The Board of Appeals held a public hearing on March 10, 1987 on
the application of Wilbur & Ann Burnham requesting a variance
from the requirements of Section 7 , Paragraph 7. 3 and Table 2 of
the Zoning By-Laws so as to permit relief of the side lot line
setback of 9" (plus or minus) on the premises located at 42
Buckingham Road. The following members were present and voting :
Frank Serio, Jr. , Chairman, Alfred Frizelle , Vice-Chairman,
William Sullivan, Walter Soule and Raymond Vivenzio.
The hearing was advertised in the North Andover Citizen on
February 19 and February 26, 1987 and all abutters were notified
by regular mail .
The Petitioners presented evidence showing that they obtained a
building permit to construct a garage on the premises . Prior to
construction an old garage was removed. After construction it
was discovered that one corner of the garage was located nine (9)
inches over the side set back.
Upon a motion made by Mr. Frizelle and seconded by Mr. Soule , the
Board VOTED to GRANT the variance as requested . Mr. Serio, Mr.
Frizelle , Mr. Soule and Mr. Vivenzio voted in favor. Mr.
Sullivan abstained.

The Board finds that the petitioner has satisfied the provisions
of Section 10, Paragraph 10. 4 of the Zoning By-Laws and the
granting of this variance in particular it will not derogate from
the intent and purposes of the Zoning By-Law nor will it
adversely affect the neighborhood .

NORTH ANDOVER BOARD OF APPEALS:
We, the undersigned neighbors to Wilbur and Ann Marie
Burnham - 42 Buckingham Road - North Andover, have
reviewed their plot plan and are aware the the back
corner of the garage is approximately nine inches too
close to the lot line as set forth in the North Andover
zoning requirements. We are also aware that the
Burnhams have requested a variance for relief of that
nine inches.
Until the Burnhams purchased that piece of property, it
was in desperate need of repair and was a general
eyesore to the neighborhood. This past year, however,
a lot of work has been done (including the new garage
in question) and the property now blends in with the
neighborhood nicely, despite the fact that the garage.
corner is located a few inches too close to the lot
line.
We are pleased with the results of this work as it now
stands and request that the Board of Appeals find it
appropriate to approve this request and grant the
desired variance to the Burnhams.

Dear Mr. Long:
The Board of Appeals held a public hearing on December 9 , 198.6 upon the
application of Alastair & Rita .Fraser requesting, as a .Party .Aggrieved,
the review of a decision made. by the Building Inspector or other auth-
ority , on building. permit #205 for conformance. with Zoning ByLaw set-
back requirements on premises located at 42 Buckingham Road. The follow-
ing members were present and voting: Frank Serio, Jr. , Chairman, Alfred
Frizelle , Vice-chairman, Augustine Nickerson, Clerk and Walter Soule .
The hearing was advertised in the North Andover Citizen on October 30 &
November 6 , 1986 and all abutterswere notified by regular mail .
Upon a motion made by Mr. Frizelle and seconded by Mr. •Soule , the Board
voted. unanimously to REVOKE THE BUILDING PERMIT until proper plans are
submitted to the Board, with specific lot lines and setbacks .
