The Board of Appeals held a public hearing on August 11, 1987 on the application of Robert Ladadini requesting Special Permit from the requirements of Section 4, Paragraph 4.122(14) of the Zoning ByLaws so as to permit legalization of existing 3 -dwelling unit situation on home purchased. The following members were present and voting: Frank Serio, Jr., Chairman, Augustine Nickerson, Clerk, William Sullivan, Raymond Vivenzio and Anna O'Connor. The hearing was advertised in the North Andover Citizen on May 21 and May 28, 1987 and all abutters were notified by regular mail. Upon a motion by Mr. Vivenzio and seconded by Ms. O'Connor, the Board voted to GRANT the Special Permit as requested with the condition that the driveway be added on as indicated on the plot plan six (6)' and three (3)', hot top. Mr. Sullivan abatained.from voting. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.3 of the Zoning•ByLaws and the granting of this Special Permit will not derogate from the intent and purposes of the Zoning ByLaws nor will it ad- versely affect the neighborhood. Road, North Andover to legalize the existing 3 - family dwelling thereon. We, the undersigned home owners and residents.on Bay State Road, hereby appeal the Board's approval,; as we feel.that since Mr. Labadini has petitions to permit the legalization of the property from a two family residence into a three family unit, he must first comply with all local and State Codes and ordinances as they apply to a multi -family dwelling. Inquiries made by us to the following Town officials - a. Plumbing Inspector - Mr. RegSie Landry b. Electrical Inspector - Mr. John J. Thorpson c. Ass't. Building Inspector - Mr Daniel McConaghy d. Fire Dept. Inspector - Lt. Andy Melnikas has determined that no Permits, Building, Plumbing or Electrical were..ever taken nor was the completed work. inspected and approved by the appropiate departments. No Fire Dept. inspection was ever requested or made to determine if the dwelling met with existing Fire codes. By State and local law, it is illegal.for anyone to live in the third apartment until all inspection require- ments are met and an Occupancy Permit is issued. I was only able to gain access to the first floor apartment. This unit has a smoke detector. Additionally, the stairwell leading to the upstairs apartment had smoke detectors. From my limited inspection I have the following questions. 1. Is the room to the rear an apartment or not? If so, what bathroom facilities do they have? 2. Since I could not gain access upstairs, are there any detectors? In summation, another question arises. If this property is in fact a three family dwelling, do the proper exits exist? Any topographical feature of the parcel of land relied upon for a variance, such as ledge, rock peat, or natural condition ofwater, brook, or river, shall be shown on the engineering plan. When a variance is requested to subdivide a parcel of land, the dimen- sions and area of the surrounding lots may be taken from the deed or lotting plan for comparison of the size of the lots in the neighborhood, noted on the plan as such, and marked "approximate". The plan shall be signed and bear the seal of a registered surveyor or engineer. Any plans presented with the petition shall remain a part of the records of the Board of Appeals. If living quarters are to be remodeled, or areas are to be converted into living quarters, in addition to the plot plan, five (5) copies of the.following described plans. shall be furnished: 1. A floor plan of each floor on which remodeling is to be done or areas converted into living quarters; 2. A floor plan showing the stairways, halls, doors opening into the halls; and exit doors of each floor or floors where no re- modeling or converting is to be done; 3.. The plans and elevations shall show all existing work. All Proposed work shall be shown in red. The size of each plan shall'be 11 x 17 or 17 x 22; it shall be drawn to scale, 1/4 inch equals one foot. All plans and elevations presented with the petition shall remain a part of the records of the Board of Appeals.
