The North Andover Board of Appeals held a public hearing at the Town Hall,at 120 Main Street,North
Andover MA on .Tuesday, November 13th,2012 at 7:30 PM on the application of Joseph LaGrasse,
40 SugarCane Lane(Map 105.0 Parcel 0014), North Andover,MA 01845. Petitioner is requesting a
Variance from Table 2(Summary of Dimensional Requirements)of the Zoning Bylaw to erect a 10 X 12
shed in the R-1 Zoning District.A side setback is required.
Legal notices were sent to all the certified abutters provided by the Town of North Andover Assessor's
Office,and were published in the Eagle-Tribune,a newspaper of general circulation in the Town of North
Andover,on October 30,2012 and November 6,2012.
The following voting members were present: Albert P.Manzi III,Ellen P.McIntyre,Richard J.Byers,
D.Paul Koch Jr.and Allan Cuscia.The following Associate members were present:Michael P.Liporto,
Deney Morganthal and Douglas Ludgin
Upon a motion by Byers to GRANT a Variance as per"Exhibit Plan of Land"Dated October 4,2012
to allow from Table 2(Dimensional Variance)of the Zoning Bylaws for a left side set back of 20 feet to
erect a 10 X 12 shed in the R-1 Zoning District.
Second by McIntyre to Grant the Variance
The following members voted in favor to GRANT the Variance:Albert P.Manzi III,Ellen P.McIntyre,
Richard J.Byers,D.Paul Koch Jr.and Allan Cuscia.
All in favor 5-0.
The Board finds that owing to circumstances relating to soil conditions,shape,or topography of the land
or structures and especially affecting such land or structures but not affecting generally the zoning district
in general,a literal enforcement of the provisions of the Bylaw will involve substantial hardship,financial
or otherwise,to the petitioner or applicant. The Board finds that desirable relief may be granted without
substantial detriment to the public good and without nullifying or substantially derogating from the intent
of the purpose of this bylaw
The Board also finds that this use, as developed by the building and site plans,will not adversely affect
the neighborhood. There will be no nuisance or serious hazard to vehicles or pedestrians since there are
provisions for the required off-street parking. Adequate and appropriate facilities are provided to the
existing residential dwelling where the 10 X 12 shed will go. The Board finds that the new shed will not
be substantially detrimental to the existing single-family dwelling and to the neighborhood and that this
use,of the shed will be in harmony with the neighborhood and general purpose and intent of this Bylaw.

Please note the property is an existing developed residence on Sugarcane Lane and is
owned and lived in by the petitioners. The land area is approximately 8 acres and has one
single family residence on it.
The property has a drainage ditch bisecting it and termed"wetland". The street side of
the wetland is approximately 23,000 SF and the rear of the property on the other side of
the wetland is 7 plus acres.
Due to the layout of the land and terrain the setbacks and wetland buffer require waivers
and variances for any addition to the house, exterior site construction, and in this case the
placement of a shed.
The shed will be placed on the lawn beside the existing driveway. The side lot line is
presently buffered with very large boulders and a tree scape.
