Thomas Scott, Trustee, dated December 16117993 and recorded in the Essex County Registry of Deeds in Book 03933 and
Page 0060, is the subject of review and approval under the Town ofNorth Andover Minimum Requirements for the
Subsurface Disposal of Sanitary Sewage A1.05 and C9.01(4). Said review and approval limits the maximum number of
bedrooms at this dwelling to the existing four (4) Bedrooms.
At the regularly scheduled North Andover Board of Health meeting held on March 26112009, the Board voted unanimously
to accept this deed restriction granted to them by the property owner allowing the existing septic system to be considered in
compliance with the requirements of Title V which otherwise would not be in compliance based upon the total number of
rooms. Reference made herein to a fidure upgrade of the existing system shall mean that a new system be engineered and
installed which conformsfully to the requirements eTitle V by using the actual number of rooms as the basis of the design of
the new system.
This review and approval is within the jurisdiction of the North Andover Board of Health and is subject to the JbIlowing
conditions.
I. A Title V inspection shall be conducted by a licensed Title V inspector hired by the Homeowner every three years to
ensure the health of the septic system,
2. There shall be no change to the configuration or number of bathrooms nor change in the occupancy of the home
without the upgrade of the septic system;
3. This approval will expire upon the entrance into any purchase and sale agreementfor the home and at such time, the
current Homeowner will be required to upgrade the existing septic system to conform with all the current Title V
requirements. The upgrade of the septic system must be completed prior to the sale of the property. Failure to
upgrade the subsurface disposal system will result in an immediate issuance of a Board of Health, Order to Correct,

upgraded or if and when the owners conduct a sewer tie-in.

Dear Mr. Bernstein:
At a regularly scheduled Board of Health meeting, which was held on Thursday, March 26, 2009, the Board of
Health made a motion on the following:
Motion
Dr. MacMillan made a motion to authorize the Health Director, to secure an agreement from the homeowner
as follows:
1. Conduct a Title 5 inspection every three years to ensure the health of the septic system
2. Prepare a deed restriction to maintain the half bathroom on first floor, as outlined in the current
plan.
3. The Board of Health will accept the current deed restriction to limit the home to four bedrooms. This
approval will expire upon the entrance into any purchase and sales agreement for the home.
4. The deed restrictions would be lifted prior to, or at the time of the sale when the septic system is
appropriately upgraded or if and when the owners conduct a sewer tie-in.
The motion was seconded by Anne Brennan. All were in favor.
Please note that the documents requested must be legally binding documents submitted and approved by the Health
Department prior to registering them as official deed restrictions.
The homeowners building project may move forward once all these requirements have been met, and the Board of
Health has copies of all the appropriate paperwork. Thank you for your assistance in this matter.

Re: 39 Hawkins Lane
This letter is to request to be on the agenda of the next Board of Health hearing
scheduled for March 26th 2009 for the purpose of seeking a variance to the Title 5
flow requirements for this property.
The existing house includes 4 bedrooms on the 2nd floor, 4 rooms on the 1st floor
and a finished recreation room in the basement. The proposal is to build an
addition consisting of 2 rooms off the living room on the 1st floor, one to be used
as an exercise room and the other as a home office.
It is our intention to register a deed restriction limiting the use of the house to the
existing 4 bedrooms. We are aware that this variance would be contingent upon
passing a Title 5 inspection, which we hope to complete prior to the hearing date.
We further understand that in the future if the house was to be used for more
than 4 bedrooms, the existing on-site septic system would have to be upgraded
to conform to current Title 5 requirements and that Board of Health approval
would be required.

Good Afternoon Steve and Nathan,
It was a pleasure speaking to you both today in regards to the application for a 10 -day emergency beaver permit,
submitted by Nathan Slack, representing the homeowner of 39 Hawkins Lane. After reviewing the; file, application,
aerial photographs and discussing the issues with you, it has been determined that these circumstances do not currently
meet the criteria for an emergency permit as described in the MA General Law noted below. Items A — J. The application
as written is therefore denied.

However, as I noted, the open trapping season begins in Massachusetts on November I't. At which time a permit will not
be necessary to trap beaver. The season runs until April.
We also discussed some possible long term solutions such as installing a low flow device through the dam and needing
temporary approval to breach the dam to install such a device. If the situation warrants a long term solution, we can
discuss the process. However, please note that not all situations warrant the tampering of water levels and flow.
When you and your client have determined your desired course of action, please contact Heidi, our Conservation
Associate. She will be able to assist you through the system. Note that any time of the year, permits are required for any
work on a dam. The state has a stiff penalty of up to $10,000 for persons who disturb beaver dams within the
Commonwealth.

I think this is acceptable. There is a number 5 with no words. This should probably be removed.
We talked about the system becoming in full compliance with this restriction even with the extra
rooms. The need for an upgrade to conform 'fully' with Title 5 by using the real number of rooms as
the basis of system is not addressed directly here. What do you think? I think there is not a good way
to write it clearly in an agreement and we should make our intent clear in the meeting minutes. I sent
it to the other members and asked them to comment to you tomorrow.

I think this is acceptable. There is a number 5 with no words. This should probably be removed.
We talked about the system becoming in full compliance with this restriction even with the extra
rooms. The need for an upgrade to conform 'fully' with Title 5 by using the real number of rooms as
the basis of system is not addressed directly here. What do you think? I think there is not a good way
to write it clearly in an agreement and we should make our intent clear in the meeting minutes. I sent
it to the other members and asked them to comment to you tomorrow.

Dear Ms. Bligh and Mr. Barrett,
On May 25, 2006 the North Andover Conservation Conunission issued an Enforcement Order to
perform work within the limits of Boston Brook, located at 39 Hawkins Lane. Specific work
includes breeching the existing beaver dam and subsequently installing a water flow I device at the
culvert on Hawkins Lanes, in order to alleviate flooding in and around the Granville Lane, Hawkins
Lane and RaleighTavern Lane areas. The deadline date to complete these activities is set at June 9,

Hi Mr. Scott, I believe the town has a Beaver deceiver and flow device in the location of this beaver dam, at the
culvert. I have contacted the DPW and they will send someone out to check on the deceiver and pipe and make sure it is
functioning as intended. If it needs to be maintained they will do so and the water level will return to the level that the
flow device allows for. I will check in with the DPW at the end of the week and see what they found and can contact
you. I am hopeful that this will resolve the rising water level issue, however if it does not or if you have additional
concerns we can discuss them at that time.

Good Afternoon Steve and Nathan,
It was a pleasure speaking to you both today in regards to the application for a 1 O -day emergency beaver permit,
submitted by Nathan Slack, representing the homeowner of 39 Hawkins Lane. After reviewing the; file,
application, aerial photographs and discussing the issues with you, it has been determined that these
circumstances do not currently meet the criteria for an emergency permit as described in the MA General Law
noted below. Items A — J. The application as written is therefore denied.

However, as I noted, the open trapping season begins in Massachusetts on November l't. At which time a
permit will not be necessary to trap beaver. The season runs until April.
We also discussed some possible long term solutions such as installing a low flow device through the dam and
needing temporary approval to breach the dam to install such a device. If the situation warrants a long term
solution, we can discuss the process. However, please note that not all situations warrant the tampering of water
levels and flow.
When you and your client have determined your desired course of action, please contact Heidi, our
Conservation Associate. She will be able to assist you through the system. Note that any time of the year,
permits are required for any work on a dam. The state has a stiff penalty of up to $10,000 for persons who
disturb beaver dams within the Commonwealth.

The Planning Board makes the following findings regarding the application of Maureen
and Thomas Scott, 39 Hawkins Lane, North Andover, MA 01845, dated July 14, 2000,
requesting a Special Permit under Section 7.2.1 of the North Andover Zoning Bylaw to
allowaccess to Lot 5 Hawkins Lane over the adjacent lot, Lot 4, owned by Maureen and
ThomasScott, 39 Hawkins Lane, North Andover, MA 01845.
FINDINGS OF FACT:
1. A large area of wetlands, the 100 year floodplain and Boston Brook covers the entire
frontage of Lot 5.
2. Access other than legal frontage to these lots will create less impact on the wetland
area therefore the location is appropriate; the driveway will not affect the
neighborhood, and will not create a hazard to vehicles or pedestrians.
3. The purpose and intent of the regulations contained in the Zoning Bylaw are met with
the Special Permit Application.
Upon reaching the above findings, the Planning Board approves this Special Permit with

The Planning Board makes the following findings regarding the application of Maureen
and Thomas Scott, 39 Hawkins Lane, North Andover, MA 01845, dated July 14, 2000,
requesting a Special Permit under Section 7.2.1 of the North Andover Zoning Bylaw to
allow access to Lot 5 Hawkins Lane over the adjacent lot, Lot 4, owned by Maureen and
ThomasScott, 39 Hawkins Lane, North Andover, MA 01845.
FINDINGS OF FACT:
1. A large area of wetlands, the 100 year floodplain and Boston Brook covers the entire
frontage of Lot 5.
2. Access other than legal frontage to these lots will create less impact on the wetland
area therefore the location is appropriate; the driveway will not affect the
neighborhood, and "I not create a hazard to vehicles or pedestrians.
3. The purpose and intent of the regulations contained in the Zoning Bylaw are met with
the Special Permit Application.
Upon reaching the above findings, the Planning Board approves this Special Permit with
the following conditions:

a) The Town Planner must approve any changes made to these plans. Any
changes deemed substantial by the Town Planner will require a public
hearing and a modification by the Planning Board.
b) Easements pertaining to the rights of access for and agreements pertaining
to the maintenance of the driveway must be recorded with the Registry of
Deeds and a certified copy of the recorded document filed with the
Planning Office.
2. Prior to any site disturbance:
a) All appropriate erosion control devices must be in place and reviewed by
the Town Planner.
b) The decision of the Planning Board must be recorded at the North Essex
Registry of Deeds and a certified copy of the recorded decision must be
submitted to the Planning Office.
C) Tree clearing must be kept. to a minimum. The area to be cleared must be
reviewed by the Town Planner.
3. The contractor shall contact Dig Safe at least 72 hours prior to commencing any
excavation.
4. Gas, telephone, cable, and electric utilities shall be installed as specified by the
respective utility companies.
5. No open burning shall be done except as is permitted during the burning season
under the Fire Department regulations.
6. No underground fuel storage shall be installed except as may be allowed by Town
Regulations.
7. The provisions of this conditional approval shall apply to and be binding upon the
applicant, its employees and all successors and assigns in interest or control.
This permit shall be deemed to have lapsed after a two- (2) year period from the date on
which the Special Permit was granted unless substantial use or construction has
commenced. Therefore the permit will lapse on _Septernber 8, 2002

4, North Andover, MA, prepared by Raymond Fraser, II,
C.P. McDonough Construction Corp., dated Sept. 29, 1988,
one (1) sheet.
13. The following wetland resource areas are affected by the
proposed work: bordering land subject to flooding and
bordering vegetated wetland. These resource areas are
significant to the interests of the Act and Town Bylaw as
noted above. These resource areas are also significant to the
wildlife and recreation interests of the Bylaw. The
applicant has not attempted to overcome the significance of
these resource areas to the identified interests.
14. The NACC agrees with the applicant's delineation of the
wetland resource areas at the site.
15. In advance of any work on this project the applicant shall
notify the NACC, and at the request of the NACC, shall
arrange an on-site conference among the NACC, the
contractor, and the applicant to ensure that all of the
conditions of this Order are understood. This Order shall
be made a part of the contractor's written contract.
16. The applicant, or its successors, shall notify the NACC in
writing of the identity of the on-site construction
supervisor hired to coordinate construction during the work
on the site and to ensure compliance with this order.
17. Prior to any activity on the site, a filter fabric fence
backed by a row of staked hay bales shall be placed between
all construction areas and wetland areas per soil
Conservation Service or DEQE standards. - This barrier shall
be inspected and approved by the NACC prior to the start of
construction. This erosion barrier shall remain intact
until all disturbed areas have been mulched, seeded, and
stabilized to prevent erosion.
18. Part of the common driveway for this lot was subject of the
original file(#242-388) for this subdivision. Before any work
begins on this lot, work on that part of the common
driveway must be completed and stabilized. Said stabilization
must be inspected and approved by the NACC prior to the start of
work on this lot.
19. The applicant shall have on hand at the start of soil
disturbance, or stockpiling, a minimum of twenty-five (25) hay

shall be used only for the control of emergency erosion
problems,and shall not be used for the normal control of erosion,
as described in the Erosion Control Plan submitted with the
Notice of Intent or the hay bale barrier described in condition
#17.
20. Upon completion of construction and grading, all disturbed
areas located outside resource areas shall be stabilized
permanently against erosion. This shall be done either by
sodding, or by loaming, seeding and mulching according to Soil
Conservation standards. If the latter course is chosen,
stabilization will be considered once the surface shows complete
vegetative cover has been achieved.
21. No earthen embankment in the buffer zone shall have a slope
steeper than 2:1. Any slopes of steeper grade shall be rip -
rapped to provide permanent stabilization.
22 All erosion prevention and sedimentation protection measures
found necessary during construction by the NACC will be
implemented at the direction of the NACC.
23, There shall be no stockpiling of soil or other materials
within 25 feet of any resource area.
24. During and after work on this project, there shall be no
discharge or spillage of fuel, oil, or other pollutants into any
resource area.
25. Any changes in the submitted plans, Notice of Intent, or
resulting from the aforementioned conditions must be submitted to
the NACC for approval prior to implementation. If the NACC
finds, by majority vote, said changes to be significant and/or to
deviate from the original plans, Notice of Intent or this order
of Conditions to such an extent that the interests of the
Wetlands Protection Act and Bylaw cannot be protected by this
Order of Conditions and would best be served by the issuance of
additional conditions, then the NACC will call for another public
hearing within 21 days, at the expense of the applicant, in order
to take testimony from all'interested parties. Within 21 days of
the close of said public hearing, the NACC will issue an amended
or new Order of Conditions.
26. Any errors found in the plans or information submitted by
the applicant shall be considered as changes, and procedures
outlined above for changes shall be followed.
27. Members of the NACC shall have the right to enter upon and
inspect the premises and to effect compliance with this Order of
conditions.
28. Accepted engineering and construction standards and

procedures shall be followed in the completion of the project.
29. Prior to the issuance of a Certificate of Compliance, the
applicant shall submit a letter to the NACC from a registered
professional civil engineer certifying that the work is in
compliance with the plans referenced above and all the conditions
hereof.
30. The provisions of this Order shall apply to and be binding
upon the applicant, its employees, and all successors and assigns
in interest or control.
31. Issuance of these conditions does not in any way imply or
certify that the site or downstream areas will not be subject to
flooding, storm damage, or any other form of damage due to
wetness.
32. A proper bond or a deposit of money or negotiable securities
running to the Town of North Andover shall be provided in the
amount of $2,000 which shall be in all respects satisfactory to
Town Counsel, Town Treasurer and the NACC, and shall be posted
with the Treasurer, of the Town of North Andover before
commencement of work. Said bond or deposit of money shall be
conditioned on the completion of all conditions hereof, shall be
signed by a party or parties satisfactory to the NACC and Town
Counsel, and shall be released after completion of the project,
provided that provision, satisfactory to the NACC, has been made
for performance of any conditions which are of a continuing
nature. This condition is issued under the authority of the Town
of North Andover Wetlands Protection Bylaw.
33. The utilities for this project shall not be constructed as
to pass under or through any wetland resource areas on the site.
34. No underground storage of fuel oils shall be allowed within
one -hundred (100) feet of any wetland resource area. This
condition shall survive this order of Conditions, and shall run
with the title of the property..
35. Fertilizers utilized for landscaping and lawn care shall be
of the low -nitrogen content variety, and shall be used in
moderation. Pesticides and herbicides shall not be used on any
lot in the subdivision within 100 feet of a wetland resource
area.
36. Special Conditions No. 34 and 35 shall survive the issuance
of a Certificate of Compliance.

4. The developer shall not place the co4t,6f �ituimin6�s pavement
until an interim As -Built and certification by the Design
Engineer has been submitted and approved by the Planning Board
indicating that all utilities have been installed and are
correct in accordance with the approved definitive subdivision
plans and profiles. Said certification will include as a
minimum all drainage facilities.
5. No lot(s) or group of lots shall be released from the statutory
covenant until the binder coat of bituminous pavement has been
installed and a certification by the Design Engineer has been
submitted stating that the pavement is in the correct vertical
horizontal alignment as approved in the Definitive Plan.
6. The Planning Board recognizes that it would be environmentally
correct in the minimizing of wetland filling and therefore
waivers the strict compliance with the Rules and Regulations
in maintaining proper side slopes. The Board will require the
applicant to increase the side slopes in the area of wetland
filling to allow for a 1 to 1 slope provided, however, that a
guard rail of acceptable standards be installed in those areas
where directed by the Division of Public Works. Said guard
rail shall be set a distance of six (6) feet from the gutter
line of the roadway and at the top of the slope and provided
further that the 1 to 1 side slope be rip -rapped for erosion
control to the satisfaction of the Division of Public Works..
This condition shall be incorporated and shown on the Definitive
Plans.
7. No lots will be released from the statutory covenant until the
Conservation Commission and the Board of Health have approved
such lot construction and an Order of Conditions has been issued
by the Conservation Comission.
8. The plans shall be revised to incorporate detail construction
specifications for proper installation of the box culverts
including, but not limited to: time and duration of installation,
dewatering, base preparation, erosion controls and wing wall
construction and will include a separate topographic at a
scale of 1" to 20' of the vicinity of the crossing showing
existing and proposed elevations and work with borings and
peat depth for approval by the Planning Board and the Division
of Public Works.
9. The applicant shall provide 30 foot wide easement granted to
the Town running from Hawkins Lane to the. land of the
Commonwealth in the area between lots 2 and 3. Said easement
will beused as a pedestrian access/egress right-of-way and
provide emergency access to the land owned by the Commonwealth,
The developer shall remove a 15' area wide of all natural vegetation
found within this easement, grubed and cleared. Stone monuments
shall be placed adjacent to the Hawkins Lane right-of-way at
each easement line. The monuments shall include the wording:
"Public Access".

10. The applicant shall show the existing stone bounds on Patton
Lane and on Granville Lane.
11. Parcel 'A' shown on the plans at the intersection of Patton
Lane and Hawkins Lane shall be eliminated. Area shown as

12. The water main and gas main installation shall be shown on the
profile of Hawkins Lane in accordance with the Rules and
Regulations of the Planning Board.
13. An additional hydrant shall be installed at the end of the

lot will support a habitative area and will not adversely

The Planning Board makes the following findings. regarding the application of Maureen and
Thomas Scott, 3 9 Hawkins Lane, North Andover, MA 0 1845, dated July 14, 2000 requesting
a Special Permit under Section 2.30.1 of the North Andover Zoning Bylaw to allow for the
construction of a common driveway for Lots 4 and 5, Hawkins Lane. The Planning Board herein
approves this Special Permit with the following conditions:.
Finding of Fact:
1. The application adheres to the bylaw restriction that no more than two (2) lots be serviced by
each common drive..
2. The design and location will not adversely affect the neighborhood.
3. There. will be no nuisance or serious hazard to vehicles or pedestrians.
4. The purpose and intent of the regulations contained in the Zoning Bylaw are met with the
Special Permit application before us.
5. Adequate standards have been placed on the design which will meet public health and safety
concerns.
6. The specific location of the common driveway is appropriate due to the presence of wetlands
between the street frontage and the building portion of the lot(s).
7. A construction phasing plan and emergency response plan are required.

b) Easements pertaining to the rights of access for and agreements
pertaining to the maintenance of the driveway shall be presented to
the Town Planner to review. When the Town Planner deems the
easement adequate, a copy must be recorded with the Registry of
Deeds and a certified copy of the recorded document filed with the
Planning Office.
2. Any changes made to these plans must be approved by the Town Planner. Any changes
deemed substantial by the Town Planner would require a public hearing and a
modification by the Planning Board.
3. Prior to any site disturbance:
a) The location of the driveway must be n1arked in the field and reviewed by the
Town Planner.
b) , All erosion control devices must be in place as shown on the plan.
c) . The decision of the Planning Board must be recorded at the North Essex Registry
of Deeds and a certified copy of the recorded decision must be submitted to the
Planning Office.
d) Tree clearing must be kept to a minimum. The area to be cleared must be marked
in the field and reviewed by the Town Planner.
e) A performance guarantee of five thousand ($5,000) in the form of a check made
out to the Town of North Andover must be 'in place in accordance with the plans
and the conditions of this decision and to ensure that the as -built plans will be

5. Prior to Certificate of Occupancy issuance:
a) The Applicant shall place a stone bollard at the entry to the common drive off of
Hawkins Lane. This stone bollard shall have the street numbers of all houses
engraved on all four sides of the stone. The dimensions of the stone shall be as
follows: 8" x 8" x 72". The stone shall have 48' exposed and 24' buried, and all
numbering on the stone shall be 4" in height. This condition is placed upon the
applicant for purposes of public safety.
b) The proposed dwellings on Lot 5 shall have a residential fire sprinkler system
installed as required by the North Andover Fire Department.
6. The contractor shall contact Dig Safe at least 72 hours prior to commencing any
excavation.
Gas, telephone, cable, and electric utilities shall be installed as specified by the respective utility
companies.
No open burriing shall be done except as is permitted during the burning season under the Fire
Department regulations.
No underground fuel storage shall be installed except as may be allowed by Town Regulations.
The provisions of this conditional approval shall apply to and be binding upon the applicant, its
employees and all successors and assigns in interest or control.
This permit shall be deemed to have lapsed after a two (2) year period from the date on which
the Special Permit was granted unless substantial use or construction has commenced. Therefore

(This review is of design plans with revision date of 5/16/2000 in which the leaching
bed has been changed from two trenches to three trenches.)
Enclosed find the "Checklist for North Andover Septic System Plane' for the above-
mentioned site. The following is a list of all the 'Problem' areas and deficiencies Port
Engineering has found.
u The actual observed estimated seasonal high water elevation must be adjusted for
the high point of the leaching bed. The high point of Trench #I is 124.5'. An
ESHW at 104 inches gives an elevation of ESHW of 115.8'. The bottom of system
must be 4 feet above or at elevation 119.8'. The design plans show the elevation of
bottom of Trench #1 to be 117'. Thus Trench #1 must be raised 2.8 feet. In like
manner, Trench #2 must be raised by 0.3 feet. Trench 43 is adequately graded -
(Note that as designed, the final grade over Trench #1 is 120.5', yet the grade of the
proposed parking area only a foot away is shown as 124', or a 3.5 foot rise in only
one foot of run.)
