The relief requested is from lot area, all yard setbacks and street frontage. In accordance with the plan titled; Plan of Land prepared for Everett & Donna Whipple; dated June 15, 1998; drawn by Appleton Land Surveying, The following members were present: William J. Sullivan, Walter F. Soule, Raymond Vivenzio, Scott Karpinski, John Pallone, George Earley, Ellen McIntyre, Robert Ford, The hearing was advertised in the Lawrence Tribune on 7/28/98 & 8/4/99 and all abutters were notified by regular mail. This application was continued to the final hearing on 1/12/99. Upon a motion made by William Sullivan, and seconded by Walter Soule, the Board voted to deny the applicants request for a variance and zoning relief as follows; 1. No evidence was presented to show that there were unique conditions affecting the lot that would warrant a variance such as soil conditions, shape or topography of the land. 2. The Board found that the request would cause undue congestion in the area by creating two substandard lots. 3. The Board found that parking and other vehicular impacts would be substantially detrimental to the area and as such violate the purpose and intent of the zoning by-law. The motion passed as follows: The following members voted in favor of denial: Walter F. Soule, William J. Sullivan, Ellen McIntyre, Robert Ford. Lemaitre, M.D. 138 Haverhill St., #203 Andover, MA 01810 978-475-7765 November 4, 1998 To whom it may concern: Mr. Everett L. Whipple III is a 38 year old man in my care since 1985. He has been in chronic renal failure since that time. In the years that followed our first encounter, he has had to undergo dialysis, initially hemodialysis, then peritoneal dialysis. Between 1987 and 1991, Mr. Whipple also had 2 kidney transplants which both failed after 1 to 2 years. In February 1993, he began peritoneal dialysis and did well until mid-1994 when he underwent a subtotal parathyroidectomy for the bone disease of kidney failure. Things settled down for the next 3 years until February of 1998 when lie developed a severe peritonitis which necessitated surgery and prolonged hospitalization. He lost 20% of his body weight and was unable to carry on the activities of daily living. lIe was and remains out of work due to muscle weakness and general malaise. His recupera- tion is still ongoing at present. Needless to say, Mr. Whipple has had a turbulent medical life since 1985, and especially since February 1998. To say that hardship has been a way of life for this young man is truly an understatement. Any assistance which he can obtain would certainly ease the enormous burdens which lie has borne. Our neighborhood is an old neighborhood with many of the homes in need of some improvement. Each family, as they have bought Into the neighborhood has done so fully aware that the homes are older, some being two or three family dwellings. Before the Whipple's owned this property, it was not owner -occupied. All three apartments were rented out. The previous tenants caused much destruction to the property, and were inconsiderate of the neighbors. For example, they constantly had at least $ - 5 unregistered cars parked on the street that were not in working order. Many nights, and most weekends, they made repairs to those cars until 1.2 am, sanding, drilling, and spray painting, with their radios blaring, and causing a general disturbance. They took no pride in the house, the neighborhood or the value of the property. Since the Whipple's purchased the property, there have been many improvements in the quality of living in the neighborhood, particularly for those neighbors at the far end of Columbia Road. Immediately, the home became owner -occupied. The tenants were all replaced, and the noise and junk cars were gratefully gone! In addition, we saw that the yard became a play yard for their children, and their tenants' children, the interior of the entire house was renovated and a beautiful deck added to the side, and the front yard was manicured. The Whipple's helped bring some sense of pride to the neighborhood. Our understanding is that with the new single-family home they plan to build, the plans include the removal of the current old three -car garage that Is,. presently on their property. That plan will immediately improve the appearance of their property and of the neighborhood, in general. We don't feel that one single family home with parking off the street will add to any congestion in any major way. If the Whipples are willing to address the parking by removing the three stall garage, then it will improve the neighborhood by getting cars off the street! Adding a nice, new single family home to this area will be an added bonus. We were happy to hear that a young family would build a new home in an older neighborhood and take pride in the existing property, as well. As landlords, they will be still living adjacent to their rental property. We worry that if the Whippies leave the area in order to realize their goal of having a new home to raise their children in, that this property will revert to mere rental property once again. Donna and Everett Whipple have proven that they will build a home that will improve the appearance of the, neighborhood and that both the new property and their existing property will be well-maintained. Whipple III is a 38 year old pian in my care since 1985. He has been in chronic renal failure since that time. In the years that followed our first encounter, he has had to undergo dialysis, initially hemodialysis, then peritoneal dialysis. Between 1987 and 1991, Mr. Whipple also had 2 kidney transplants which both failed after 1 to 2 years. In February 1993, lie began peritoneal dialysis and did well until mid-1994 when he underwent a subtotal parathyroidectomy for the bone disease of kidney failure. Things settled down for the next 3 years until February of 1998 when he developed a severe peritonitis which necessitated surgery and prolonged hospitalization. He lost 20% of his body weight and was unable to carry on the activities of daily living. He was and remains out of work due to muscle weakness and general malaise. His recupera- tion is still ongoing at present. Needless to say, Mr. Whipple has had a turbulent medical life since 1.985, and especially since February 1.998. To say that hardship has been a way of life for this young man is truly an understatement. Any assistance which he can obtain would certainly ease the enormous burdens which he has borne. Sin ly, Paul N. Lemaitre, M.D. We feel the variance being requested by Donna Whipple would compound an already existing drainage problem. After heavy rains and winter run off, my neighbors and I have experienced erosion of our property and exposed tree roots. During the heavy rains last spring I had a river running from the Whippies back yard thru my back yard and into the Watson property. I know last spring was extreme with the rain but it has occurred every year. The lower Sutton Street area has developed a recent drainage problem and by squeezing another house and driveway into this already overdeveloped area could prove costly. To cover some of the other existing problems that some of the other residents brought up were the number of cars on Columbia Road due to tenant parking. Mr. & Mrs. Whipple already own a three family house, a garage and a small barn on these small lots. They claim that building a new house will enhance the neighborhood. We disagree. When you take away what little open space there is left it is not an improvement.
