Please be advised that I represent Mr. Dennis Pacheco regarding his many
attempts to have repairs made on the above-mentioned property. Mr. Pacheco has
made three attempts to have the repairs to your apartment completed only to be turned
away by you and your wife. On the first attempt with the handyman at your apartment,
you even contacted the police department.
The first time, Linda's Rental (Mario) made 5 attempts to make the repairs and
was turned away; on the last time you contacted the police. The second person, Mr.
Shane Loizides, contacted Mr. Enache and was told he refused to have him come by and
to complete the repairs and became abusive towards Mr. Loizides. Mr. Loizides is now
unwilling to try a second time to make the repairs because of the your verbal abuse. The
third and last attempt was by Shawmut Property Management office. Shawmut Property
Management is the management company for the entire condominium. Mrs. Enache
agreed to have them come and have the repairs done on April 19, 2013 at 1:00 p.m.. Mr.
Enache called up on Friday morning and canceled the appointment.
Pursuant to the notice sent to you by the North Andover Health Department on
April 16, 2013, I am contacting you to get a date that my client can have his repairman
come by and make the necessary repairs. These are the repairs that you filed a complaint
with the Town of North Andover and the Consumer Protection Agency regarding.
Please note your occupancy only commenced on March 1, 2013 and you filed
complaints immediately with the Town and the Consumer Protection Agency.

I just go off the phone with Dennis Pacheco. He did not give any authority to Linda's Rental to notify the selectmen or any
other office over this matter.
I was informed that the tenant has not paid the rent after the landlord has been trying to get this last issue resolved. I
believe that once the shower is working
properly with no leak and the Town signs off then there should be no more issues. There are going there today to finish
the shower so lets cross fingers that
these people can just get along.
Mr. Pacheco and my office have had no problem with the Town of North Andover. We just want this over with, if the
tenant can just let the work get done.

Please see the email below. I have received this additional information from Linda's Rentals regarding the work on the
shower. I assume you forwarded the note I sent to you this morning regarding the odor from the heating unit.
I wanted to let you know that I am working tomorrow afternoon until 4:30 and would be available to complete the final
inspection at that time. Otherwise, we can set up a time another day. It may be prudent to have representatives of
interested parties present if all agreed.
On another note, I have had conversations with your legal counsel, who has been very helpful in this matter. She has
expressed that your view of the Health Department's handling of this has been acceptable, and that we have handled
this very contentious rental housing issue in a professional manner. Unfortunately, your representative has indicated to
our superiors that this is not the case. In fact, in my the last conversation with Attorney Daly it was discussed that you
were going to let your representatives know that they were not speaking for you, if they continued in such a negative
tone.
I would be more than happy to discuss this with you, but I wanted to let you know that I am concerned that the tone of
the most recent emails may continue to have a detriment effect on trying to conclude this matter as quickly as
possible. Be advised, that since the police were called to respond on a previous occasion, if representatives of Linda's
Rentals are to be present upon my inspection as well as the tenant, the NAPD will accompany me on this inspection.

addressed multiple times I am sorry you don't know how to use your heat but the electrition and I both
showed you and he is a lic professional who made sure everything was in working order and you (Paul)
sign the work order saying everything worked now I am feeling as though we here at Linda's Rentals And
Sales are being harassed and I am not going to stand by and allow this to happen, the plumber will be
there at 2pm tomorrow I may not arrive till 2:30 once this leak is fixed I expect a form from the health
department stating so, if not I already have a call into Mr. Bellavance and Mr. Maylor in requards to this
matter and if I have to call our select man or governors office I will. I had on many occasions offered Paul
to be relieved of his obligations on his lease and even offed his security back so that he could find a place
that made him happy.

I am currently out of town, and will not be returning home until the end of next week. My representative is
Linda of Linda's Rentals. To my knowledge, there has never been an issue with her being in the unit. In fact,
Linda was present during the previous repairs a couple of weeks ago without a problem.
There is nothing wrong with the heat in the unit. A certified electrician was present during the previous repairs,
and he confirmed that the system was working properly. The tenants apparently didn't know how to use the
thermostat, and he gave them instruction on how to use it.
I have copied my attorney on this email, so she is apprised of the facts in this case.

This is the most recent information from the tenant.( read below)
Also, please be sure that the added item of the heat unit in the bathroom and heat in general is addressed. It was an add
on after the inspection report was written, but is still an important item.
Apparently the heating unit is there, but not operational. We verbally told Mario that all parts of the heating system
must be in good working order. Some people think heat is not required in the bathroom, however the code does require
it.
I hope we can get this case closed this week if at all possible.

Per our phone conversation on 04/17/2013 at 3p.m.,we received a statement from your office concerning the
04/10/2013 unannounces visit from Mario.l emailed you and also Linda a question about what time was he
planning to come,we did not want to be around him after his outrageous previous harassments over the
phone and in person.He had since 03/01/2013 all kinds of chances to do those repairs(nothing major) but he
chose to "not find the keys.not understanding when and how this business works -he can come ANYTIME
,when we are not home to fix it,instead,he obstructs this easy task ... I did not get any kind of answer
concerning the time for wed.04/10/2013,so at 7:50 a.m.,when we just got home from work,he was pounding
on our door,swearing at us and waking up our neigh bours???!!!When I answered hid madness,he became
belligerant,so my only choice was to get the N>Andover police(I do have a police report to mail you,if
necessary).He wanted ,at &:50 a.m. ,UNANNOUNCED to do the repairs,when I asked him to come back at 3pm
he got nasty again!This is our update,sorry for this ...

going on",only to argue and question the OBVYOUSLY.This key,if we lose it,Mario told us it would charge us a
$100.00,we can not take a chance.Saturday before 4pm when they were supposed to come and check things

very aggressive and scary(we have them on our voicemail),so Mario is sabotaging as best as he can this simple
thing which by now should have been done long time ago.Sue,if you want to help,which by now,this is turning
into a big deal with Mario's help,you do not really help us.You do know all those things I am repeating
here .... THOSE PEOPLE SHOULD HAVE THEIR MASTER KEY,people like us,in this situation need your help,by
now,you just complicated it,so please tell Mario to do what he needs to do.We have a life to live,everywhere
in this country people fix things and that's it?!

Mr. Pacheco,
Yesterday afternoon the Health Department received a copy of the order letter, hand delivered from your
representative, noting that all items listed and the additional issue of heat had been addressed. Each item was initialed
by the renter and representative that repairs had been complete.
Around 4:15, 1 personally went to 4 Walker Rd. #8 and inspected the unit, which is required by the Housing Code. All but
one item was found in compliance.
I turned on the left tub faucet and the water came out from behind the handle area, just as it did upon
inspection. Unfortunately, I am unable to state that this item is in compliance since it was leaking once again.
Please let me know when I may conduct another re -inspection to verify corrective action.

I noticed that one thing we spoke to Mario about may not have been written down.
After we did the inspection and sent the Order; we were told by the tenant that we forgot to write down the broken
heater unit in the bathroom. We called Mario and told him the code requires the heat be working. He said it had been
"disconnected". I don't know what that meant, but code does require heat in any room with a toilet. The tenant also felt
the heat in the unit did not seem to work properly.
We told Mario verbally, that he needed to fix the heat or when we do a re -inspection we will have to write a new Order
Letter. He said he understood.
I would hate to have to write another one. Could you please plan on fixing that as well?

The lawyer just called me back. The owner is upset. He has not authorized Mario to speak for him. If he calls again the

As for the faucet. They acknowledge that there is a bigger problem. A plumber is being hired, because the real problem

I guess our phone call was cut off. These are the basic details as they stand now
1) Mario, from Linda's realty says he does not have a key to your apartment. You and Carmen may have all the
keys.

3) 1 proposed that Carl Campbell from Shawmut to pick up the key (the Meadowview maintenance department),

Per our phone conversation on 04/17/2013 at 3p.m.,we received a statement from your office concerning the
04/10/2013 unannounces visit from Mario.l emailed you and also Linda a question about what time was he
planning to come,we did not want to be around him after his outrageous previous harassments over the
phone and in person.He had since 03/01/2013 all kinds of chances to do those repairs(nothing major) but he
chose to "not find the keys.not understanding when and how this business works -he can come ANYTIME
,when we are not home to fix it,instead,he obstructs this easy task ... I did not get any kind of answer
concerning the time for wed.04/10/2013,so at 7:50 a.m.,when we just got home from work,he was pounding
on our door,swearing at us and waking up our neigh bours???!!!When I answered hid madness,he became
belligerant,so my only choice was to get the N>Andover police(I do have a police report to mail you,if
necessary).He wanted ,at &:50 a.m. ,UNANNOUNCED to do the repairs,when I asked him to come back at 3pm
he got nasty again!This is our update,sorry for this ...

Friday we received an email from Linda saying that"saturday they will be at the apartment to check things
out,WE DO NOT NEED TO BE THERE"Today you told me earlier that Mario pretended to have the key,but later
on he did not.This is not the first time he does that,in the past he made us come home"so they can see what's
going on",only to argue and question the OBVYOUSLY.This key,if we lose it,Mario told us it would charge us a
$100.00,we can not take a chance.Saturday before 4pm when they were supposed to come and check things
out,as Linda and I decided,he harassed me and my wife Carmen on the phone,leaving messages which were
very aggressive and scary(we have them on our voicemail),so Mario is sabotaging as best as he can this simple
thing which by now should have been done long time ago.Sue,if you want to help,which by now,this is turning
into a big deal with Mario's help,you do not really help us.You do know all those things I am repeating
here .... THOSE PEOPLE SHOULD HAVE THEIR MASTER KEY,people like us,in this situation need your help,by
now,you just complicated it,so please tell Mario to do what he needs to do.We have a life to live,everywhere
in this country people fix things and that's it?!

Re: Access for repairs
Dear Mr. and Mrs. Enache,
On April 3, 2013, an authorized sanitary code inspection was conducted at your apartment by
Health Department personnel. Subsequently, an Order Letter (OL) was sent to the landlord of the
property regarding violations to the Housing Code. The OL set a deadline of seven days of
receipt of the Order, for completion of the corrections of the seven violations listed.
The Health Department directly advised Mrs. Enache, at the close of the inspection on April 3ia,
of the requirement of a renter to allow access for repairs. 105 CMR 410.810, "Every occupant of
a dwelling, dwelling unit, or rooming unit shall give the owner thereof, or his agent or
employees, upon reasonable notice, reasonable access, if possible by appointment, to the
dwelling, dwelling unit, or rooming unit for the purpose of making such repairs or alterations as
are necessary to effect compliance with the provisions of 105 CMR 410.000".
Since the OL letter was received by the landlord, there have been numerous verbal and written
communications between the parties to set up dates and times for the repairs. Hostilities grew out
of these attempts such that this negotiation eventually escalated to the point of you letting me
know that you had contacted the North Andover Police Department for assistance on April 10th,
when the maintenance was tentatively scheduled to occur. No repairs were able to be done on
that day.
On April 12th, the Health Office was notified via letter, by the landlord's representative of
Linda's Rentals and Sales, that reasonable access cannot be.obtained and therefore a request for
extension has been requested. As a result, the Health Department is granting an extension to 30
days, at which time the status will be reevaluated. It is our hope that a compromise for access
can be found within that period of time.
However, as you are keenly aware, the Health Department duty is to enforce the Housing code.
This includes any failure to provide access to effect repairs, which is a violation of the State
Sanitary Code. Therefore, this is an official OL to you, the tenants, to comply with the State

Code regarding providing access to the owner by May 6, 2013. Failure to do so will result in a
ji�Qmplaint filed against you in the Housing Court.
You have the right to request a hearing before the Board of Health if you feel this order should
be modified or withdrawn. A request for said hearing must be made in writing and received by
the Health Department within seven (7) days from the receipt of this order. At said hearing you
will be given an opportunity to be heard and to present witnesses and documentary evidence as
to why this order should be modified or withdrawn. All affected parties will be informed of the
date, time and place of the hearing and of their right to inspect and copy all records concerning
the matter to be heard. You may be represented by an attorney.

My name is Mario Sciaraffa I am the property manager of 4 Walker Rd unit
8 in North Andover, Ma. As per the request of the health department I have
attempted many times to correct the issues with said unit with no success,
therefore I am requesting that you allow me to do these repairs once current
tenant is out of unit. Please read below for reasoning.
On the first visit which was on March 18, 2013 at 7:30 pm I went to said
unit per order of the owner Dennis Pacheco after owner and I receiving the
current tenants Paul and Carmen Enache apartment condition statement via mail
stamped March 22, 2013 to check things out, when I arrived said tenants showed
me the sink and I explained to them that nothing was wrong and showed them
how to use it correctly. Mr. Paul Enache didn't agree and became verbally abusive
then told me I was a lazy bum and to just leave and get out of his apartment, so
per tenants request I left the premises.
Since this visit I have been trying to get in the unit to assess the situation with no
prevail by leaving current tenants voice mails as well as email such as the email

Town of North Andover Housing inspection department, stating that they did an
inspection without notifying owner of any such inspection, after reviewing letter
with owner and I found the regulation .500 has to do with structural not a door.
I once again I tried calling tenants to set up a date and time so I could
attempt to do the work as stated in the inspection report but got no response so
sent them an email stating that I have been trying to contact them by voice mail
and email with no response so to consider the email as notice that I would be by

Department. That date and time was April 10, 2013 at 8 am with authorization
that the tenant need not be there.
Fifth attempt was on April 10, 2013 at Sam, at this time when I arrived at 4
Walker Rd North Andover Unit 8 tenant Paul Enache opened the door and
became belligerent and so I left to go to my truck and call Michelle and Susan at
the Housing Inspection Department to let them know the tenants refused to let
me in once again, as I was doing this the tenants called the authorities at which
time I had explained to the police officer that it was arranged by Michelle and
Susan at the Health Department and the tenant that I come by today at this time
to fix everything that the Housing Inspection Order Form.
So with all being said I ask that you retract this order and allow me to fix
everything once current tenants lease has expired and they move out I will then
fix everything and call to have a re inspection before new tenants move in.

Susan at the Health Department and the tenant that I come by today at this time
to fix everything that the Housing Inspection Order Form.
So with all being said I ask that you retract this order and allow me to fix
everything once current tenants lease has expired and they move out I will then
fix everything and call to have a re inspection before new tenants move in.

My name is Mario Sciaraffa I am the property manager of 4 Walker Rd unit
8 in North Andover, Ma. As per the request of the health department I have
attempted many times to correct the issues with said unit with no success,
therefore I am requesting that you allow me to do these repairs once current
tenant is out of unit. Please read below for reasoning.
On the first visit which was on March 18, 2013 at 7:30 pm I went to said
unit per order of the owner Dennis Pacheco after owner and I receiving the
current tenants Paul and Carmen Enache apartment condition statement via mail
stamped March 22, 2013 to check things out, when I arrived said tenants showed
me the sink and I explained to them that nothing was wrong and showed them
how to use it correctly. Mr. Paul Enache didn't agree and became verbally abusive
then told me I was a lazy bum and to just leave and get out of his apartment, so
per tenants request I left the premises.
Since this visit I have been trying to get in the unit to assess the situation with no
prevail by leaving current tenants voice mails as well as email such as the email

dated March 28, 2013 at 6:20am asking to allow us in unit to take care of their list
of thing they wanted done to the unit with no response.
On April 4, 2013 the owner Dennis Pacheco received a letter from The
Town of North Andover Housing inspection department, stating that they did an
inspection without notifying owner of any such inspection, after reviewing letter
with owner and I found the regulation .500 has to do with structural not a door.
I once again I tried calling tenants to set up a date and time so I could
attempt to do the work as stated in the inspection report but got no response so I
sent them an email stating that I have been trying to contact them by voice mail
and email with no response so to consider the email as notice that I would be by
on Saturday April 6, at 2pm to get a list of things I will need at Home Depot for
repairs and then I would be back on Monday 8, 2013 at 2pm to do the repairs.
Third Attempted I went on April 6, 2013 to find no one home, I tried calling
tenant's cell phone no one answers so I left message saying I would be back on
Monday 8, 2013 at 2pm
Forth Attempt was on Monday 8, 2013 at 2pm to find that the tenants were
not there once again. However I did receive an email that stated Mario you are
running out of time for this project, you only have a few days to do it, your
landlord would not like getting fined. After reading this I feel as though they are
intentionally not allowing me to do the work in the unit,

This letter is in response to the ongoing issues at 4 Walker Road Unit 8, North Andover, MA.
The Health Department conducted an authorized inspection last week and issued an Order Letter
for seven easily correctable items that were found in violation to the Housing Code 105 CMR
410. The letter was received by you and you forwarded it to your representative, Mario, with
Linda's Rentals and Sales of Beverly. Please note that in addition to the initial list, we have
informed Mario of an additional item brought to our attention. The heating unit in the bathroom
may not be working, and if so, this would be a violation. To avoid an additional Order Letter, we
will need to verify all heating systems are properly working at the re -inspection.
Since that time, both parties have contacted the Health Department staff by phone and by email
numerous times. Realizing that the rental manager and renter could not move forward, the Health
Department attempted to mediate issues between the two parties, but was unable to resolve them.
Ultimately, we have made the decision to remove ourselves from these negotiations, as this
purview is not required by code. We will wait for confirmation from you, at the seven (7) day
mark from receipt of service, that per the Order Letter requirements, the corrections have
occurred and a re -inspection can be scheduled.
