Regular Meeting
The BOARD OF APPEALS met on Monday evening, September 10, 1973, at 7'.30 P.M.
in the Town Office Building meeting room. The following members were present and
voting: Frank Serio, Jr., Chairman; Dr. Eugene A. Beliveau, Clerk; William N.
Salemme, Louis DiFruscio and Associate Member Alfred E. Frizelle, who sat. in place
of regular member Arthur R. Drummond.
There were 10 people present for the meeting.
There were no hearings scheduledi however, it was necessary to make decisions on
two hearings held last month.
1. AMEDIO SAN ANTONIO:
Mr. Serio read a letter received from Highway Surveyor William Cyr relative
to the drainage in the area of He~rltt Ave. Mr. Cyr said that there is a problem
but he doesn't see how the construction of two additional houses would make
conditions any worse.
The Board looked at the Assessor's map of the area and compared the sizes of the
other lots.
Mr. DiFruscio made a motion to grant the variance. There was no second.
Atty. Frizelle made a motion to DENY the petition on the basis of the failure of
the petitioner to show substantial hardship; Mr. Salemme seconded the motion and
the vote was ~ - 1, Mr. DiFruscio voted no. The Board found that the area is
zoned R-3, which requires 25,000 sq. ft. lots and that the formation of two lots
of 25,000 sq. ft. and one lot of 10,000 sq. ft. was too ~reat a deviation from
the requirements of the Zoning By-Law; also that there would be no hardship to
the petitioner, financial or otherwise. However, the Board would not be adverse
to the formation of one building lot.
2. THE ~.I/~/S, INC.
The Board had viewed the premises and further discussed with Mr. Regan how
many trees would be removed end the loaming and grading of some of the area.
Dr. Beliveau made a motion to ~ the special permit subject to the conditions
of ~rading, loaming and seeding the banks in the front and providtng a lO-foot
chain link fence with a dark green wind screen. Also~ to waive condition~2 of
the Board's decision dated July 8, 1971, so that only the necessary trees will
be removed to allow the construction of the four additional outdoor tennis courts
and the future addition of either one additional tennis court or two platform
tennis courts, all as shorn on the submitted plan. Mr. Sale,,me seconded the
motion and the vote was unanimous. The additional parking facilities will be
allowed provided the area is hot-topped and marked as required under the Zoning
By-Law. These additional tennis courts would not have any adverse effect to the
area; also, this would be inkeepingwith the recreational facility as allowed
under the original special permit.

DAVIS & FURBE~MACHINECO. V~OLATION:
Mrs. Mary Stone informed the Board that Davis & Furber Machine Co. was
violating the Board's decision dated April 12, 1972 relative to property on
Water and Clarendon Streets. One of the conditions was that D. & F. must give
first option to purchase the property to the present tenants. They did not
do so in Mrs. Stone's case. D. & F. sold the property to someone else ~ithout
first offering it to the Stones.
Mr. Serio said the Board will refer the matter to Town Oounsel for proper action.
