of the pool,
as stated in the document titled"Swimming Pool Maintenance Requirements"dated April 24,
2014, provided by Sullivan Engineering Group LLC. These BMPs includes maintenance of

the infiltration trench, proper storage of chemicals and pool draindown procedures..
Discharge of pool water into the town's stormwater management is strictly forbidden. The
"Best Management Practice"document referenced here will be noted in the deed.
iv) The limit of work has been marked on the plan to be as close to the proposed construction as
possible.No new lawn areas will be created.
v) Fertilizers are limited to those which are either organic or slow-release nitrogen and
phosphorous-free. The use of pavement sealants is prohibited. These restrictions will be noted
on the deed.
b) The existing lot complies with the current Zoning Bylaw with regard to frontage and acreage. The
lot was created before 1994 and is not subject to the Conservation Zone, as described in section
4.136.2.Table 1.
c) The existing structure is connected to the Town sewer and water systems.
2) There is no reasonable alternative location outside the General, Non-Disturbance, and the Non-
Discharge Zones for any discharge,structure or activity.
3) In addition, in accordance with Section 10.31 of the North Andover Zoning Bylaw,the Planning Board
makes the following FINDINGS OF FACT:
a) The specific site is an appropriate location for the proposed use as all feasible storm water and
erosion controls have been placed on the site;
b) The use will not adversely affect the neighborhood as the lot is located in a Residential 1 Zoning
District;
c) There will be no nuisance or serious hazard to vehicles or pedestrians;
d) Adequate and appropriate facilities are provided for the proper operation of the proposed use;
e) The Planning Board also makes a specific finding that the use is in harmony with the general purpose
and intent of the North Andover Zoning Bylaw.
Upon reaching the above findings,the Planning Board approves this Special Permit based upon the following
SPECIAL CONDITIONS:
1)Permit Definitions:
a) The"Locus"refers to the 54,962 sq.ft.parcel of land with frontage on Great Pond Road as
shown on Assessors Map 37A,Parcel 53,and also known as 316 Great Pond Road,North
Andover,Massachusetts.
b) The"Plans"refer to the plans prepared by Sullivan Engineering Group LLC,entitled"Site
Development Plan located in North Andover Massachusetts"
c) The"Project"or"316 Great Pond Road"refers to installation of an inground swimming pool,
patio, fence,shed,landscaping, and associated grading and utilities within 100 feet of a bordering
vegetated wetland in the Non-Disturbance Zone of the Watershed Protection District
d) The"Applicant"refers to Bill Karras,the applicant for the Watershed Special Permit.
e) The"Project Owner"refers to the person or entity holding the fee interest to the title to the Locus
from time to time,which can include but is not limited to the applicant,developer,and owner.

2) The Town Planner shall approve any changes made to these plans. Any changes deemed substantial
by the Town Planner would require a public hearing and modification by the Planning Board.
3) Prior to the endorsement of the Plan
a) The applicant shall incorporate the following conditions as a deed restriction and a copy of the
recorded deed shall be submitted to the Town Planner and included in the file. j
i) Fertilizers are limited to those which are either organic or slow-release nitrogen and
phosphorous-free.
ii) The use of pavement sealants is prohibited.
iii) Discharge of pool water into the town's stormwater management is strictly forbidden. The
"Best Management Practice" document titled "Swimming Pool Maintenance Requirements"
and dated April 24,2014 referenced here will be noted in the deed.
b) The applicant will provide copies of all Decisions, Notification and Orders of Conditions from
the North Andover Conservation Commission.
4) Prior to the start of construction or the issuance of a building permit:
a) A performance guarantee bond of four thousand dollars ($4,000.00) made out to the Town of
North Andover must be posted to insure that the construction, erosion control, measures, and
performance of any other condition contained herein will take place in accordance with the plans
and the conditions of this decision and to ensure that the as-built plans will be submitted.
b) The applicant shall designate an independent Environmental Monitor who shall be chosen in
consultation with the Planning Department and Conservation Department staff. The Monitor
shall submit weekly reports during the entire duration of the project and must be available upon
four (4) hour notice to inspect the site with the Planning Board staff. The Planning Staff may
reduce the frequency of reports upon review of such a request from the applicant.
c) All erosion control measures as shown on the plan must be in place and reviewed by the Town
Planner and Conservation Department.
d) A pre-construction meeting must be held with the developer,their construction employees,Planning
Department and Conservation Department (and other applicable departments)to discuss scheduling
of inspections to be conducted on the project and the construction schedule.
e) No new landscape or lawn areas are to be created. Fertilizers are limited to those which are either
organic or slow-release nitrogen and phosphorous-fi•ee.
5) Prior to release of the Performance Bond:
a) The applicant shall submit an as-built plan stamped by a Registered Professional Engineer in
Massachusetts that shows all construction, including storm water mitigation trenches and other
pertinent site features. This as-built plan shall be submitted to the Town Planner for approval and
must be provided in paper form as well as in SDF (Standard Digital File) format. The applicant
must also submit a letter fiom the architect and engineer of the project stating that the pool
installation and site layout substantially comply with the plans referenced at the end of this decision
as endorsed by the Planning Board. This as-built plan shall be submitted to the Town Planner for
approval.

b The Planning Board must by a majority vote make a finding that the site is in conformance with the
approved plan.
5) No open burning shall be done except as is permitted during burning season under the Fire Department
regulations.
6) The Contractor shall contact Dig Safe at least 72 hours prior to commencing excavation.
7) The provisions of this conditional approval shall apply to and be binding upon the applicant, it's
employees and all successors and assigns in interest or control.
8) This Special Permit approval shall be deemed to have lapsed May 6, 2016 (two years from the date of
issuance) exclusive of the time required to pursue or await determination of any appeals, unless
substantial use or construction has commenced within said two-year period. Substantial use or
construction will be determined by a majority vote of the Planning Board.
9) This decision must be filed with the North Essex Registry of Deeds. The following information is

Protection Division"under the Tour.of North Andover Zoning Bylaw which has a 100 foot"Non-
Disturbance'buffer zone from the edge of all wetland resource areas_ The proposed inground pool and shed
fah within the 100 foot"Non-Diswrbance"zone.
Under Section 4.136-3(c)(ii)(6)...the following use is allowed by Special Permit;
"Construction of Any accessory structure or exTausion of any existing structure by less than twenty live
(25)percent of the gross floor if the existing structure exceeds 2,500 square feet"
The accessory inground pool has a footprint of 848 square feet and the accessory shed has a footprint of 60
square feet 'herefore the total proposed accessary square footage is 908 square feet.
Per the Town Assessor'sfield card for the property,the total Gross Floor Area of the primary permanent
structure is 3,912 s.f(Main Floor=1,220 s.f,Upper Level= 1892 s.f,Finished Basement=800&Q. The
Bylaw allows 25`010 of 3,912 s.f.OR 378 square feet for construction of an accessory stnmacture.
Therefore,the proposed pool and shed construction(908 square feet)meets the standard for Special Permit
consideration since 908 square feet is LESS THAN 978 square feet. As such,the North Andover Planning
Beard issued a Watershed Special Permit with Conditions which was reviewed by an independent third party

storm water management systems shall employ Best Management Practices.
iii. Prohibited Uses: The following uses are specifically prohibited within the Non-Discharge
Buffer Zone.
(1) All of the Prohibited Use listed in Section 3(c)(iii) of this Watershed Protection District
Bylaw are prohibited in the Non-Discharge Zone.
(2) The use, or method of application of, any lawn care or garden product(fertilizer,
pesticide,herbicide)that may contribute to the degradation of the public water supply.
(3) The used of lawn care or garden products that are not organic or slow-release nitrogen.
iv. Building Requirements: All construction in the Watershed Protection District shall comply
with the best management practices for erosion, siltation,and storm water control in order
to preserve the purity of the ground water and the lake;to maintain the ground water table;
and to maintain the filtration and purification functions of the land.
c. Non-Disturbance Buffer Zone
There shall exist a Non-Disturbance Buffer Zone within the Watershed Protection District
which shall consist of all land areas located between one hundred fifty(150) feet and two
hundred fifty(250)feet horizontally from the annual mean high water mark of Lake
Cochichewick, and between seventy five (75) feet and one hundred fifty(150) feet
horizontally from the edge of all wetland resource areas (as defined in M.G.L. Chapter 131,
Section 40, and the Town Wetland Bylaw) located within the Watershed.
i. Allowed Uses: All of the Allowed Uses listed in Section 3 (a)(i)of this Watershed
Protection District Bylaw are allowed in the Non-Disturbance Zone except as noted.
ii. Uses allowed by Special Permit: The following uses shall be allowed within the Non-
Disturbance Buffer Zone only by Special Permit issued pursuant to Section 4 of this
Watershed Protection district Bylaw:
(1) Any activities which cause a change in topography or grade.
(2) Vegetation removal or cutting, other than in connection with agricultural uses or
maintenance of a landscape area.
(3) Construction of a new permanent structure only after a variance has been granted by
the Zoning Board if Appeals.
(4) Replacement of any permanent structure.-
(5) Any surface or sub-surface discharge, including but not limited to, storm water runoff;
drainage of any roadway that is maintained by the Division of Public Works or any
private association; outlets of all drainage swales; outlets of all detention ponds.
(6) Construction of any accessory structure or expansion of any existing structure by less
than twenty five(25)percent of the gross floor if the existing structure exceeds 2,500
square feet. (2006/41)
(7) Construction of any accessory structure or expansion of any existing structure by less
than fifty(50)percent of the gross floor area of the existing primary structure is less
then 2,500 square feet and the primary structure will be connected to municipal sewer
upon completion of the project. (2006/41)
iii. Prohibited Uses: The following uses are specifically prohibited within the Non-
Disturbance Buffer Zone:
(1) All of the Prohibited Uses listed in Section 3(c)(iii)of this Watershed Protection

NORTH ANDOVER ZONING BYLAW, SECTION 4.136 PARA. 2.B.1.
FINDINGS OF FACT•
The Planning Board makes the following findings regarding this
Special Permit as required by section 4. 136 of the Zoning Bylaws:
1. The proposed use and site design for this lot are
appropriate, due to it's location in Town.
2 . Adequate vehicular and pedestrian access into the surrounding
site has been provided.
3 . The applicant has met the requirements of the Town for a
Special Permit as stated in Section 4 . 136 of the Zoning
Bylaw.
4. Adequate and appropriate facilities will be provided for the
proper operation of the proposed use.
5. This application for construction within the Watershed
Protection District, Section 4. 136 of the North Andover
Zoning Bylaw, was specifically granted for construction or
regrading within 100 ' of a tributary to Lake Cochichewick.
The Planning Board has herein issued their approval for
construction within the Watershed Protection District with
the condition that this lot be tied into the existing sewer
system. The applicant has made every effort to minimize the
impact of the new construction on the Town's water supply.
The Planning Board finds under Section 4. 135 of the Zoning Bylaw
that the proposed site plan generally complies with the Town
Bylaw requirements but requires conditions in order to be
completely in compliance.
Upon reaching the above findings, the Planning Board approves
this Special Permit based upon the following conditions which
shall be submitted to the Board prior to signing the documents to
be filed with the North Essex Registry of Deeds.
SPECIAL CONDITIONS:
1. This decision shall be filed with the North Essex Registry
of Deeds. Included as part of this decision are the
following plans:

Any changes made to these plans shall be approved by the
Town Planner. Any changes that the planner may deem as
substantial shall require approval by the Planning Board.
2. The Order of Conditions approved by the North Andover
Conservation Commission, and modified on June 5, 1991
shall be considered as part of this decision.
3. The contractor shall contact Dig Safe at least 72 hours
prior to commencing any excavation.
4. Gas, Telephone, Cable and Electric utilities shall be
installed as specified by the respective utility companies.
5. All catch basins shall be protected and maintained with hay
bales to prevent siltation into the drain lines during
construction.
6. No open burning shall be done except as is permitted during
burning season under the Fire Department regulations.
7. No underground fuel storage shall be installed except as
may be allowed by Town Regulations.
8. Prior to a Certificate of Occupancy being issued for any
structures, this site shall have received all necessary
permits and approvals from the North Andover Board of
Health.
�9 Prior to the Building Permit being issued for the structure
and again prior to occupancy of the structure, the
applicant shall receive a written determination from the
Conservation Administrator that all work being done under
the jurisdiction of the Conservation Commission is being
satisfactorily performed and maintained.
10. The provisions of this conditional approval shall apply to
and be binding upon the applicant, it's employees and all
successors and assigns in interest or control.
11. The applicant agrees, as a part of this conditional
approval, that in no instance shall a septic system be
installed on Parcel B. The Planning Board has herein
issued their approval for construction within the Watershed
Protection District with the understanding that this lot
will be tied into the sewer system.
12 . In no instance shall the Applicant's proposed construction
be allowed to further impact the site than as proposed on
the plan referenced above in condition #1 of this approval.
13 . No pesticides, fertilizers or chemicals shall be used in
lawn care or maintenance. The applicant shall incorporate
this condition as a deed restriction,- a copy of the deed
shall be presented to the Planning Board and included in
the file.
14. Any Residential dwelling found on Parcel B shall be
guttered and drained by a pipe system into a leach pit. The
leach pit shall be a minimum of 1000 gallon concrete pit
with 24" depth of 1.5" stone around and beneath. Any runoff
associated with the proposed driveway access shall be
directed to and contained within the leach pit.
15. A No-Cut Zone shall exist outside the haybale and siltation
control lines as established by the NACC.
16. Prior to the Applicant receiving a Certificate of
Occupancy, ,Drainage easements and wetland restriction ,
,easements shall be granted to the Town of North Andover.
The easements shall be recorded with the Essex North
Registry of Deeds.
17. Prior to receiving a Certificate of Occupancy the applicant
shall submit a certified copy of an As-Built plan which
shows all construction including, �sewter lines, leach pits
and other pertinent site features. This As-Built shall be
submitted to the Town Planner for approval and shall be
stamped by both a certified land surveyor and practicing
engineer.
18. Afbond in the amount of' $5, 000.00 shall be posted with the
Planning Board for erosion control. This bond shall be in
the form of a passbook with both the applicant and the Town
of North Andover named directly.
X19. All site work shall be completed by November 15, 1991. Final
site grading and stabilization of all disturbed areas shall
be completed by September 15, 1991. Any slopes not
stabilized prior to Sept. 15, 1991 shall be sodded by the
applicant. Should this work not be completed by the
applicant the Planning Board may use the Erosion Control
Bond for this purpose.
- 20. �' The plans shall be revised so as to show the limit of work
and haybale line outside the existing tree line. This
Special Permit is granted with the condition that no
existing trees be removed for the proposed construction.

The Board of Appeals held a public hearing on Tuesday evening -March 13, 1990,
April 10, 1990 and May 1, 1990 upon the application of Warren & Joya Sideri request-
ing a variation from the requirements of Section 4.133, Paragraph 1,2,3 and 4 of
the Zoning Bylaw so as to permit construction of a single family dwelling within
100 feet of a tributary of the lake on the premises located at Great Pond Road,
Parcel B. The following members were present and voting: Frank Serio, Jr. ,
Chairman, Augustine Nickerson, Clerk, Walter Soule, Anna O'Connor and Louis Rissin.
The hearing was advertised in the North Andover Citizen on February 22, 1990 and
March 1, 1990 and all abutters were notified by regular mail.
Upon a motion made by Ms. O'Connor and seconded by Mr. Soule, the Board vz)red to
GRANT the variance as requested, upon the following condition, i. e. that. pctitioner '
hook-up proposed residence to Town sewer to be constructed on. Great Pond Goad, prior .
to issuance of Occupancy Permit. The vote was: in favor; Serio, Nickerson, Soule,
and O'Connor and one abstained, Rissin.
The Board finds that the petitioner has satisfied the .provisions of Section 1.01
Paragraph 10.4 of the Zoning Bylaw and that the granting of this variance will not
derogate from the intent and purpose of the Zoning Bylaw nor •will 'it advers~•ly
affect the neighborhood. The Board further finds that the siting of the proposed
single-family dwelling from the newly-designated edge of .the wetlands, as approved
by the Conservation Commission, presents a minimal 1.ntruslon into the 1.00' buffer
zone consistent with the purposes of the Watershed Protection Distr.ict..
