You applied for Section 8 rental assistance 5/22/95 when we opened our Section 8 waiting list. After being sent a top of the list letter from the housing authority, we had the initial briefing, your application and the information you provided us was third -party verified, a criminal offenders record information report was obtained and you had the final part of the briefing session and a Section 8 Voucher was issued to you on 10/3/95. You stated that you wished to stay in the unit in which you were currently living. You were told that as long as the unit passed the Housing Quality Inspection and the owner was willing to comply with the program requirements, you could surely do that. I did the initial inspection within two days of issuing the Voucher to you. The paperwork you returned to me that the owner was to fill out was returned incomplete - some were signed. I returned them to you. I also told you that the owner must do a one year lease with you - he said he couldn't do that because he would be discriminating against his other renters. He then changed and said he would do it, although you haven't submitted a lease for approval. This week I have had calls from Atty. Domenic Scalise, Sandy Starr at the North Andover Board of Health and Sen. Jajuga's office. I called Howard Wensley at the Massachusetts Department of Public Health in Boston today and discussed this issue with him. He told me, "a screen door is required". The inspection failed because there was no screen door. Otherwise, the unit and building were in very good condition. Ms. Hoyt came to this office with you one day and I tried to tell you that the only thing preventing Ms. Hoyt from receiving Section 8 Voucher rental assistance was the failed inspection; and when and if the screen door was installed I would go forward with her program participation. You told me that you had just spent a lot of money renovating the building. You said you cannot put a screen door on because it would hit the overhang; and, if it required a screen door, why didn't the North Andover Building Inspector require it at the time the renovations were done. On 12/18/95, I spoke to Mrs. Blackstock at the building inspector's office and she stated that didn't fall under Mr. Nicetta's jurisdiction, it would be the Board of Health. I then talked to Sandy Starr of the North Andover Board of Health and she stated a screen door is required. Ms. Starr called today to say that Ms. Hoyt went to her office and discussed the matter with her but Ms. Starr did not do an on-site inspection. I still felt correct in my understanding of the Mass. State Sanitary Code, Section 410:552: Screens for Doors. Therefore, I placed a call to Howard Wensley at the Mass. Dept. of Public Health and he stated "a screen door is required". I introduced myself to a gentleman who identified himself as the prospective new owner, and conducted an inspection. I inquired about the construction in progress, and whether the contractor responsible for the deleading might be on the premises. He stated that he was not. The gentleman also stated that the contractor was a professional in his field. It was acknowledged that proof of complete deleading would be provided to the renter by the contractor before return of the occupant would be allowed. Agent also observed new windows and frames, door ways, work on light fixtures, and plumbing disturbance in the bathroom. Furniture was covered with plastic, however the rugs were dusty and dirty. I was assurred that a complete cleaning would be accomplished before occupancy. There had previously been some discussion with the Building Department on work going on at that address that had run into some problems. Up until we received notification from the Building Department we were not aware of any work going on at that address. On January 6, 1995 a Mrs. G. Hoyt visited the Health office stating that she lived at 39 East Water Street, that the unit had just been sold and that there was renovation going on. She was concerned that there was deleading going on and she had not been properly notified or given any directions or information about when she could return to her apartment. She stated that there was paint, presumably containing lead, all over her furniture and other belongings.
