RE: Removal of dead tree within the buffer zone to wetland resource areas.
Per your email dated June 8, 2011, the North Andover Conservation Department authorizes the
removal of the dead tree shown in the attached photographs. The tree is with the jurisdiction of
the North Andover Conservation Commission (NACC). The tree is located within the 25' No-
Disturbance Zone pursuant to the North Andover Wetlands Protection Bylaw (C. 178 of the
Code of North Andover). Removal of vegetation, including pruning and cutting, is prohibited
within the No-Disturbance Zone except in rare circumstances, such as safety.
The Conservation Department will permit the removal of the above referenced trees in order to
prevent possible injury or property damage. These cutting activities shall be limited to the tree
identified which shall be removed without machinery entering the area.
The approved cutting will be subject to the following conditions:
❖ The work approved in this letter shall be completed by September 1, 2011.
❖ No machinery shall enter the 25' No Disturbance Zone.
❖ No work shall occur in resource areas.
❖ All tree limbs, brush, and other debris materials shall be taken off site and disposed of
properly (brush dump on Sharpners Pond.Road or other approved facility).
❖ Stumps of the trees shall not be removed and shall be left in place. Stumps may be ground
down or cut flush with the landscape.
❖ Care shall be taken to prevent damage to surrounding trees during removal of the approved
trees.
❖ All trees are assumed to be on the property of 42 Lacy Street; however determination of
property boundaries and ownership is the responsibility of the homeowner of 42 Lacy Street.
❖ Upon completion of the tree removal, all disturbed areas shall be properly stabilized.
❖ The applicant shall notify this department immediately following completion of work for a
final site inspection.

❖ Areas within 100-feet of wetland resource areas shall remain in a natural state and no further
vegetation shall be removed without the prior approval of the Conservation
Department/Commission.
It is noted in the photograph, that lawn is maintained to the edge of the existing pond. The
NACC encourages (and requires in the case of new projects on the property) the maintenance of
a 25' No-Disturbance Zone where native vegetation is allowed to grow. A no-disturbance buffer
zone has significant effects on the health of the adjacent water body. I have attached information
regarding buffer zones and their significance for your consideration. Nothing additional is
required at this time.

Attached please find a couple of photos of the tree that we would like to remove from our
property at 42 Lacy Street North Andover. As you can see from the photo it is dead. We plan on
using a company that does not need to drive a truck onto our lawn--one that can be parked in the
driveway.
Please let me know if it is ok to proceed with this tree removal.
