The following members were present: William J. Sullivan, Robert P. Ford, Ellen P. McIntyre, George M. Earley and Joseph D. LaGrasse. Upon a motion made by Ellen P. McIntyre, and 2nd by Scott k Karpinski, the Board voted to DENY the petitioner relief on the grounds that Section 6 is meant to be remedial and protective; and that the intent of the Bylaw as passed by Town Meeting is to eliminate internally lighted signs. Therefore, the Board voted to uphold Section 6, Paragraph 6.5. Voting in favor of the denial: William J. Sullivan, Robert P. Ford, Ellen P. McIntyre, George M. Earley and Joseph D. LaGrasse. Petitioner/Applicant ************************* MEMORANDUM OF LAW IN SUPPORT OF APPLICATION FOR A VARIANCE PERMITTING SIGN ILLUMINATION INTRODUCTION The petitioner/applicant, Kohl's Inc. ("Kohl's") is seeking permission of the Zoning Board of Appeals to have an internally illuminated sign on the pre-existing, but renovated, 86,000 s.f. retail store. FACTS 1. The petitioner/applicant, Kohl's, is a leading U.S. retailer opening stores through out Massachusetts on April 12, 2002 as a part of a major expansion into the New England Region. Most of the new Kohl's stores replace recently closed Bradlees and/or Caldor's stores and are located within retail shopping plazas. 2. The petitioner/applicant, Kohl's, uses throughout the country internally illuminated logo signs which is a critically important factor for retail visibility. These signs are typically only visible from the interior of the plaza or on immediately adjoining streets and ways. 3. The prior operator of the premises at 350 Winthrop Street, N..Andover, Massachusetts and many abutting and neighboring businesses have been and continue to use internally illuminated signs in order to maintain visibility and to encourage business. 4. The proposed sign does not contribute in any materially adverse manner to the dimishment of the dark sky given the pre-existing illumination and the scope of abutting uses maintaining said illuminated signs. 5. The failure to have an internally illuminated sign results in a competitive disadvantage, financial hardship and other lost business opportunity. ARGUMENT SINCE KOHL'S CAN DEMONSTRATE ALL THAT IS REQUIRED FOR A SIGN VARIANCE IF IT IS DETERMINED ONE IS REQUIRED, THE ZONING BOARD OF APPEALS SHOULD GRANT THE REQUESTED RELIEF. DISCUSSION Both the North Andover bylaws and Massachusetts General Laws c. 40A, § 10, authorizes the grant of a variance from the terms of a zoning by-law "where [t]he permit granting authority specifically finds that owing to circumstances relating to soil conditions, shape or topography of such land or structures and especially affecting such land or structures, but not affecting generally the zoning district in which it is located, a literal enforcement of the ordinance or by-law would involve substantial hardship, financial or otherwise, to the petitioner or appellant, and that the desirable relief can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the such ordinance or by-law." Mass. Gen. L. c. 40A, §10;_Kirkwood v. Board of Appeals of Rockport, 17 Mass. App. Ct. 423, 427 (1984); See also Section VI(E) of the Bylaw. Since Kohl's, based on the foregoing facts, meets these requirements this Board, as a matter of law, should grant the requested variance. 1. Uniqueness of the Premises: The subject premises are located with a shopping plaza which is a multi -use retail parcel. The subject building which has a square footage of 86,000 s.f. was formerly operated by another retailer who is now out of business on an involuntary basis. Kohl's seeks to reinstall a preexisting illuminated sign. The conditions of the parcel, layout of the structure and the building are pre -determined and are not subject to change without further zoning relief. This condition and these constraints are not apparent in the remainder of the zoning district and in the adjoining business community. 2. Literal Enforcement resulting in Hardship: It is obvious that if Kohl's a new Massachusetts retailer is not permitted to install an internally illuminated sign as proscribed by the bylaws, that there are direct financial impacts to Kohl's as well as other more intangible hardships. Furthermore, Kohl's will not be as effectively able to compete with the numerous other retailers who have internally illuminated signs. The hardship is further not self-created since the Kohl's is proposing this signage as a part of its complete renovation of the pre-existing department store. 3. Desirable Relief without Substantial Detriment to Public Good and Intent of Bylaws. The bylaws are designed to encourage the most appropriate uses of the land and to encourage uses which are appropriate in each zoning district. The general purpose behind illuminated sign restrictions is to foster the appropriate darkened environment in and around the community adjoining the proposed use. Whereas in the instant case the applicant is simply seeking to use the premises in the same manner previously used, there is absolutely no detriment either to the public good or to the spirit and intent of the bylaw.
