J10,2003 if North Andover idover, MA 01845 North Andover Zoning Board of Appeals Request for a Special Permit 1. The particular use proposed for the land or structure: We are requesting a special permit for the purpose of constructing a deck on the back of our house, and a shed on the back side of our house. The deck will be used to enjoy open space in the back yard and to make a transition from inside the house to the back yard. The shed will be used for storing bicycles, a lawn mower, a snow blower, and yard tools. 2. The specific site is an appropriate location for such use, structure or condition: We have a set of French doors on the house for the purpose of opening onto a deck in the back yard. Our back yard is spacious and the deck would provide a natural transitional structure to exit the house and enjoy the open space in the back yard. The proposed deck is very simple and low to the ground and is 12' x 16' in size. The proposed shed is also a simple structure, 12' x 16' in size, of similar construction to the existing house, and set back from the neighbor's yard. Trees also separate the neighbor's house from the shed, so the shed would have very little impact on the neighbors. Even though both the deck and shed will be constructed in the back of our house and will be barely visible from the street, in should be noted we do not have neighbors across the street from our property. We have discussed both structures with our neighbors and they have no problems with the proposed shed or deck. 3. There will be no nuisance or serious hazard to the vehicles or pedestrians: Neither the deck nor shed would propose any problems to vehicles or pedestrians, as they are set back from the road and driveway at the back of the house. 4. Adequate and appropriate facilities will be provided for the proper operation of the proposed use: The proposed deck is of simple construction and suitable for use as defined by the building code. The deck is of wood construction and will have railings. The proposed shed is also of simple construction and designed for storage of items such as lawn mowers, snow blowers, tools, etc. 5. The use is in harmony with the purpose and intent of the zoning by-law: The use will be for residential purposes only, to enjoy open space in our back yard on the deck,' and to store residential equipment, items, and tools in a shed rather than in the main house. 6. Specific reference and response to the criteria required by the particular special permit for which this application is made: The proposed deck and shed will not be detrimental to the neighborhood. We are not planning on using construction materials that will outlast the existing house. The deck and shed will be of wood construction, not requiring foundations. Sincerely, y., . A. February 10, 2003 Town of North Andover North Andover, MA 01845 To: The North Andover Zoning Board of Appeals RE: Request for a Special Permit 1. 5. The use is in harmony with the purpose and intent of the zoning by-law: The use will be for residential purposes only, to enjoy open space in our back yard on the deck, and to store residential equipment, items, and tools in a shed rather than in the main house. 6. Specific reference and response to the criteria required by the particular special permit for which this application is made: The proposed deck and shed will not be detrimental to the neighborhood. We are not planning on using construction materials that will outlast the existing house. The deck and shed will be of wood construction, not requiring foundations.
