The North Andover Board of Appeals held a public hearing at its regular meeting on Tuesday,March 12,
2002,at 7:30 PM upon the application of Benjamin Farnum,397 Farnum Street for premises at: Boston
Street,North Andover,requesting a Finding as a Party Aggrieved of the Building Commissioner's Decision
denying a Special Permit for the erection of two microwave antennae on an existing tower within the
Village Residential zoning district.
The following Board members were present: Robert P.Ford,John M.Pallone,Ellen P.McIntyre,George
M.Earley,&Joseph D.LaGrasse.
Upon a motion made by John M.Pallone and 2nd by Ellen P.McIntyre the Board voted to GRANT the
FINDING of the applicant as a Party Aggrieved of the Building Commissioner's decision and instruct the
Building Commissioner to issue a Building Permit for the erection of two microwave antennae on the
existing tower. Voting in favor:Robert P.Ford,John M.Pallone,Ellen P.McIntyre,George M.Earley,&
Joseph D. LaGrasse.
The Board finds that the petitioner has satisfied the provisions of Section 10,paragraph 10.4 of the Zoning
Bylaw and that the granting of this finding will not adversely affect the neighborhood or derogate from the
intent and purpose of the Zoning Bylaw.

Please be advised that due to the projected calculated radiofrequency levels exceeding
33% of the radiofrequency energy levels limits for the frequency for which you are
planning on using environmental measurements of both current and post operational
radiofrequency energy levels are required. Final approval will be granted based upon
evidence that the environmental measurement data has been submitted to our office and
that the radiofrequency energy levels limits established by 105 CMR 122.000 are not

In accordance with M.G.L. c. 111, §§ 3 and 127A and regulation 105 CMR 420.000: Housing and Sanitation Standards
for Farm Labor Camps (State Sanitary Code, Chapter III), the Massachusetts Department of Public Health(MDPH),
Community Sanitation Program(CSP)has received and reviewed all required documents, including water test results
when applicable, submitted for the issuance of a Certificate of Occupancy for the following farm labor camp:
Boston Hill Farm,94 Dorchester Street,Lawrence,MA 01840
An inspection was conducted on February 3, 2006 by the Massachusetts Department of Workforce Development
(MDWD),Division of Career Services(DCS) staff on behalf of the MDPH, to ensure that your farm labor camp meets
the requirements of the regulations and is approved for occupancy by farm workers.
Based on the inspection, as well as the submitted forms, the MDPH has approved your request for a Certificate of
Occupancy for 2 farm workers. The attached Certificate of Occupancy expires on December 31, 2006 at which time
you must resubmit to the MDPH a new application including all required current documents and schedule a
reinspection with the Division of Career Services.
Please post the attached certificate conspicuously in the headquarters or main building pursuant to 105 CMR 420.810.

RE: Clarification of Recreational Camp Licensing Exemption for Programs
"Sponsored"By Municipal Recreation Departments
DATE: March 6, 2006
As the new camp season approaches, the Department of Public Health ("Department") is
providing this Advisory to clarify its interpretation of the exemption from the licensing
requirement for recreational camps for children for programs that are sponsored by a municipal
recreation department. This exemption applies to "single-purpose classes, workshops, clinics or
programs sponsored by municipal recreation departments" (MGL c. 111, §127A). While this
Advisory clarifies the Department's interpretation of this exemption, the decision as to whether
any particular programs must be licensed as a recreational camp for children must be made by
the municipal recreation department and board of health in consultation with their city or town
attorney. This Advisory replaces all previous advisories issued by the Department on this
subject.
In order to protect the health and safety of young campers during the upcoming camp
season, city and town recreation departments should take the time now to review the licensing
status of all of their recreational programs for children to determine whether they meet the
requirements for licensure as a recreational camp for children under 105 CMR 430.000 Minimum
Sanitation and Safety Standards for Recreational Camps for Children. It is important to
remember that unlicensed programs may not meet the state's minimum standards designed
to protect the health and safety of the campers, including adequate medical oversight,
specialized staff for high risk activities, adequate background checks (CORI and SORI) on
counselors and volunteers, appropriate camper/counselor ratios and appropriate health forms and
immunizations.
The Department interprets the exemption specified in MGL c. 111, §127A, for programs
sponsored by municipal recreation departments to apply only when a program is operated by a
city or town recreation department and run by employees hired by the city or town (i.e., the
employees receive a W-2 form from the city or town). The Department believes that in most
cases a program held at or using city or town facilities but operated by a third party(individual or
organization) that does not have an employer-employee relationship with the municipality is not
a sponsored program and therefore must be licensed as a recreational camp for children. While
the statute does not require licensure for programs that do meet the requirements as a sponsored
program, cities and towns may choose to voluntarily license these programs.
The Department believes that the only way to promote minimum standards
of accountability within city and town recreation programs and protect the health and safety of
the children attending these programs is for every city and town to ensure compliance with 105
CMR 430.000.
