Dear Mr. Long:
The Board of Appeals held a, public hearing on January 13 , 1987 upon
the application of Domenic Giarruso requesting a variance from the
.requirements of Section 7, Paragraph 7. 2 and Table 2 of the Zoning .
ByLaws so as to permit creation of anew lot on Salem Street with
insufficient frontage but meeting all other requirements . . The
following members were present and voting: Frank Serio, Jr. , Chair-
man, Alfred Frizelle,, Vice-chairman, Augustine Nickerson, Clerk,
Walter Soule and' Anna O'Connor. '
The hearing was advertised in the North Andover Citizen on December 24
and 31 , 1986 and all abutters were notified by regular mail .
Upon a motion made by Mr. Frizelle and seconded by Mr.. Soule , the
Board voted, unanimously, to GRANT the variance as requested, subject
to . the condition that ,the pool must be removed prior to conveying of
lot.
The .Board finds that the granting of this variance will not derogate
�from, the intent and purposes of the Zoning Bylaws nor adversely
affect the neighborhood.

Re: Giarusso-Pickles Property, Watershed Special Permit.
Dear Ms. Saint Andre,
The Planning Department would like to have your interpretation of
the applicability of the current Watershed Bylaw on the above
referenced property.
The applicant has petitioned for and received a variance for
relief of frontage from the Zoning Board of Appeals on 1/21.187 .
Further, the Planning Board endor-ed an "Approval tJc�t: lteyu i r �l"
plan with regard to this property in
1987 .
The applicant has also petitioned the Zoning Board of Appeals for
a variance to construct a single family residence within the Non—
disturbance zone of the Waterslied protection Di!.:trict . ']'hat
variance was granted on 12/12/89 (copy enclosed) with the
following wording:
" The Board (ZBA) finds that the petitioner has satisfied the
provisions of Section 10 , Paragraph 10 . 4 of: the Zoning lly I .1ws
and the granting of these variances will not der.odate from
the intent and purpose of the Zoning Bylaw r1or will i.t
adversely affect the neighborhood . It was determined that. the
1987 bylaw, which was the bylaw in effect at the time of the
formation of this lot, is the applicable law at this time . As
such, this Board has jurisdiction thereunder. "
The applicants attorney and the Zoning Board of Appeal both 1r. el

and not a use regulation.

` To be more specific, I would like to ask you the following
question:
1. Is Section 4 . 135 (Watershed Protection District) of the Forth
Andover Zoning Bylaw to be considered a dimensional
regulation. If so, would that mean this lot is subsequently
not to be considered grandfathered by the 1987 ANR plan with
regard to Section 4 . 135 of the Zoning Bylaw.
I have refused to approve the "Form U" and subsequently tale
Building Inspector has refused to issue the Bu i ld i nrj Permit for
this site. The applicant has simultaniously filed with the Zoii_i.rly
Board of Appeals as a party aggrieved to the Building Inspector
for refusing to issue the Building Permit and the Planning Board
for a Special Permit as required by the current Watershed Bylaw.
The applicant's petition will be heard by the ZBA on 'Tuesday ,
3/13/90. I would like to ask that you reply prior to that hearing
date.

voted, unanimously, to GRANT the variances as requested, subject to the
following condition:

was amended to require a minimum lot size of two acres within. a
R-2 district. However, Parcel B as shown on the AIIR plan
includes only 54 , 962 square feet of area .
The applicants have stated tliat Parcel B is "di.me>> ;iona 1. 1y
grandfathered under the provisions of H . G . L. Chapter 40A . " 1.11
order for Parcel B to be entitled to grandfathered stator: Wieder
