Dear Mr . Long :
The Board of Appeals held a public hearing on Monday evening ,
June 8 , 1981 upon the application of H . Terry Closson . The
hearing was duly advertised in the North Andover Citizen on
May 21 and 28 , 1981 and all abutters were notified by regular
mail . The following Board members were present and voting :
Frank Serio , Jr. , Chairman ; Alfred E . Fri zel le , Esq . , Vice-
Chairman ; Richard J . Trepanier , Esq . , Clerk ; Augustinq W .
Nickerson ; and Maurice S . Foulds .
The petitioner seeks a variance from the provisions of Section
7 , Paragraph 7 . 3 and Table 2 of the By Law to enable the continued
use of a single family dwelling with less than the required side
set-back on the premises located at 40 Milk . Street .
The petitioner , through counsel , testified that the dwelling was
constructed in 1958 prior to the enactment of the Zoning By Law ,
and that when a sale was proposed , it was discovered that the
building did not have the proper side set-back .
Upon a motion made by Mr . Frizelle and seconded by Mr . Nickerson ,
the Board voted unanimously to grant the variance as requested .
The Board finds that each of the conditions set forth in Section
10 . 4 of the Zoning By Law have been satisfied . In particular ,
the Board finds that due to the location of the structure on the
premises for over twenty years , with a small deviation from the

existing requirement , constitutes a hardship within the definition
of the Zoning By Law .
Said variance will not , in the opinion of the Board , derogate from
the intent and purpose of the Zoning By Law .

The applicants ' property consisting of land and single
residence is presently under purchase and sale agreement for a
purchase price of $75 ,000 . 00 . The residence was built about 1958.
The applicants purchased the property in 1974 . At that time, plot
plans showing the location of buildings were not commonly required
by lending institutions and no plot plan was made.
The applicants discovered the violation as a result of the plot
plan procured by the present purchasers . The variance sought is
needed to enable the applicants to give a good and marketable title
to the purchasers.
Failure to grant the variance requested would result in a
substantial hardship to the applicants since the property would be
unsaleable because of the zoning violation. There would be no
substantial derogation from the intent and purpose of the zoning
law.
