Due to the presence of Mosquito Brook on the property, it is difficult to construct a roadway that meets both Planning Board and Conservation Commission requirements without significantly impacting the environment. However, the Planning Board is convinced that sufficient upland exists on the site for the creation of one additional lot. The Board suggested that Mr. Joyce create two frontage exception lots which require 50' of frontage each and 3 times the required area for the zoning district. The property contains sufficient area but is lacking in frontage due to the unique shape of the lot. Mr. Joyce will need a special permit from the Planning Board for the creation of a frontage exception lot and for a common driveway however the Board has expressed their support for these permits. The Planning Board supports Mr. Joyce's application for a variance for the frontage due to the unique shape of the lot and the environmental impacts a subdivision roadway would have on this site. JOYCE Dear Members: This letter is at the request of your Chairman to evidence my efforts over the years to acquire frontage to this property. In 1987 I bought the property to the northerly side and changed the lot lines so as to expand the frontage. At that time the Planning Board signed a plan defining the exterior boundries of Rea Street and it is arguable that I have as much as 110' frontage, according to the plan enclosed herewith, s l n recorded in the North Essex Registry of Deeds as Plan #11090 The Town Meeting subsequently changed the zoning by-laws to require the 50' frontage through the building line of the parcel to prevent so-called "pork chop" lots. At the time I laid out these lots, the girth of the lot was not an issue and it is the girth that presently mandates the variance due to the change in zoning. When all these facts were presented to my engineer, he took the position that the rules and regulations governing registered land surveyors required him to show the 82.95' frontage as on the variance plan. This is entirely arguable and subjective but since the variance application is mandated by the girth issue, I agreed with the engineer to take the conservative position with respect to the frontage. As to my abutter to the south, the personal relationship over the years has precluded any possibility of acquiring frontage from them. Kindly regard.
