The inspection revealed a plastic trash bag with garbage open and overflowing along the right side of the house and an old abandoned/unused oiltank in the rear of the property. These items constitute a violation of The State Sanitary Code; 105 CMR 410. 602 (A) . You are hereby ORDERED to correct these violations within fourteen (14) days of receipt of this report of inspection/order and maintain the area in a clean and sanitary manner at all times. You have the right to be heard by the Board of Health if you feel this order should be withdrawn or modified. To obtain a hearing, you must file a written petition with this office within seven (7) days of receipt of this order letter/report of inspection. You also have the right to inspect and obtain copies of all relevant inspection or investigation reports, orders, notices, and other documentary information in possession of the Board of Health; the right to be represented at the hearing; and that any affected party has a right to be represented at the hearing; and that any affected party has a right to appear at said hearing. Conboy, Health Administrator Board of Health 120 Main Street North Andover, Massachusetts , 01845 Dear Ms. Conboy: I am writing in response to your letter of August 13 , 1992 in which you state that a complaint was lodged regarding my property at 404 Andover Street. As discussed in our telephone conversation the following Monday, the property has been unoccupied since July 31st and had been inspected at that time revealing no trash bags anywhere on the premises. Having discussed the matter with my lawn maintainance service and others, I am told the trash bag was left there deliberately by someone. Since it was in a hidden area behind a bush not visible from the street, I would conclude that the person who told you about it and the person who put it there are one and the same. In any case, it was immediately removed along with a large amount of papers which had blown on to -the property. As regards the unused tank in the rear of the property, I am told it was left there with official town permission. In any case I did not want it there and have followed your helpful suggestion and had it removed. I do my best to maintain the property and spend a great deal on professional service to do so. We are constantly challenged by the amount of debris that continually blows on the property primarily from what appears to be the Burger King property. This week alone I filled six plastic trash bags with papers , bags and cups bearing the Burger King label. In driving through their property I note they do not have any trash bins on the right side of their property, and I wonder if this is contributing to the problem. You have also mentioned keeping the area clean and sanitary at all times, and I cannot help but wonder why the property adjacent to me at 424 Andover Street is allowed to remain in its present state.
