Re: 386 Great Pond Road
Ms. Ford,
Attached are copies of the soil evaluation for the above property as required by the
Special Permit issued by the town for the construction on this lot. As you are aware, the
percolation rate was determined at less than two minutes per inch at a depth of sixty
inches. These results clearly indicate the soil is suitable for infiltration of runoff, either
from the driveway area or roof area. An infiltrator concave plastic unit would likely be
suitable for either use, or alternatively, a simple stone filled trench would be sufficient
for the driveway runoff.
R
1p
Though the site conditions are favorable for the intended runoff recharge, I can't resist
again noting that I believe that the infiltration of rainfall with nitrogen levels recorded at
around .20 mg/I is of no benefit to the environment. Given the soils, proximity of the site
to the reservoir, and topography, groundwater recharge is of no significant value on this
site and is probably detrimental to environmental protection.
Please contact me if you have any questions.
Sincerely,
Steven Eriks ` of Mq

386 Great Pond Road
Special Permit - Watershed Protection District
The Planning Board makes the following findings regarding the application of Douglas I Ely, 386
Great Pond Road, North Andover, MA 01845, dated May 19, 1997, requesting a Special Permit
under Section 4.136 of the Zoning By -Law of the North Andover Zoning Bylaw to allow the
expansion of a single family home and appurtenances which will cause surface and sub -surface
discharge of stormwater within the Non -Discharge Zone of the Watershed Protection.
FINDINGS OF FACT:
In accordance with 4.136(4) the Planning Board makes the finding that the intent of the Bylaw, as well
as its specific criteria, are met. Specifically the Planning Board finds:
that as a result of the proposed construction in conjunction with other uses nearby, there will
not be any significant degradation of the quality or quantity of water in or entering Lake
Cochichewick. The Planning Board bases its findings on the following facts:
a) the home will be connected to the Town sewer system;
b) storm water mitigation will be constructed along the edge of the driveway and from the
residential structure for the existing and proposed sections to catch and treat all storm
water drainage;
C) the limit of clearing is restricted to the minimum necessary to construct the structure
and appurtenances;
d) a construction phasing plan and emergency response plan are required.
2. that there is no reasonable alternative location outside the Non -Discharge Buffer Zone for any
discharge, structure or activity, associated with the proposed driveway construction as the
access to the lot is located within the Non -Disturbance and Non -Discharge Zone.
In accordance with Section 10.31 of the North Andover Zoning Bylaw, the Planning Board makes the
following findings:
A. The specific site is an appropriate location for the proposed use as all feasible stormwater and
erosion controls have been placed on the site;
B. The use will not adversely affect the neighborhood as the lot is located in a residential zone;
C. There will be no nuisance or serious hazard to vehicles or pedestrians;
D. Adequate and appropriate facilities are provided' for the proper operation of the proposed use;
E. The Planning Board also makes a specific finding that the use is in harmony with the general
purpose and intent of the North Andover Zoning Bylaw.
Upon reaching the above findings, the Planning Board approves this Special Permit based upon the
following conditions:

APPEALS S
Petition #172-90
DECISION
The Board of Appeals held a regular meeting on November 12, 1991
continued to a special meeting on November 21, 1991 upon the
application of Mary Ellen Ostherr requesting a variation from the
requirements of Section 7, Paragraph 7.1 and 7.2 and Table 2 of
the Zoning Bylaw so as to permit relief from lot area and street
frontage on the premises at 386 Great Pond Road. The following
members were present and voting: Frank Serio, Jr., Chairman,
Walter Soule, Clerk, Raymond Vivenzio, Anna O'Connor and John
Pallone.
Upon motion made by Mr. Soule and second by Mrs. O'Connor the
Board voted unanimously to GRANT the variance as requested with
the following conditions:
1. Both lots must be tied into sewer.
2. Lot 1, with existing dwelling, shall tie into sewer
within one year from the date of this decision.
The Board finds that the granting of this variance will not
adversely affect the neighborhood or derogate from the intent and
purpose of the Zoning Bylaw. The Board finds that this lot
located immediately adjacent to the water treatment plant, is
subject to special circumstances not affecting other lots in the
area, and that the petitioner is suffering a hardship as a
result. Such circumstances include noise, light and activity, and
as applied to this long narrow lot create conditions sufficient
to warrant the variance requested.
Dated this 25th day of November, 1991.
