The current exemption for "homeowners" was extended to include owner
-occupied dwellings of six units or less and to allow such homeowners to
engage an individual for hire who does not possess a license, provided
that'the owner acts as supervisor. (State Building Code, Section 109.1.1)
DEFINITION OF HOMEOWNER:
Person(s) who owns a parcel of land on which he/she resides or intends to
reside, on which there is, or is intended to be, a one to six family dwell-
ing, attached or detached structures accessory to such use acid/or farm
structures. A person who constructs more than one home in a two-year
period shall not be considered a homeowner. Such "homeowner" shall submit
to the Building Official, on a form acceptable to the Bulding Official,
that he/she shall be responsible for all such work..performed under the
building permit. (Section 109.1.1)
The undersigned "homeowner" assumes responsibility for compliance with the
State Building Code and other applicable codes, by-laws, rules and
regulations.
The undersigned "homeowner" certifies that he/she understands the Town of
North Andover Building Department minimum inspection procedures and
requirements and that he/she will comply with said procedures and
requirements.

PREAMBLE
THIS AGREEMENT entered into this fourttl• ,
day of December,
1990, and executed in duplicate (each executed copy
constituting and original) between the Town of Andover
(hereinafter "Andover") and the Town of North Andover
(hereinafter "North Andover").
WITNESSETH:
WHEREAS: North Andover, in and under the terms and

WHEREAS: Andover, in and under the terms and conditions as
listed herein, desires to provide such sewer services to
North Andover.
NOW THEREFORE, in consideration of the mutual covenants and
agreements hereinafter contained, the parties agree to as
follows:
PART A
STANDARD TERMS AND CONDITIONS
I. Legal
1. Term
This agreement shall be in force until terminated by mutual -
agreement of the parties or until such time as the Agreement
is breached by either party and such breach is not remedied
as provided herein.
2. Amendments.
No officer, official or agent of Andover or North Andover
shall have or possess the power to amend, modify or alter
this agreement or waiver any of its conditions or to bind
the Town of Andover or the Town of North Andover by making
any promise or representation not contained herein and unless
a written amendment is executed by both parties.
3. Assignment.
This agreement shall not be assigned or transferred by
either party.
4. Cancellation.
This agreement will be subject to cancellation in the event
a court of competent jurisdiction restricts or limits;
directly or indirectly, any of Andover's rights to provide
such service.
5. Damages.
Andover will not be responsible in damages for any
interruption or failure to provide such service and shall be
saved and held harmless from any and all damages of any kind,
nature or description, which may arise as a result of making
this agreement and furnishing such service hereunder.
6. Hold Harmless.
Andover shall not be responsible in damages .for any failure
to provide or for interruption of such service. To this
extent, North Andover specifically agrees to save and hold
harmless Andover from all damages to real and personal
property occasioned or caused by making of the sewer
connection or connections herein referred to or caused by
the furnishing of such service hereunder; and, shall save
and keep harmless Andover from any and all such damages
occasioned thereby, except as provided for herein.
II. Regulations.
North Andover may not permit any further extension of the
sewer services without prior approval of Andover and, if
applicable,•the Greater Lawrence Sanitary District
(hereinafter referred to as GLSD.)
7. Decisions.
The parties reserve to their respective Town Managers the
right to decide all questions arising as to the proper
performance of this contract. Such Managers decisions shall
be final and may only be challenged if the decision is
arbitrary and capricious.
III. Rights
8. Deposits
Andover reserves the right to require North Andover to deposit,
in advance, a sum equal to the estimated costs for such
service during a period of one hundred eighty (180)days
at the Andover prevailing sewer charge.
9. Inspections.
Andover reserve the right to inspect and test and to require
North Andover to repair and replace the sewer lines and
appurtenant features contained within the town limits of
North Andover as required herein. Andover shall be
responsible to repair and replace the sewer lines and
appurtenant features contained within the town limits of
Andover. Such replacements or repairs, and the costs
thereof, shall be assumed and paid by North Andover.
10. Performance.
Despite the provisions of Section II, Paragraph 7 above; the
parties reserve the right, either in law or equity, by suit,
a complaint in the nature of mandamus, or other proceeding,
to enforce or ,compel performance of any or all covenants
herein contained.
11. Termination.
Andover reserves the right to terminate. this agreement after
giving North Andover ninety (90) days' notice, in writing,
of its intent to do so for North Andover's refusal to
fulfill any obligation or condition shown herein. The
discontinuance of service, for such cause, shall not release
North Andover from its obligation to pay all bills due in
accordance with this agreement.
IV. RESPONSIBILITIES
12. Points' of Responsibility.
Andover shall bear responsibility for the service at any
point inside the Town line of Andover. North Andover shall
bear responsibility for maintaining the system at any point
inside the Town line of North Andover.
13. Operator.
The parties shall notify and keep each other informed of the name
and emergency telephone number of the proper official to
contact regarding this service for North Andover.
14. Emergencies.
North Andover shall notify Andover's Department of Public
Works Director of any emergency or condition which may affect
the service supplied to North Andover by Andover.
Andover shall notify North Andover's Department of Public

V. Equipment and Operation
15. Service Mains and Manholes.
North Andover shall provide all service mains and manholes
and bear the costs for connecting said mains to and severing
them from Andover's system. The parties shall each be
responsible for the maintenance of such mains and manholes
within their respective town limits.
16. Metering Devices.
North Andover shall provide and maintain any and all devices
expressly requested by the Director of Public Works of
Andover and/or GLSD for the purposes of controlling,
measuring, transmitting and recording flow. Alternatively
the flow may be measured by the water meters to measure
flow.
17. Incorrect Meter Readings.
When it is determined that a service meter registered
incorrectly, an estimate of the amount of service furnished
through the faulty meter shall be prepared by the Director
of Public Works of Andover for the purposes of billing North
Andover. The estimate shall be based upon the average of
two (2) preceding readings of the meter, exclusive of
incorrect readings. When less than two (2) correct readings
are available, fewer readings, including some obtained after
the period of incorrect registration, may be used.
PART B
SPECIFIC TERMS AND CONDITIONS
I. Service to be Furnished
1. Use Restriction.
The service provided is limited to Lots 1 and 2 as shown on
a plan entitled "Plan of Land in North Andover, Mass. drawn
for John & Michael DiBetetto, 787 River Street, Haverhill,
Mass., May 1985, Scale: 1" = 40', Merrimack Engineering
Services, 66 Park Street, Andover, Massachusetts 01810" and
recorded with the Essex North District Registry of Deeds as
Plan No. 9953.
II. Funding and Appropriations
North Andover agrees to appropriate annually sufficient
money or so much thereof as may be necessary to provide
sufficient funds for the payment of the service furnished by
Andover hereunder. North Andover further agrees that it
will, at all times, charge its consumers sufficient rates in
order to provide adequate funds for payment of the service
furnished b.y Andover.
III. Rates and Billing
The service fee shall be set by the -Director of Public Works
and shall be at the same rate as established for Andover
residents. Andover shall bill North Andover in the same
intervals as established for residents of Andover for the
service furnished to North Andover under this agreement and
North Andover shall pay such bill within thirty (30) days of
the receipt of the same. Any bill remaining unpaid after
the thirtieth day of the date on which the bill is due 'shall
bear interest at the same rate charged to Andover residents,
computed from the due date on such bill.
1. Event of Non—Payment
In the event of Non—payment of the bill presented to the
Town of North Andover and remaining unpaid for sixty (60)
days, Andover reserves the right to require North Andover to
deposit, in advance, a sum equal to the average estimated
costs for such for a period of three hundred sixty—five
(365) days at the prevailing metered rate; said sum to be
deposited in an interest—bearing account and the interest
credited to North Andover.
PART C
FURTHER CONTRACT TERMS
I. Force Majeure
1. The term "force majeure", as used in this contract,
shall mean an act of God and any other event or effect that
cannot be reasonably anticipated or controlled.
2. In any case, by reason of force majeure, Andover is
rendered unable, wholly or in part, to carry out the obligations
under this contract, notice and full particulars of such
force majeure shall be given to North Andover by Andover,
in writing, within a reasonable period of time.
3. The obligations of Andover, upon giving of such notice to
North Andover, so far as is affected by force majeure,' shall
be suspended during the continuance of the inability claimed.
II. Service of Notice.
All notices or communications provided for herein shall be
in writing and shall:
As to the Town of Andover, be delivered to the Town
Manager's Office, Town Hall, Bartlet Street, Andover, MA. 01810,
with a copy to the Director of Public Works of the Town of
Andover at the foregoing address. _
As to the Town of North Andover; and its sewer users, be
delivered to the Town Manager's Office, Town Hall, 120 Main
Street, North Andover, MA. 01845.
III. Interpretation of Law
This agreement and all acts performed or required to be
performed hereunder shall be interpreted under the lams
of the Commonwealth of Massachusetts and jurisdiction shall
vest in said Massachusetts courts.
IV. Regulatory Authority
Any and all conditions, rules, regulations orders or other
requirements heretofore or hereafter placed upon the Town of
Andover by the GLSD and/or the Department of Environmental
Quality Engineering of the Commonwealth of Massachusetts and
by any court of competent jurisdiction and by any other
applicable Federal, State or County agency, shall be
construed to become a part of this contract. Further, any
additional costs placed upon the Town of Andover as a result
of any orders of the above referenced court or agencies in
connection with the supplying of the service to the Town of
Andover by the Town Andover shall be borne by said Town
of North Andover.
The infiltration/inflow for the portion of the sewer
(including house services) in North Andover shall meet
Andover standards.
IN 14ITNESS WHEREOF, on the date first mentioned, the
officials of the Town of Andover and of the Town of North
Andover hereto execute this agreement, in duplicate copies.
Said agreement, when so executed, to be recorded in the
office of the Town Clerk of the respective municipalities.

COVENANT
Whereas, Jenna Builders, Inc. (hereinafter, with their
successors and assigns referred to as the "Owner") is the
owners of certain property located in North Andover, MA more
particularly described as follows:
The land in North Andover, Essex County, Massachusetts and
being shown as Lot 1 as shown on a plan entitled "Plan of
Land in North Andover, Mass. drawn for John & Michael
DiBetetto, 787 River Street, Haverhill, Mass., May 1985,
Scale: 1" = 40', Merrimack Engineering Services, 66 Park
Street, Andover, Massachusetts 01810" and recorded with
Essex North District Registry of Deeds as Plan No. 9953 and
to which plan reference may be had for a more particular
description.
Being the same premises conveyed to said Owner by Deed of
John DiBitetto et alii, Trustees dated October 11, 1990 and
recorded with Essex North District Registry of Deeds in Book
3174, Page 138.
Whereas, the Owner desires that said lot tie into the sewer
system of the Town of Andover, (hereinafter referred to as
"Andover"), and
Whereas, the Town of North Andover (hereinafter referred to
as "North Andover") and Andover have agreed to permit said
tie in, and
Whereas, by the terms of said agreement between Andover and
North Andover, Andover shall bill North Andover for said
service and costs:
Now therefore, the parties agree as follows:
1. The Owner shall pay to North Andover all sums billed to
North Andover by Andover relating to the use and maintenance
of said sewer system or arising under the Agreement between
the Town of Andover and the Town of North Andover, dated
December 4, 1990.
2. All payments shall be made to North Andover within
thirty (30) days of the date of billing to the Owner by
North Andover.
3. Failure by the Owner to so pay shall be cause for North
Andover to terminate the agreement with Andover.
4. The Owner shall indemnify and hold harmless North
Andover and Andover from any and all damages, direct or
consequential arising from the use of said sewer system.
5. Notwithstanding paragraph 3 above, the Owner shall be
responsible for all costs associated with said sewer
connection and use, and upon failure to pay all sums when
due, any outstanding amounts shall be added to the Owner's
tax bill for the next tax period.

G. The Owner shall be billed for the services provided at
the then current rate for residents of Andover. In
addition, the Owner shall be responsible for all charges
made by Andover for said service, including the costs of
maintaining or disconnecting said service.
7. The service provided is for the benefit of. said Lot 1
exclusively.
8. The Owner shall have no right to extend the service to
any other property without the prior written consent of
Andover and North Andover.
9. The Owner shall comply with all metering requirements of
Andover, North Andover and the Greater Lawrence Sanitary
District.
This agreement shall be construed as a covenant running with
the land and shall be binding on the Owner, its successors
and assigns.
