Dear Mr. Saxe, This is a follow up letter pertaining to your request to remove 4 (four) trees in close proximity to the home, garage and child's playhouse at 400 Great Pond Road. I have reviewed the trees and their proximity to the aforementioned resource areas. The trees are between 10 feet and 50 feet from the Bordering Land Subject to Flooding. They appear to be in poor health. The North Andover Conservation Commission has determined that due to their proximity to the structure and poor condition, the 2 (two) cedars located in close proximity to the rear wing of the home; a river birch located in front of the home; and a dead fir tree located in a wooded area near the playhouse; removal will be permitted in order to prevent possible injury or property damage. These cutting activities shall be limited to the four trees identified. The area shall be allowed to be maintained as before. Replacement trees may be planted. Stumps may be ground down or cut flush with the landscape. ❖ Care shall be taken to prevent damage to surrounding trees during removal of the approved trees. ❖ Upon completion of the tree removal, all disturbed areas shall be properly stabilized. ❖ The applicant shall notify this department immediately following completion of work for a final site inspection. ❖ No further vegetation shall be removed without the prior approval of the Conservation Department/Commission. (Ransom)has prepared this letter regarding the implementation of an Immediate Response Action(IRA)at the above-referenced site (the Site). The MCP requires that the local chief municipal officer and board of health be notified of the completion of-a Response Action Outcome (RAO) Statement for the Site. 1' J IRA activities took place on July 1 and 2, 2005, following the release of approximately 10 gallons of non- polychlorinated biphenyl(PCB)mineral oil dielectric fluid (MODF)that occurred when a traffic accident caused a utility pole to fall to the ground, damaging a pole-mounted transformer. IRA activities included the application of a granular oil-absorbent material to the affected portion of the asphalt-paved roadway, washing of the affected asphalt with a detergent solution,removal of a resulting oily sheen observed on standing water in a catch basin and the removal of a small quantity of MODF-impacted soil. Based on the cleanup activities,Ransom's observations,and the results of confirmatory sampling,the areas impacted by the MODF release have been satisfactorily remediated. Therefore, it is Ransom's opinion that no further response actions are necessary and that a condition of"No Significant Risk"of harm to human health, safety,public welfare, and the environment exists at this location regarding this release. The legal notice was properly advertised in the North Andover Citizen on October 13 and October 20, 1993 and all parties of interest were duly notified. The following members were present: Richard Nardella, Chairman, John Simons, Vice Chairman, Joseph Mahoney, Clerk and Richard Rowen. The petitioner was requesting a Special Permit to permit the installation of a sewage pump station, gravity sewer and force main in order to connect to the municipal sewer and to permit the construction of three parking spaces in order to facilitate emergency vehicle access to the existing house within 250 ft. of Lake Cochichewick in the Watershed Protection District. The premise is located at 400 Great Pond Road. Mr. Mahoney read the legal notice to open the public hearing. Ms. Colwell told the Board that there were no staff issues. The Town should support efforts to connect to Town sewer. Mr. Bernard Pacquin, from Dana Perkins, gave the following information to the Board: waste water pump station will be installed force main installed gravity line installed - in the same trench dual pumps, 24 hour storage Essex County Greenbelt owns property that fronts on Great Pond Road may build barn or greenhouse in the future on the site and tie it into the gravity line i Page 2 : 400 Great Pond Road Mr. Walter Saxe property is an asset to the family, want to keep it up to date will need to tie-in in the future anyway with new septic system regulations Mr. Pacquin 3 car parking lot/emergency access to be constructed 35 to 40 feet away from edge of lake Ms. Colwell discussed gravel vs. paving and oil trap. Mr. Pacquin - need a vertical separation for oil trap that is not easily attainable on-site. Mr. Nardella asked why not slope away from the lake. Mr. Pacquin told him, need to slope with current driveway. Mr. Mahoney asked what happens with current tank. Mr. Pacquin told him, pumped of solids, filled. On a motion by Mr. Rowen, seconded by Mr. Mahoney, the Board voted to close the public hearing and directed staff to draft Special Permit decision to discuss at next meeting. Motion by Mr. Rowen, seconded by Mr. Mahoney, the board voted to amend the previous motion by voting to approve project with decision filed and reviewed by staff. Attached are those conditions. This work will be done within two- hundred fifty (250) feet of the annual high water mark of Lake Cochichewick. FINDINGS OF FACT: In accordance with Section 10. 31 of the North Andover Zoning Bylaw: 1. The Planning Board finds that the specific site is an appropriate location for the installation of a sewage pump statio, gravity sewer, and force main as the Town encourages home owners in the Watershed Protection District to tie into the municipal sewer; 2 . The installation of the sewage pump, gravity sewer, and force main as well as the construction of three additional parking spaces will not adversely affect the neighborhood; 3 . There will be no nuisance or serious hazard to vehicles or pedestrians, the addition of three parking spaces will facilitate emergency vehicle access; 4 . Adequate and appropriate facilities are provided for the proper operation of the proposed use; 5. The Planning Board also makes a specific finding that the use is in harmony with the general purpose and intent of the North Andover Zoning Bylaw. In accordance with Section 4 . 136 of the North Andover Zoning Bylaw the proposed construction of the addition will not cause any significant degradation of the quality of water in or entering Lake Cochichewick. Upon reaching the above findings, the Planning Board approves this Special Permit based upon the following conditions: SPECIAL CONDITIONS : 1. Prior to Construction: a. This decision must be filed with the North Essex Registry of Deeds and a copy of the recorded document submitted to the Planning Office. Add additional sheets if necessary Any question should be directed to the Planning Office r� ATTACHMENT A I am seeking a special permit to construct a sewer pump station, gravity sewer and force main in order to connect my single family residence to the municipal sewer line currently being constructed in Great Pond Road. The house is currently served by a septic system, which is within the "non- disturbance" zone of the Watershed Protection Overlay District. By connecting to the town sewer I can abandon the septic system, thereby eliminating an allowed (as a legally non-conforming use) but generally undesirable land use in this District. The pump station will be equipped with storage capacity equivalent to an average 24 hour flow. I am also seeking a special permit to allow construction of three parking spaces within the non-disturbance zone. These parking spaces are accessory to the residence and are intended to improve vehicular access to the house. As presently configured it is very difficult to turn around in front of the house if there are more than two cars parked there. The parking spaces will provide off-driveway parking and allow room for emergency vehicles to turn around. Eight sets of plans are attached. These tests were observed by Mr. Michael Rosatti of Merrimac Engineering Services, Inc. , representing the Town of North Andover Board of Health. A plan showing the location and elevation of these percolation tests is enclosed. Also shown on this plan is the location and elevation of the deep test pits that were observed by Mr. Joseph Cushing of Gelinas Associates, representing the Town of North Andover Board of Health on May 25, 1982. The results of these deep test pits and a plan showing their location was previously submitted to the Board of Health on June 1, 1982. This information is being submitted to the Board of Health for record purposes. It is our understanding that these soil tests are valid for a period of one year, and that design plans for subsurface sewage disposal systems can be submitted to the Board during that one-year period until September 7, 1983. We have shown on the enclosed plans, in sketch form, the proposed location of the primary disposal area and the reserve area for two possible subsurface sewage disposal systems. The design of the leaching facilities in all probability would be stepped (or terraced) trenches, and the design would be based on a percolation rate of between 25 and 30 minutes per inch. A percolation test was conducted in the primarydisposal area and reserve area for each system as shown on the enclosed plan. . Depending on the family's wishes for the property, the property may or may not be divided in the foreseeable future. It is our understanding that the family has until this September 7, 1983 date in order to weigh their decision and submit final design plans for the proposed subsurface sewage disposal systems.
