The North Andover Board of Appeals held a public hearing at its regular meeting in the Senior Center,
120R Main Street, North Andover, MA on Tuesday, October 12, 2004 at 7:30 PM upon the application of
Arthur & Gina Allen, 369Waverley Road, North Andover,'requesting a dimensional Variance from
Section 7, Paragraph 7.3, and Table 2 for relief of a front setback from the proposed family room/kitchen
and deck addition; and a Special Permit from Section 9, Paragraph 9.2 in order to extend a pre-existing;
non -conforming structure on a non -conforming lot. The said premise affected is property with frontage on
the West side of Waverley Road within the R-4 zoning district. The legal notice was published in the Eagle
Tribune on July 26 & August 2, 2004.
The following members were present: Ellen P. McIntyre, Joseph D. LaGrasse, Richard L Byers, and
Albert P. Manzi, III. The following non-voting members were present: John M. Pallone, Thomas D.
Ippolito, Richard M. Vaillancourt, and David R. Webster.
Upon a motion by Joseph D. LaGrasse and 2°d by Richard J. Byers the Board voted to GRANT a
dimensional Variance from Section 7, Paragraph 7.3 and Table 2 for relief of 14.7' from a front setback
from Greene Street in order to construct the proposed family room/kitchen and deck addition; and upon a
motion by Joseph D. LaGrasse and 2nd by Richard J. Byers the Board voted to GRANT a Special Permit
from Section 9, Paragraph 9.2 in order to allow a pre-existing building to be extended by a family-
room/kitchen and deck on a pre-existing, nonconforming lot per Plan of Land in North Andover, prepared
for owners Arthur & Gina Allen, 369 Waverly Road, North Andover, MA 01845 Date: July 10, 2004,
Revised: Sept.23, 2004 by Dante E. Bartolomeo, Henry R. Himber, 219 Salem Street, Andover, MA 01810,
and Proposed Additions & Renovations, Allen Residence, 369 Waverly, North Andover, MA, [sheets] 1-7,

The Board finds that the shape of this applicant's parcel has satisfied the provisions of Section 10,
paragraph 10.4 of the Zoning Bylaw in that the granting of this Variance will not adversely affect the
neighborhood per abutter's letters, or derogate from the intent and purpose of the Zoning Bylaw. Also, the
Board finds that the applicant has satisfied the provisions of Section 9, Paragraph 9.2 of the Zoning Bylaw
and that such change, extension or alteration, the 480 sq. ft. addition, shall not be substantially more
detrimental than the existing structure to the neighborhood.

Notice is hereby given that the Board of Appeals will hold a public hearing at the Senior

To North Andover Board of Assessors,
I am writing this letter on behalf of our neighbors, Arthur and Gina Allen,
369 Waverly Road. They are hoping to renovate their home with an addition. As
we have three children also, we can understand their desire and need to do this.
With prices of homes in this town being what they are, an addition is a more
viable option. Also, if we don't need to uproot our families by moving to a new
neighborhood when we are happy where we are, an addition is very attractive.
This addition can only increase the value of the home and surrounding
homes, as the house will have more to offer if and when the Allen's decide to sell
in the future.

The information herein is an abstract of more
specific requirements listed in the Zoning Board

STEP 1: ADMINISTRATOR PERMIT DENIAL:
The petitioner applies for a Building Permit and
receivers a Permit Denial form completed. -,by the
Building Commissioner.
STEP 2: VARIANCE APPLICATION FORM:
Petitioner completes an application form to petition the
Board of Appeals for a Variance. All information as
required in items 1 through and including 11 shall be
completed.
STEP 3: PLAN PREPARATION:
Petitioner submits all of the required plan information as
cited in section 10, page 4 of this form.
STEP 4: _OBTAIN LIST OF PARTIES IN INTEREST:
The petitioner requests from the Assessors Office a
certified list of Parties in Interest (abutters).
STEP 5: SUBMIT APPLICATION:
Petitioner submits one (1) original and 10 Xerox copies
of all the required information to the Town Clerk's Office
to be certified by the Town Clerk with the time and date
of filing. The original will be left at the Town Clerk's
Office, and the 10 Xerox copies will be left with the
Zoning Board of Appeals secretary.
. STEP 6: SCHEDULING OF BEARING: AND-.
PREPARATION OF' LEGAL NOTICE. `
The Office of the Zoning Board of Appeals schedules
the applicant for a hearing date and prepares the legal
notice for mailing to the parties in interest (abutters) and
for., publication in the newspaper. The petitioner is

The petitioner picks up the legal notice from the Office

notice to, the, local newspaper publication.
STEP 8: PUBLIC HEARING BEFORE THE ZONING
`BbARD OF APPEALS:
The petitioner should appear in his/her behalf, or be
represented by an agent or attorney. In the absence of
any appearance without due cause on behalf of the
petitioner, tho. Board shall decide on the matter by using
the information it has otherwiseYeceive.
STEP 9: DECISION:
After the hearing, a copy of the Board's decision will be
sent to all parties in interest. Any appeal of the Board's
decision may be made pursuant to Massachusetts
General Law ch. 40A sec. 17, within twenty (20) days
after the decision is filed with the Town Clerk.
~ STEP 10 RECORDING -T DECISION'AND k -ANS.
The petitioner is responsible for recording certification of
the decision and any accompanying plans at the Essex
County, North Registry of Deeds, 381 Common St.,
Lawrence MA, and shall complete the Certification of
Recording form and forward it to the Zoning Board of

A. The particular use proposed for the land, or structure.
We are requesting a variance on the side set -back dimensional requirement for the
purpose of constructing an addition. The addition will be used as additional Family
room, and Family Day Care (ground floor) and larger Living room and larger kitchen on
main floor.
B. The circumstances relating to conditions affecting the property for which the
variance is sought which do not affect generally the zoning district in which the property
is located.
We are desirous of building an addition. Our land runs along Waverly Road
(East) in the front and along Green Street (South) on the side. Our entire living space is
all on one floor and consists of a very small Living room (South), a small kitchen
(Southwest), a Bathroom (Northwest), and three bedrooms (North, and northeast). The
purposed new addition will expand our living room and kitchen which naturally would
need to be placed adjacent to the existing rooms on the Southern end of our home,
however, the addition is close to the side set -back requirement.
C. Facts which make up the hardship, financial or otherwise, which result from
literal enforcement of the applicable zoning restrictions...
Over fourteen years, since 1990, our family has grown, and our need for
additional living space to accommodate my husband and I, and three growing children is
essential. The addition will add much needed living room and kitchen space to an
already very small living room and kitchen. Our living room and kitchen are on the south
and southwest sides of our home, respectively, and if we move the addition toward the
northern end of our home it will not tie in with the pre-existing rooms, and instead will lie
adjacent to our bathroom and bedrooms. It will also be taking up valuable outdoor yard
area which we want to conserve.

D. Facts relied upon to support a finding that relief sought will be desirable and
without substantial detriment to the public good.
The proposed addition will run along the southerly side of our property, Green
Street, where there are no adjacent neighbors. Across Green Street is the Town
Housing Authority which has a very similar type set -back, and is also relatively close
to the road.
We are well within the set -back requirements related to our neighbors to the West and
North, but have also visited with them and shown them our proposed addition plans and
answered their questions and concerns. All our close neighbors have related to us that
they have no problems with our intended addition. Also I know of other neighbors with
similar plans of adding on to their existing homes to accommodate their growing family's
needs. We feel confident and committed to making our addition a desirable asset to our
neighborhood and its property values.
E. Facts relied upon to support a finding that relief sought may be given without
nullifying or substantially derogating from the intent or purpose of the zoning bylaw.
In our understanding, our Southerly side set -back of 20 feet is required to provide
sufficient distance between our dwelling and the towns road development requirements.
As far as a sidewalk is concerned, one already exists on the opposite side of Green Street,
adjacent to the Town Housing Authority, and any additional sidewalk needs would most
suitably tie into those on that side of the road.
In our case, Green Street does not run straight but at an odd westerly angle, which
creates a dilemma as you go further out into our back yard but does not easily lend itself
to road use or development due to its being directly in back of and behind our existing
house. There was at one time a garage in almost the exact spot of our proposed addition,
but was taken down and replaced with an addition to the existing home (now our Living
Room) which better served their purposes at the time. In 1990, my husband and I
removed the remaining foundation that had never been removed.

an Application for a Special
Permit
Ten (10) copies of the following information must be
submitted thirty 30 days prior to the first public hearing

The inforrnation-herein-isan abstract of more specific
requirements listed in the Zoning Board Rules and
Regulations and is not meant to supersede them. The
STEP 1: ADMINISTRATOR PERMIT DENIAL:
The petitioner applies'#ora 86ilding •Permit';and
receivers a.Permit Denial form completed by the Codes
Administrator.
STEP 2: SPECIAL PERMIT. AP.PLICATI.ON FORM:
Petitioner completes an application form to petition the
Board of Appeals for a Special Permit. All information
as required in items 1 through and including -1,1 shall be
completed.
STEP 3: PLAN PREPARATION: f
Petitioner submits all of the requited plan information as
cited in Section 10 page 4 of this form.
STEP 4: LIST OF PARTIES IN INTEREST:
The petitioner requests from the Assessors Office a
certified list of Parties in Interest (abutters).

STEP 6: SCHEDULING OF HEARING AND

The. Office` of-tfie`Zoning Board of Appeals schedules

for publication in the newspaper. The petitioner is

Re: Special Permit Written Documentation:
1. The particular use proposed for the land or structure:
We are requesting a variance on the left side set -back dimensional requirement for the
purpose of expanding our existing kitchen and family rooms.
2. The specific site is an appropriate location for such use, structure or condition.
We are desirous or expanding our existing kitchen and family rooms on the West side of
our house, which falls within the definition of "Pre-existing non -conforming".
Expanding on the West side will have the least impact on all adjacent property. Any
other location would not align with our existing kitchen and family room area and would
require additional side and front setbacks.
3. There will be no nuisance or serious hazards to vehicles or pedestrians.
All construction materials will be stored well inside the property (fenced in area) and will
be erected in-place as soon as possible. Construction debris from the existing structure
will be placed in a dumpster. Vehicles and pedestrians will not be subjected to any
serious hazards, building or otherwise.
4. Adequate facilities will be provided for the proper operation of the proposed use.
No additional sewer or water lines will be placed. No additional paved areas or other
public facilities are proposed. Utilities for the proposed expanded kitchen are either in
place or will be relocated and tied into existing water lines, drains etc. There will be no
additional people using or living in this house as a result of this addition. Hence, no
additional stress will be placed on the existing sewer or water systems.
5. The use is in harmony with the purpose and intent of the zoning by-law.
It is our understanding that the intent of the side setback requirement is to provide
adequate distance between dwellings in the zoning district. Our neighbors who border us
on the West (will be 10.5' closer than exists now but still 15.5' greater than required by
current zoning) and North (no change from existing) will not be substantially impacted
by this addition. The only land owner that will be slightly impacted is the Town of North
Andover (Town Layout Lines of Green Street) when we move 3.4 ` closer to same).
However, the proposed addition will be approximately 0.5' further on our land than a
garage that existed on same shown on N.E.R.D. plan #1456 (copy attached). Hence, we
claim no denigration to all our neighbors with the construction of this addition.

6. Specific reference and response to the criteria required by the particular special
permit for which this application is made.
The criteria for this special permit being requested for extension of a preexisting non-
conforming structure is based upon our appeal on a hardship caused by living
space/conditions.
When originally constructed, our home complied with the existing zoning requirements.
Since that time there have been a number of changes in the Town By -Laws relative to
zoning. When we moved in in 1990, the kitchen and family rooms were of adequate size
to meet all of our needs. However, as our family has grown and our children are nearing
their teenage years we are in dire need of additional kitchen and family space. To meet
these additional needs and remain in the Town that we have come to call our own, we
request approval of our proposed addition as presented.
