MA 01845 in the R4 Zoning District. The Petitioner is requesting Variances from Table 2 of the Zoning Bylaws (Dimensional Requirements) for two side yard setbacks (left) in the R4 Zoning District. Legal notices were sent to all the certified abutters providedby the Town of North Andover, Assessors Office, and were published in the Eagle -Tribune, a newspaper of general circulation in the Town of North Andover, on April 19, 2016 and April 26, 2016 The following regular voting members were present, Albert P. Manzi, III, Adan Cuscia, Ellen P. McIntyre, and Doug Ludgin also associate member Alexandria Jacobs. Ellen McIntyre made a motion to Grant a Variance under per Section 7, paragraph 7.3 Yards (Setbacks), 7.3 2 Projections into Side Yards and Table 2 of the Zoning Bylaw in the R4 Zoning District to allow the construction of a two (2) story Building with a Setback Variance of 16.8 feet (side), be constructed where 20 foot setbacks are required and to allow the construction of a Salt Shed with a Setback Variance of 9.6 feet (side), be constntctcd where 20 foot setbacks are required, subject to the following three (3) conditions; The Inspector of Buildings filed Letter that address parking be dated, The Exterior Elevations and Wall sections (A2':1) prepared by Christiansen &, Sergi, Inc., Haverhill, Massachusetts and the Mylar show the correct building height. The following members voted in favor of the Variance were, Ellen McIntyre, Allan Cuscia, Douglas Ludgin, and Alexandria Jacobs. Not in Favor, Albert P. Manzi, II1. Vote 4-1 in favor Variance Granted. (a) concerning parking requirements: The proposed 7,100 SF Office Administration Building requires (21) spaces. Determination and Calculations: Other Business or Office Uses Not Otherwise Listed Above require: 3.0 per ksf GFA. Note 2: Where the computation of required parking spaces results in a fracitaoml number of 0.5 or above, the required number of parking spaces shall round up to the next whole number(Page 88). The existing 22,960 SF Building requires six (6) spaces. Determination and Calculations: I have determined the proposed use as a "municipal garage" as work vehicles will be transporting to and from and maintenance of Town vehicles and such will be taking place. The space is not being used for storage or warehousing. Other Industrial and Transportation Uses Not Otherwise Listed require: As Determined by the planning Board, but not less than 0.25 per ksf GFA. Note 2: Where the computation of required parking spaces results in a fractional number of 0.5 or above, the required number of parking spaces shall round up to the next whole number(Page 88). The proposed 8,000 SF Salt Shed requires zero (0) parking. Determination and Calculations: The Salt Shed will be used for bulk storage for seasonal use. It does not require parking. The total number of required parking for the facility is 27 spaces. OF , Procedure & Requirements for an Application for a Variance Twelve (12) copies of the following information must be submitted thirty 30 days prior to the first public hearing. Failure to submit the required information within the time periods prescribed may result in a dismissal by the Zoning Board of an application as incomplete. The information herein is an abstract of more specific requirements listed in the Zoning Board Rules and Regulations and is not meant to supersede them. When requesting a Variance from the requirements of MGLA ch. 40A, Sec. 10.4 and the North Andover Zoning By-laws, all dimensional requirements shall be clearly identified and factually supported.. All points, A -F, are required to be addressed with this application. A. The particular use proposed for the land or structure. B. The circumstances relating to soil conditions, shape or topography of such land or structures especially affecting the property for which the Variance is sought which do not affect generally the zoning district in which the property is located. C. Facts which make up the substantial hardship, financial or otherwise, which results from literal enforcement of the applicable zoning restrictions with respect to the land or building for which the variance is sought. D. Facts relied upon to support a finding that relief sought will be desirable and without substantial detriment to the public good. E. Facts relied upon to support a finding that relief sought may be given without nullifying or substantially derogating from the intent or purpose of the Ordinance. F. PLAN OF LAND Each application to the Zoning Board of Appeals shall be accompanied by the following described plan. Plans must be submitted with this application to the Town Clerk's Office and ZBA secretary at least thirty (30) days prior to the public hearing before the Zoning Board of appeals. A set of building elevation plans by a Registered Architect may be required when the application involves new construction/conversion/ and/or a proposed change in use. 10. A. Major Projects Major projects are those, which involve one of the following whether existing or proposed: 1) five (5) or more parking spaces, in three (3) or more dwelling units, M 2,000 square feet of building area. The proposed project consists of the redevelopment of the front portion of the Public Works property by the construction of a two story addition to the existing building. A bid alternate consists of the replacement of the existing salt shed located at the rear of the site. The property is abutted in the front by Osgood Street and on the left side (Side A) by Wayne Street. The side setback requirement for a corner lot in the R-4 District is 20'0" from the property line. Due to the fact that the property is overlapped on both Side A and Side B by the 50' no -build conservation restriction, the location of both the administration building and salt shed is severely limited. The proposed Administration Building will be 16.8' from the property line on Side A (along Wayne Street) requiring a variance approval of 3.2'. The new Salt Shed will be 9.6' from the property line on Side A requiring a variance approval of 10.4'. Both structures conform to the setback requirements for the front, rear and Side B. As a result of a Special Permit request in 1974, the Board of Appeals found that the site is an appropriate location for municipal (public works) use, that no serious hazard or nuisance was present, and that the neighborhood would not be adversely affected. Therefore, the granting by the Zoning Board of Appeals for the approval of the variance of the dimensional reduction of the Side A setback for both the Administration Building and Salt Shed would have no impact on the neighborhood and surrounding abutting properties.
