Dear Ms. Saint Andre, The Planning Department would like to have your interpretation of the applicability of the current Watershed Bylaw on the above referenced property. The applicant has petitioned for and received a variance for relief of frontage from the Zoning Board of Appeals on 1/21.187 . Further, the Planning Board endor-ed an "Approval tJc�t: lteyu i r �l" plan with regard to this property in 1987 . The applicant has also petitioned the Zoning Board of Appeals for a variance to construct a single family residence within the Non— disturbance zone of the Waterslied protection Di!.:trict . R ` To be more specific, I would like to ask you the following question: 1. Is Section 4 . 135 (Watershed Protection District) of the Forth Andover Zoning Bylaw to be considered a dimensional regulation. If so, would that mean this lot is subsequently not to be considered grandfathered by the 1987 ANR plan with regard to Section 4 . 135 of the Zoning Bylaw. I have refused to approve the "Form U" and subsequently tale Building Inspector has refused to issue the Bu i ld i nrj Permit for this site. The applicant has simultaniously filed with the Zoii_i.rly Board of Appeals as a party aggrieved to the Building Inspector for refusing to issue the Building Permit and the Planning Board for a Special Permit as required by the current Watershed Bylaw.
