DECISION
The Board of Appeals held a regular meeting on November 12, 1991
continued to a special meeting on November 21, 1991 upon the
application of Mary Ellen Ostherr requesting a variation from the
requirements of Section 7, Paragraph 7.1 and 7.2 and Table 2 of
the Zoning Bylaw so as to permit relief from lot area and street
frontage on the premises at 386 Great Pond Road. The following
members were present and voting: Frank Serio, Jr., Chairman,
Walter Soule, Clerk, Raymond Vivenzio, Anna O'Connor and John
Pallone.
Upon motion made by Mr. Soule and second by Mrs. O'Connor the
Board voted unanimously to GRANT the variance as requested with
the following conditions:
1. Both lots must be tied into sewer.
2. Lot 1, with existing dwelling, shall tie into sewer
within one year from the date of this decision.
The Board finds that the granting of this variance will not
adversely affect the neighborhood or derogate from the intent and
purpose of the Zoning Bylaw. The Board finds that this lot
located immediately adjacent to the water treatment plant, is
subject to special circumstances not affecting other lots in the
area, and that the petitioner is suffering a hardship as a
result. Such circumstances include noise, light and activity, and
as applied to this long narrow lot create conditions sufficient
to warrant the variance requested.

The Board of Appeals held a regular meeting on Tuesday
evening, June 10,1997 and July 8, 1997 upon the petition of
Douglas Ely & Judith Zazula requesting a variance under
Section 4.136 Paragraph 3c (iii) (3) of the Zoning By -Law.
The request is for relief from gross floor area increase
limitation of 4.136 Paragraph 3c (iii) (3) in the Watershed
Protection district for the purpose of expansion to an
existing structure.
The following members were present and voting. William
Sullivan, Walter Soule, Robert Ford, Scott Karpinski & Ellen
McIntyre.
The hearing was advertised in the North Andover Citizen on
May 21, 1997 and May 28, 1997 all abutters were notified by
regular mail.
Upon a motion by Robert Ford seconded by Walter Soule to
Grant the petition to allow expansion of existing structure
greater than 25 percent, expansion of living space will be
40 percent and the rest is the garage and basement area in
R-1 Zoning District. The request was for relief from gross
floor area increase limitation in the Watershed Protection
district for the purpose of expansion to an existing
structure. Decision made with the condition that the tie
into the sewer system be done prior to.any building or
expansion. Voting members were: William Sullivan, Walter
Soule, Robert Ford, Scott Karpinski, and Ellen McIntyre.
The petitioner has satisfied the provisions of Section 10,
Paragraph 10.4 of the Zoning Bylaw and that the granting of
this variances will not adversely affect the neighborhood or
derogate from the intent and purpose of the Zoning By law.
Note: The granting of the Variance and/or Special Permit as
requested by the applicant does not necessarily ensure the
granting of a Building permit as the applicant must abide by
all applicable local, state and federal building codes and
regulations, prior to the issuance of a building permit as
required by the Building Commissioner.

After marketing your home for over a year, it is clear
to me, and our other brokers, that the new water treatment
plant abutting your property is the most serious obstacle
to a sale. When the leaves are off the trees, the plant
looms next door and detracts from the residential character of
the area. Unfortunately, there is additional noise from the
site which several potential buyers have mentioned as the
prime reason for not making an offer on your home.
Though it is difficult to estimate an exact figure, I
feel strongly that the plant has had a negative financial
impact on the value of your property.
