RE: Selective removal of 12 trees located within Bordering Vegetated Wetland and the associated
Buffer Zone.
This letter pertains to your written request to remove fifteen (15) trees which are in close proximity to
your home and yard at 335 Chestnut Street and are within Bordering Vegetated Wetland (BVW) and
the associated Buffer Zone. The trees were reviewed during a site visit by the Conservation
Department with the homeowner on July 27, 2015. The trees which are permitted to be removed were
marked with blue and yellow ribbon and also identified on a Mortgage Inspection plan dated August
22, 2012. Twelve (12) of the fifteen (15) identified trees are permitted for removal while three (3), which
are in a wooded area and not within the maintained yard, were not approved and the marking ribbons
should be removed (identified as trees 11, 12 & 13 on the submitted plan). All twelve trees approved
for removal were observed to be dead, dying and/or a danger to the home.
'Determination of property ownership is the responsibility of the homeowner.
Due to the potential danger imposed by the trees, the Conservation Department will permit their
removal to prevent possible injury or property damage. These cutting activities shall be limited to the
twelve trees identified and shown in the submitted plan.
In addition, the Conservation Department requires that you plant a minimum of six (6) shrubs
(minimum 4 -foot in size) along the edge of lawn in the area of tree removal from the following list:
high -bush blueberry (Vaccinium corymbosum), winterberry (Ilex verticillate) or red -osier dogwood
(Cornus sericea/stolonifera). In addition, after discussion with the chairman of the North Andover
Conservation Commission (NACC), you may install an outlet pipe to an interior sump pump system to
relieve basement flooding. This pipe is to extend no more than 10 feet from basement at the rear of the
home.

The approved cutting and pipe installation will be subject to the following conditions:
❖ Please notify the Conservation Department prior to the start of work and provide a detail of how
trees within the BVW will be removed.
•3 No machinery shall enter the BVW or 25' No Disturbance Zone.
❖ All tree limbs, brush, and other debris materials shall be taken off site and disposed of properly.
❖ Stumps of the trees shall not be removed and shall be left in place. Stumps may be ground down or
cut flush with the landscape.
❖ No dirt will be stockpiled overnight within 100 feet of BVW.
❖ Care shall be taken to prevent damage to surrounding trees during removal of the approved trees.
❖ Upon completion of the tree removal and pipe installation, all disturbed areas shall be properly
stabilized and required shrubs planted as described herein.
•3 The applicant shall notify this department immediately following completion of work for a final site
inspection.
❖ Areas within 100 -feet of wetland resource areas shall remain in a natural state and no further
vegetation shall be removed without the prior approval of the Conservation
Department/ Commission.
❖ This permit shall expire six months from the date of issue.

Present Conditions: A certified wetlands ecologist, Richelle Angeli
(Arrow Environmental, LLC), completed a wetlands delineation on the
property, 335 Chestnut St. North Andover) and marked with pink
.ground flags and tree ribbons. A certified arborist, Guy Shepherd,
(Professional Environmental Services, LLC) completed a site inspection to
determine hazardous trees that are dead, dying, or compromised and that
pose a threat to safety and property. Mr. Shepherd marked fifteen (15 )
hazardous trees with navy blue and neon green tags.
Scope of Tree Removal: The tree removal will include 15 trees located on
the property of 335 Chestnut St. North Andover, MA. Trees will be
removed by Mayer Tree Service with saws, by hand and by crane. Stumps
will remain.

Present Conditions: A certified wetlands ecologist, Richelle Angeli

property, 335 Chestnut St. North Andover) and marked with pink
ground flags and tree ribbons. The proposed project will be greater
than 25 feet from any delineated line of wetlands (see plot plan with
detailed picture).
Scope of the Project: The installation of a sump pump tube will run
approximately 10 feet from the basement at back of the home to the
backyard. The discharge pipe will exit into daylight and discharge
greater than 25 feet from the edge of the wetlands. This tube will also
prevent storm and ground water from entering the home.
Rationale: This small project will have minimal impact on the wetland
resource areas as it will only prevent water from entering and mold
spores from propagating inside the home. Currently, there are two
residents in the home who suffer from asthma, one of whom is thirteen.
Damp conditions and mold spores have the potential to cause life-
threatening symptoms.
Request: We request an emergency action to install a sump pump for
the purpose of preventing water from entering our home and causing a
health problem for the owner/resident and his thirteen year old
daughter.
