MEMORANDUM
TO: William A. Cyr, Director, Division of Public Works

RE: 41 Carty Circle
As you know, over the past several years, there has been
considerable problems with the proper drainage of the sewer
line from the above referenced property. My association with
this problem goes back approximately two years and the
problem the owner has encountered concerning the issue goes
back even further.
In October, 1989, when the problem was discussed with
Paul Niman, Frank Dugan and myself, the question that had to
be dealt with was whether or not the flowage problem was the
Town's responsibility to fix or the homeowner' s. The
position of the Public Works Director, at that time, was that
if upon investigation the problem was in the main, then it
would obviously be the Town's responsibility to fix it.
Mr. Niman suggested that when the problem again surfaced,
that the property owner should have the line dug up in order
to determine exactly where the blockage was occurring. That
work has now been completed and according to the contractor
performing the work, the blockage was at the tie in of the
house line to the Town sewer. While the homeowner has
incurred a considerable amount of expense over the years
associated with this problem and consistent with the position
the Town took back in 1989, I have authorized payment from
the Town to the homeowner in the amount of $ 1, 600 which
represents the cost of the recent repair work.
I am not certain, nor is anyone else at this time,
whether or not the problem is solved on a permanent basis. I
would, therefore, like Division of Public Works to review
this matter and advise me as to what steps should be taken in
the future to prevent reacurrence. I have asked Mr. Bushnell
to call the Division of Public Works should there be a
reacurrence of theP roblem in the future.
