Site Plan Review
through the Special
Permit Process
Dear Mr. Long:
The North Andover Planning Board held a public hearing on
August 4 , 1938 in the Town Hall , Selectmen' s Meeting Room, upon
the application of Toscano & Ardito, c/o Channel Building Company,
242 Neck Road, Haverhill, MA. The hearing was duly advertised in
the North Andover Citizen on July 21 and July 28 , 1988 . The following
members were present: George Perna, Vice-Chairman; John Simons , Clerk;
Erich Nitzsche and Michael Leary.
The petitioners seek a Special Permit under Section 8 .3
(Site Plan Review) of the Zoning Bylaw. The purpose of the site
plan is to review the construction of a 17 , 100 sq.ft. , two story,
office structure and related improvements . The lot is located ora
the Assessors Map 25 , Parcel 281 Bayfield Drive, in the North Andover
Business Park, containing 2 . 149 acres more or less , in an
Industrial-1 ( I-1 ) Zoning District .
John Simons read the legal notice to open the public hearing .
A letter was received and read from .D.P.W.
Jery Fortin and Peter Richardson, of Richard F. Kaminski &
Associates were present as well as Jim Bourgeois , Channel Building
Company and Lawrence Ardito. The construction will be done in
two phases . There will be not increase in run-off . An area of
3, 055 sq. ft. to be filled. Conservation had concerns with the
extensive filling in the fire lane.
Erich Nitzsche wanted to know the exact percentage of pavement
for the parcel . Jerry Fortin said he would supply that information
to the Board.
George Perna questioned the height of the building. Jerry
Fortin said -the building would be 30 ' high. George Perna wanted
to know what the building would be used for . Larry Ardito said
the building would be C.P .A. offices .
George Perna questioned the type of lighting to be used
any the type of signs . Peter Richardson responded to the lighting
stating that it would be shoe box type. Larry Ardito responded
to the question on the sign stating that it would be chrome letters
with indirect lighting.

' John Simons questioned the landscaping. Jerry Fortin said
a landscaping plan had been submitted.
A motion was made by John Simons to continue the public
hearing to the first meeting in September. Erich Nitzsche
seconded the motion and was voted unanimous by the Board.
One September 13 , 1988 the Planning Board held a meeting.
The Following members were present: Paul Hedstrom, Chairman;
George Perna, Vice-Chairman; Erich Nitzsche and Michael Leary.
John Simons arrived at 8 :15 p.m.
Jerry Fortin, Richard F. Kaminski & Associates, spoke to the
Board regarding an Order of Conditions from the Conservation
Commission. The applicant is going back to Conservation to try
and amend their Order of Conditions .
Paul Hedstrom stated that part of the conditions to be
traffic lights at Willow Street and Route 114 .
A motion was made by Erich Nitzsche to close the public hearing
and instruct Staff to draft the decision. The motion was seconded
by George Perna and was voted unanimous by the Board.
One September 22 , 1988 the Planning Board held a meeting.
The following members were present: Paul Hedstrom, Chairman;
George Perna, Vice-Chairman; John Simons, Clerk; Erich Nitzsche
and Michael Leary.
A motion was made by Erich Nitzsche to approve the site plan
in accordance with the draft decision and amendments . The motion
was seconded by Michael Leary and the Board voted unsnimous to
approve the site plan.

Special Permit - Site Plan Review
The Planning Board makes the following findings regarding this
application for a Special Permit as required under 6ectin 10.31 of the
Zoning Bylaw:
A. The specific site is an appropriate iocation for such a use,
structure , or condition;
B . The use as developed and conditioned in this decision will not
adversely affect the surrounding neighborhood ;
C . ' There will be no nuisance or serious hazard to vehicles or
` pedestrians ;

D ' Adequate and approPriate facilities will be provided for the
Proper operation of the pruposed vse;
E . The Special Permit application berore us is in harmorny with the
general purpose and intent of this Bylaw.
The Planning Board makes the findings ets required under 5ection 8. 35
that the site plan generally complies with Town Bylaw requirements but
requires additional conditions to fully comply with the purposes and
intent of the Zoning Bylaw. Therefore , in order to fully comply with
the approvals necessary Co construct the facility as specified in this
special permit before us, the Planning Board hereby grants a special
permit to the applicant provided the following conditions are met :
I . Condition, to be met prior 'Co the plans be endorsed by the Board
and recorded with the Registry of Deeds Office:
1 . Landscaping plan shall be revised as follows:
a. Four (4 ) ziUditional October Glary - Red Maple trees
shall be planted in conformance with Section 8'4 of
the Zoning Bylaw ( 15 trees needed , 11 shown) ' All
*SO trees shall be a minimum of 3'5 inches in diameter ,
�z and be at least four feet in height at the time �f '

~~ b . Additional plantings in the form of shrubs at least 3 '

structure , along the front and side facing the parking

"The entire area located to the west of the wetlands
on this site shall !-emain undisturbed and left in its
natural condition. NO clearing , curbing or cutting of

be allowed . "
2 . All signage for the property shall obtain a sign permit -From
the Building ins>pec tar prior to i t�I5 installation. No -sign
be placed on the building ' s west elevation, nor shall
any freestanding sign be placed on site except as shown in
the landscaping plan dated 7/ 15/F-30.
3. A note which states : "All handicapped parking spaces shall
be suitably located and marked on the site in accordance
with architectural barrier standards. "
4 . All lighting found on the structure and the site shall be
directed down and shall not cast light into adjacent
properties. No light shall be placed on the west side of
the structure to avoid light being cast onto the adjacent
highway .
5. The parapet of the building shal. 1 be raised 3 ' feet above
the highest part of the l'ini shed roof line of the building .
The purpose of thi =, requirement is to screen the HVAC units
to be placed on the roof from adjacent property and roadways .
b. Wheel i stops shall be provided on all parking spaces in order-
to protect landscaping :ar?d promote pedestrian access to the
entrance of the structure.
7. The applicant shall be recitiired to contribute_ his portional

agreeing to so part icipatl shall be submitted to the Board .
8. The applicant shall cu{rrpiy with all the rr.quirementa of the
NAFU specified in its Ar.�gs 1 . 1`430 letter- which contained
the following :
a . Set of fire alarm plans to be submitted to review
