Information and Instructions
Massachusetts General Laws chapter 152 requires all employers to provide workers' compensation for their employees.
Pursuant to this statute, an employee is defined as "...every person in the service of another under any contract of hire,
express or implied, oral or written."
An employer is defined as "an individual, partnership, association, corporation or other legal entity, or any two or more
of the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer, or the
receiver or trustee of an individual, partnership, association or other legal entity, employing employees. However the
owner of a dwelling house having -pot more than three apartments and who resides therein, or the occupant of the
dwelling house of another who employs persons to do maintenance, construction or repair work on such dwelling house
ur
or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer."
MGL chapter 152, §25C(6) also states that "every state or local licensing agency shall *withhold the issuance -or
renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any
applicant who has not produced acceptable evidence of compliance with the insurancd coverage required: '
Additionally, MGL chapter 152, §25C(7) states "Neither the .commonwealth nor any of its political subdivisions shall
enter into any contract for the performance ofpublic work until acceptable evidence of compliance with the insurance
requirements of this chapter have been presented to the contracting authority.,,
Applicants
Please fill out the workers; compensation affidavit completely, by checking the boxes that apply to your situation and, if
necessary, supply sub -contractors) name(s), address(es) and phone number(s) along with their certificate(s) of
insurance. Limited Liability Companies (LLC) or Limited Liability Partnerships (LLP) with no employees other than the
members or partners, are not required to carry workers' compensation insurance. If an LLC or LLP does have .
employees, a policy is required. Be advised that this affidavit maybe submitted to the Department of Industrial
Accidents for confirmation of insurance coverage. Also be sure to sign and date the affidavit. The affidavit should
be returned to the city or town that the application for the permit or license is being requested, not the Department of
Industrial Accidents. Should you have any questions regarding the law or if you are required to obtain a workers'
compensation policy; please call the Department at the number listed below. Self-insured companies should enter their
,self-insurance license number on the appropriate line.

Please be sure that the affidavit is complete and printed legibly. The Department has provided a space at the bottom
of the affidavit for you to fill out in the event the Office of Investigations has to contact you regarding the applicant.
Please be sure to fill in the permithicense number which will be used as a referencd number. In addition, an applicant
that must submit multiple permit/license applications in any given year, need only submit one affidavit indicating current
policy information (ifnecessary) and under "Job Site Address" the applicant should write "all locations in (city or
town)." A copy of the affidavit that has been officially stamped or marked by the city or town ,may be provided to the
applicant as proof that a valid affidavit is on file for future permits or licenses. A new affidavit must be filled out each
year. Where a homeowner or citizen is obtaining a license or permit not related to any business or commercial venture
(i.e. a dog license orpermit to bum leaves etc.) said person is NOTrequired to complete this affidavit.

interpretation to determine
use of occupancy for the
residence located at:
415-417 Winter Street
North Andover, MA
I am writing to you concerning the multi -family status of the
residential dwelling situated at 415-417 Winter Street in North
Andover. It is my understanding that various town records have
either been lost or destroyed due to flooding, most notably the
original building permit that would have been issued when the
home was constructed. If the town records had been preserved,
they would clearly demonstrate that the home constructed at 415-
417 Winter Street was constructed as a two family dwelling.
In the absence of town records, there are several indicia of
multi -family or two family dwelling status with respect to the
above-mentioned property:
(1) The property has always had two distinct addresses - one
for each unit. The tax assessor's field card (Attachment A)
shows the property with an address of 415 Winter Street while the
recorded deed (Attachment D) for the property shows an address of
417. More importantly, census reports show different individuals
residing at 415 Winter Street and 417 Winter Street with
different telephone numbers.
(2) The assessors field card shows a clear diagram of the
property which shows a building with two distinct sides or units
of approximately equal size. This diagram shows a rectangle

with a vertical line drawn approximately in the middle of the
rectangle depicting two separate units. This is to be contrasted
with other assessor's field cards for single family dwellings
where no such vertical or horizontal dividing lines appear.
Moreover, there are two kitchens located within the building, one
kitchen in the left side unit and one kitchen in the right side
unit.
(3) The building was originally constructed as a two family
dwelling inasmuch as the wall between the unit at 417 Winter
Street and the unit at 415 Winter Street is a fire wall. Fire
walls are not commonly found in single family dwellings but are
typically found in multi -family dwellings.
(4) An examination of the "folk's" directory (Attachment B) of
residents shows unrelated individuals residing in the property.
An examination of the 1974 directory shows two male individuals
residing at 415 Winter Street while there is no entry for 417
Winter Street. It should be noted however, that the two male
individuals residing at the property clearly lived in separate
units as they have different last names and are therefore
unrelated and more importantly, there is a different telephone
number listed for each individual. Moreover, this 1974 entry
lists an individual by the name of Robert Carleton - Robert
Carleton is the individual who constructed the dwelling. As
owner, he and his family always occupied the slightly larger 3
bedroom unit on the left side of the home and now known as 417
Winter Street. Mr. Carleton's wife resided with him when the
1974 Directory was assembled but the Directory only listed the
head of each household.
The 1976 Directory shows Eileen Carleton (the widow of
Robert Carleton) residing at 417 Winter Street and one "Robert
Wilcox" residing at 415 Winter Street in the unit that has always
been used for rental purposes. It is interesting to note that
-the other occupant of the property listed in 1974 besides Mr.
Carleton, is one "Thomas McHale". It is hard to imagine why just
two years later, there is a different individual then residing at
the property with Mr. Carleton's widow unless of course, that
individual was residing in the rental unit at 415 Winter Street.

A later "Polk's" directory lists one individual residing
at 415 Winter Street and one individual residing at 417 Winter
Street. These same two individuals are again separately listed
in the 2006 North Andover Census. There are no individuals with
the last name of Carleton listed as residents simply because the
present owner, Stephen D. Carleton, does not reside at the
property and instead rents out both units. (Attachment C)
(5) The current owner, Stephen D. Carelton, is the son of
Eileen Carleton and Robert Carleton. The Carleton family has
owned the home since it was constructed and therefore has
personal knowledge of the home's use as a two family building
since its inception.
I hereby respectfully request that you issue to me on behalf of
Stephen D. Carleton, your written determination that the premises
situated at 415-417 Winter Street is in fact a two family or
"duplex" dwelling based upon the above enumerated observations.

enforcement actions in accordance with G.L. ch. 40A if no building permit or special permit has
been issued for a particular building and/or use:
Your inquiry is answered by reference to the following from Moreis v. Oak Bluffs Board
of Appeals, 62 Mass. App. Ct. 53, 60 (2004):
"The six-year limitations period in [G.L. ch. 40A] §7 applies to both structural
and use violations authorized by a building permit. However, unlike structural
violations for which no permit was obtained (which enjoy a ten-year limitations
period), no such protection is afforded use violations unsanctioned by any permit.
See Lord v. Zoning Bd. of Appeals of Somerset, 30 Mass. App. Ct. at 227."

The property at 415-417 Winter Street (104.A/66) was zoned as R-2 [E & F] when the lot
was created and recorded at NERD [G]. There was no provision for a Family Suite in R -
1/R -2/R-3 in 1974, the structure's building Year. The Zoning Bylaw revision changing
Dale & Winter Streets from R-2 to R-1 occurred in 1987.
There is nothing in the Building Department folder for 415 or 417 Winter Street to show
that a Building Permit was issued for the structure, let alone that the structure was a
duplex.
There is no record that North Andover Associates, Olde Yankee Homes, Inc., Eileen T.,
or Robert E. Carleton registered a Special Permit for a Family Suite at the Essex North
Registry of Deeds from 1971-1980.
Or, Mass. Gen. L ch.40A §7grants amnesty for the structure, but not the use; 415-417, as
a duplex, is not a lawfully pre-existing use?

interpretation to determine
use of occupancy for the
residence located at:
415-417 Winter Street
North Andover, MA
I am writing to you concerning the multi -family status of the
residential dwelling situated at 415-417 Winter Street in North
Andover. It is my understanding that various town records have
either been lost or destroyed due to flooding, most notably the
original building permit that would have been issued when the
home was constructed. If the town records had been preserved,
they would clearly demonstrate that the home constructed at 415-
417 Winter Street was constructed as a two family dwelling.
In the absence of town records, there are several indicia of
multi -family or two family dwelling status with respect to the
above-mentioned property:
(1) The property has always had two distinct addresses - one
for each unit. The tax assessor's field card (Attachment A)
shows the property with an address of 415 Winter Street while the
recorded deed (Attachment D) for the property shows an address of
417. More importantly, census reports show different individuals
residing at 415 Winter Street and 417 Winter Street with
different telephone numbers.
(2) The assessors field card shows a clear diagram of the
property which shows a building with two distinct sides or units
of approximately equal size. This diagram shows a rectangle

with a vertical line drawn approximately in the middle of the
rectangle depicting two separate units. This is to be contrasted
with other assessor's field cards for single family dwellings
where no such vertical or horizontal dividing lines appear.
Moreover, there are two kitchens located within the building, one
kitchen in the left side unit and one kitchen in the right side
unit.
(3) The building was originally constructed as a two family
dwelling inasmuch as the wall between the unit at 417 Winter
Street and the unit at 415 Winter Street is a fire wall. Fire
walls are not commonly found in single family dwellings but are
typically found in multi -family dwellings.
(4) An examination of the "Polk's" directory (Attachment B) of
residents shows unrelated individuals residing in the property.
An examination of the 1974 directory shows two male individuals
residing at 415 Winter Street while there is no entry for 417
Winter Street. It should be noted however, that the two male
individuals residing at the property clearly lived in separate
units as they have different last names and are therefore
unrelated and more importantly, there is a different telephone
number listed for each individual. Moreover, this 1974 entry
lists an individual by the name of Robert Carleton - Robert
Carleton is the individual who constructed the dwelling. As
owner, he and his family always occupied the slightly larger 3
bedroom unit on the left side of the home and now known as 417
Winter Street. Mr. Carleton's wife resided with him when the
1974 Directory was assembled but the Directory only listed the
head of each household.
The 1976 Directory shows Eileen Carleton (the widow of
Robert Carleton) residing at 417 Winter Street and one "Robert
Wilcox" residing at 415 Winter Street in the unit that has always
been used for rental purposes. It is interesting to note that
the other occupant of the property listed in 1974 besides Mr.
Carleton, is one "Thomas McHale". It is hard to imagine why just
two years later, there is a different individual then residing at
the property with Mr. Carleton's widow unless of course, that
individual was residing in the rental unit at 415 Winter Street.

A later "Polk's" directory lists one individual residing
at 415 Winter Street and one individual residing at 417 Winter
Street. These same two individuals are again separately listed
in the 2006 North Andover Census. There are no individuals with
the last name of Carleton listed as residents simply because the
present owner, Stephen D. Carleton, does not reside at the
property and instead rents out both units. (Attachment C)
(5) The diarrent owner, Stephen D. Carelton, is the son of
Eileen Carleton and Robert Carleton. The Carleton family has
owned the home since it was constructed and therefore has
personal knowledge of the home's use as a two family building
since its inception.
I hereby respectfully request that you issue to me on behalf of
Stephen D. Carleton, your written determination that the premises
situated at 415-417 Winter Street is in fact a two family or
"duplex" dwelling based upon the above enumerated observations.
Would you kindly immediately contact me if you require any
further information before issuing you determination.
