The application contained a.wr-itten notification dated March 25, 1992 stating that the North Andover Board of Health granted variances to the provisions of: 310 CMR 15.14 Fig.#1: Distance to a slope of Title 5 of the State Environmental Code. Accompanying the application was a plan consisting of one sheet(s), titled as follows: Title: Sanitary Disposal System Location: Lot #5A Berry Street Municipality: North Andover, MA 01845 Applicant: Riding Realty Trust P.E. or R.S.: Thomas E. In the opinion of the Department, the requirements for the granting of a variance(s) as specified at 310 CMR 15.20 have not been satisfied. The applicant has',not proved that the enforcement of the provision(s) of the Code from which a variance is being sought would do manifest injustice and that the same degree of environmental protection required under Title 5 can be achieved without strict application of the subject provision(s). In accordance with 310 CMR 4.00, you have 60 days from the postmarked date of this letter in which to address the listed deficiencies. Within the 60 day time frame, the applicant is advised to allow for the appropriate Board of Health action on the revised submittal since the Department of Environmental Protection's subsequent action may be its final action and, therefore, any further filing in this matter would be considered a NEW application. If the applicant cannot accomodate the schedule of the Board of Health within the 60 day period, or for any other reason requires additional time, the applicant may, by written agreement with this Department, extend this schedule in accordance with 310 C,R 4.04(2)(f). The applicant is also advised that when the. Department receives the new information, it�will initiate a second technical review, and has an additional 30 days to rule upon the application. Should the application be deemed to be deficient for a second time, the application will be denied. Any person aggrieved by the decision of the Department of Environmental Protection may seek relief therefrom within thirty (30) days in superior court, as provided by the laws of this Commonwealth. Our office, in the presence of your health agent conducted deep hole observation test pits and percolation tests on the above referenced lot owned by Riding Realty Trust. Find attached a plan which includes topography, test pit locations, proposed driveway, house and septic system location. The plan also shows the location of a concrete barrier which is specifically located where the required slope cannot be achieved. The State Environmental Code, Title V, specifically 310 CMR. 15.20, states that Variances may be granted only as follows: "the Board of Health may vary the application of any provision of this Title ... when in its opinion (1) the enforcement thereof would do manifest injustice and (2) the applicant has proved that the same degree of environmental protection ... can be achieved without strict application of the particular provision." This lot consists of all upland. Local testing requirements have been done and have demonstrated that there is sufficient area and depth of soil to install a system. With one exception, the proposed system shall meet local regulations and will be 50% larger in size than Title V requires. The proposed barrier shall prevent sewage from breaking out onto the sloping surface of the ground in the later stages of the system's life. Sand having a perc rate of less than 2 minutes per inch shall be placed below and beyond the system as required. A strict interpretation of this requirement would mandate that the slope, as measured at a point located along a line drawn as a horizontal extension of the top surface of the washed stone at the calculated distance,should extend continuously to meet the natural grade. This is best demonstrated by using, as an example, a case where a near vertical slope is encountered. The required separation distance, using the above equation, would approach infinity as the slope approaches the vertical. In some cases this strict interpretation may cause undue hardship as maintaining the required slope may be impractical or even impossible for a particular site. In these cases one must not lose sight of the intent of this requirement. That is: to provide a simple and concise method for determining the required separation distance necessary to protect against surface breakout of the effluent. In the cases where the enforcement of the slope requirement would do manifest injustice, the applicant should demonstrate that the same degree of environmental protection against breakout can be achieved without strict application of this particular provision by performing a more detailed geohydrologic investigation of the site. Mr. Osgood wanted to know how high is the wall going to extend above existing ground level. Mr. Neve stated that it is not high, it's in the ground. There is 8' to 10' of fill in the back end of the lot. He stated that it is not a wall, it's an underground structure. Mr. Osgood asked how high the concrete is?. Mr. Neve responded that the concrete is going to extend from elevation 104 to elevation 111, which is about the average height of a foundation wall. Ms. Conboy asked what the finish grade is? Mr. Neve replied that the finish grade is elevation 112. Ms. Conboy stated that Mr. Rosati said if the variance was granted he would want 1)a concrete barrier to extend 2' into the natural grade and 2) a structural engineer to design the barrier. Mr. Neve presented Ms. Conboy with the return receipts from the abutters. Mrs. Poirier stated that she has no objections to the construction. Board of Health Town Hall North Andover, MA 01845 Re: Variance Request from Title V and the North Andover Board of Health Supplemental Rules and Regulations Riding Realty Trust, 242 Neck Road, Haverhill, MA Lot 5A Berry Street, North Andover Dear Board Members: At the request of Riding Realty Trust we are submitting plans and supplemental information to you in hopes that your Board will grant a Variance to Title V, allowing the use of a concrete barrier to cure the slope breakout requirement shown in 310 CMR 15.14 figure #1. Our office, in the presence of your health agent conducted deep hole observation test pits and percolation tests on the above referenced lot owned by Riding Realty Trust. Find attached a plan which includes topography, test pit locations, proposed driveway, house and septic system location. The plan also shows the location of a concrete barrier which is specifically located where the required slope cannot be achieved. The State Environmental Code, Title V, specifically 310 CMR. 15.20, states that Variances may be granted only as follows: "the Board of Health may vary the application of any provision of this Title ... when in its opinion (1) the enforcement thereof would do manifest injustice and (2) the applicant has proved that the same degree of environmental protection ... can be achieved without strict application of the particular provision." This lot consists of all upland. Local testing requirements have been done and have demonstrated that there is sufficient area and depth of soil to install a system. With one exception, the proposed system shall meet local regulations and will be 50% larger in size than Title V requires. The proposed barrier shall prevent sewage from breaking out onto the sloping surface of the ground in the later stages of the system's life. Sand having a perc rate of less than 2 minutes per inch shall be placed below and beyond the system as required. The system, as proposed, will provide the same degree of environmental protection as a standard system without a barrier. Not granting the Variance would create a hardship and will be manifestly unjust. The land would be rendered unbuildable even though it had been sufficiently tested. The slope requirement contained in Title V is not a function of the perc rate of the soil which is should be. Furthermore, the equation used to calculate the slope requirement is too general and leaves no judgement to the designer. It should not be generally applied since all lots have distinctly different slope and soil characteristics. Good judgement is necessary in this case. Please find attached a policy statement from the Department of Environmental Quality Engineering, now the Department of Environmental Protection (D.E.P.) As you can note, the tone of this policy is that barriers, even concrete walls are acceptable if properly designed and applied. As required under 310 CMR 15.20 the abutters of the Riding Realty Trust property have been notified of the hearing to be held. (Find the Notice attached.) Pare, P.E. Chief, Ground Water Regulation Section Illustrations A and B (Figure 1, 310 CMR 15.12 and 15.14) show "natural soil" around leaching pits, galleries, chambers and trenches. Section 15.02(17), however, allows leaching facilities to be constructed in fill material provided certain minimum criteria are satisfied. Questions have been raised about the method used to calculate the breakout prevention distance for facilities constructed in fill, and, in those cases where the fill material extends above natural grade, whether ( the slope as determined at the point of measurement must extend continuously until It meets natural grade. When reviewing a pproposed leaching facility which is to be constructed in fill, Figure 1 of Title 5 (Illustrations A,B, and C) shall apply. The location of disposal facilities in relation to adjacent downhill slopes is therefore determined by usinq the formula - distance = 150 x slope (y/x) - as .shown on the illustrations. A strict interpretation of this requirement would mandate that the slope, as measured at a point located along a line drawn as a horizontal extension of the top surface of the washed stone at the calculated distance,should extend continuously to meet the natural grade. This is best demonstrated by using, as an example, a case where a near vertical slope is encountered. The required separation distance, using the above equation, would approach infinity as the slope approaches the vertical. In some cases this strict interpretation may cause undue hardship as maintaining the required slope may be impractical or even impossible for a particular site. In these cases one must not lose sight of the intent of this requirement. That is: to provide a simple and concise method for determining the required separation distance necessary to protect against surface breakout of the effluent. In the cases where the enforcement of the slope requirement would do manifest injustice, the applicant should demonstrate that the same degree of environmental protection against breakout can be achieved without strict application of this particular provision by performing a more detailed geohydrologic investigation of the site. A variance to the slope requirement could then be granted pursuant to 310 CMR 15.20. A retaining wall or other flow restrictive barrier may be considered in these instances.
