C.131 S.40) and The North Andover Wetlands Protection Bylaw (C. 178 of the Code of North Andover). Dear Mr. and Mrs. Mayo: On June 20, 2000 this Department visually observed two unauthorized structures (sheds) located in a protected resource area. Please be aware that any work or structures proposed within 100' of a Bordering Vegetated Wetland (BVW) is subject to a Request for Determination of Applicability (RDA) or Notice of Intent (NOI) filing with the North Andover Conservation Commission (NACC) (Sections V and VI of the North Andover Regulations). Please be aware that you are in violation of the Massachusetts Wetland Protection Act (C.40 S.21D) and The North Andover Wetlands Protection Bylaw (Chapter 178 of the Code of North Andover). According to Section III (D)(4b) of the North Andover Wetlands Protection Bylaw, no structures are allowed within 50' of protected resource area. This Department mandates the removal of both sheds by no later than July 24, 2000. The structures must be relocated out of the 50' No Construction Zone. If you need clarification of the 50' No Construction Zone, please contact this Department. Failure to comply with the above mentioned deadline will result in additional penalties and / or fines. Please keep in mind that if a building permit was applied for, this situation would have been detected and resolved immediately. Please refer to the attached Enforcement Order. Bureau of Resource Protection - Wetlands s' and North Andover Wetland Massachusetts Wetlands Protection Act M.G.L. c. 131, §40 Protection Bylaw. 13 Order The Issuing Authority hereby orders the following (check all that apply): ❑ The property owner, his agents, permittees, and all others shall immediately cease and desist from the further activity affecting the Buffer Zone and/or wetland resource areas on this property. 'i, Wetland alterations resulting from said activity shall be corrected and the site returned to its original condition. ❑ Complete the attached Notice of Intent. The completed application and plans for all proposed work as required by the Act and regulations shall be filed with the Issuing Authority on or before (date). No further work shall be performed until a public hearing has been held and an Order of Conditions has been issued to regulate said work. 11 Appeals/Signatures An Enforcement Order issued by a conservation commission cannot be appealed to the Department of Environmental Protection, but may be filed in Superior Court. Massachusetts General Laws Chapter 131, Section 40 provides: "Whoever violates any provisions of this section shall be punished by a fine of not more than twenty-five thousand dollars or by imprisonment for not more than two years or both.
