AGREEMENT, dated 10-19-94, between jezej,'os -WU60*''" ereinafter referred to as
the "Owner") and Penobscott Lead Removal, with a usual place of business in Winthrop,
Massachusetts(hereinafter referred to as the "Contractor").
1. Contractor will furnish all materials and labor necessary and required for the
performance of the work on the premises described as 31-41 East Water and more
specifically set forth in the estimate and specifications which are attached to and
incorporated as part of this Agreement.
2. Contractor shall obtain all licenses and permits required for the services to be
performed pursuant to this Agreement. The cost of obtaining such licenses and permits is
the responsibility of the Owner.
3. Owner is responsible for the obtaining and for the payment of all inspections and
inspection reports required for the deleading of those areas set forth in the attached
estimate and specifications.
4. Contractor is responsible for deleading only those designated areas defined by
measurements and location as established by the inspection report and in conformity with
existing procedures and techniques.
5. Owner shall be assessed, as additional cost, for those services performed and areas
deleaded not included in the licensed inspection report or estimate provided.
6. Contractor is not resopnsible for, nor shall it delead, any area not specifically
included in the inspection report or was undected at time of said inspection.
7. Owner agrees to obtain and pay for the cost of providing upgraded or additoinal
electrical services which are necessary or required by the Contractor for the proper,
efficient, and safe operation of its equipment utilized in the performance of its service.

8. Owner agrees that it shall indemnify and hold harmless the Contractor for any loss
which may result from the inadequate, faulty or malfunctioning electrical services or
wiring on or to the premises. Any loss shall be in addition to the Contractor's estimate
attached hereto.
9. Contractor shall not be responsible for any resulting condition or damage caused
due to the nature, age, or condition of premises or its.surrounding areas, including, but not
limited to: scarring, breakage of glass or windows, window panes, split wood, loose or
deteriorated plaster, wallpaper, rugs, rapes, wa s, or wa oar .
10. Contractor warrants that it shall exercise diligence and due care, performing all
work in a workmanlike manner and in conformity with existing laws and regulations
thereunder.
11. Owner agrees to pay Contractor for the performance of its work and the furnishing
of its materials the sume of$ 10,300.00 to be made according to the following schedule:
(a) upon execution of the Agreement: $ 4,000.00
(b) When two units are completed $ 3,300.00
(c) The remaining balance due upon completion: $ 3 .00

12. All work not included in the estimate attached hereto sha 1 be performed only upon
written orders signed by the Owner or its authorized representative. Prior to initiating any
such additional work, Contractor shall notify Owner, in writing, of its additional cost.
13. All unauthorized persons are prohibited from entering in or upon the premises after
work has commenced. Any injury, loss, or contamination resulting from such
unauthorized entrance is the responsibility of the Owner.
Further, such unauthorized entrance or presence upon the premises constitutes a
breach of this Agreement which may be terminated by the Contrator, at its option. In such
event, all work shall immediately be terminated by the Contractor and all downtime
resulting from such breach, by the Owner, its agents or employs, shall result in additional
costs assessed against the Owner and shall be paid by the Owner as additional cost to the
Contractor.
14. The Owner shall bear risk of loss for all casualty or vandalism occurring during the
performance of this Agreement, without recourse to the Contractor.

15. Contractor shall perform all required work in a wor arilike manner and shall
complete work on the premises no later than WASO If the Contractor fails to
complete its work on the premises by said date, the delay due to the Contractor's error or
negligence, the Contractor will be responsible for providing up to a maximum of one
hundred seventy-five and 00/100 dollars ($175.00) per day, for substitute food and
lodging for a family of four(4), to the Owner, of Owner occupied, or to the Tenant
lawfully in posession of said premises. The payment of these funds by the Contractor shall
be the sole remedy, both in law and equity,'to the Owner. Any payments made pursuant
to this paragraph are subject to verification and review by the Contractor. Any non bona-
fide claim shall be rejected in full or in part. If the delay in completion is due to the
negligence, omissions or interference by the Owner or any pson claiming under or through
the Owner, or is caused by strike, fire, weather or other causes beyond the Contractor's
control, the period of delay shall be added to the completion date set forth herein and any
claim by the Owner or those claiming under or through it, for substitute food and lodging
shall be void, unless the premises are not completed by the revised completion date. Any
dwelling or unit not occupied prior to the commencement of work by the Contractor shall
be exempt from the provisions of this paragraph.
16, all work completed hereunder shall be in compliance with Massachusetts General
Laws, Chapter 111, Section 190 et seq., and the regulations promulgated thereunder - 105
C.M.R. 460.00 et seq.
17. The Owner acknowledges and fully comprehends that compliance with the existrig
statutes and regulations governing deleading and lead paint removal does not constitute
nor does it result in "lead free" premises.
Execution of this Agreement constitutes a binding and enforceable contract as to the
terms, conditions, and specifications herein. All monies paid are non-refundable. The
execution of this Agreement constitutes an authorization for the Contractor to enter upon
the premises and perform the agreed-upon services.
