Meeting, December 3, 1985
MINUTES:
A meeting of the Old Center Study Committee, in response to notice sent November 22,
1985 by Karen Nelson, was held on Tuesday, December 3, 1985 at 3:30 p.m. in the
Selectmen's Meeting Room at Town Hall in North Andover, Massachusetts. The meeting
was attended by David M. Blanchard, Peter L Hornbeck, William J. Sullivan and
committee members, Mrs. Hayden Clark., William A. Cyr, Thomas W. Leavitt, Karen Nelson,
Howard M.- Thomson and Eugene H. Avrett.
Mr. Hornbeck presented a plan for the parking lot in the Old Center and for associated
changes in the west side of Johnson Street between the Brick Store and the Community
Center. He indicated that a number of adjustments had been made in the earlier park-
ing lot plan presented to and approved by the North Andover Board of Appeals, in
order to facilitate snow plowing ana pedestrian access.
Mr. Avrett reported that the Cochichewick Lodge had agreed to the suggestion that
their two driveway openings on Johnson Street be closed off and that, instead, a
connection be provided between their back parking area and the new parking lot.
Consequently, the new plans include avc� a connection to their back parking area and
a continuous curb along Johnson Street •L-etween the Brick Store and the new parking lot.
Mr. Sullivan asked for ..further study of the street boundary between the Brick Store
and the new parking lot to see if a number of diagonal parking spaces might be
provided.
Mr. Thomson asked whether one entrance to the parking lot might be better than two

able parking spaces, and efficency for circulation and that the landscaped setback from
the street that is in the plan would, avid the appearance of excessive paving.

Ms. Nelson agreed to forward copies of the plans to the Selectmen and to. James D.

Mr. Cyr agreed to review the proposed street changes, including curbing, relocation
of catch basins, and relocation of -two telephone poles.
Mr . Leavitt announced that the Museum of American Textile History plans to donate a
tree to be planted on Johnson Stree:' �t. ':'he 'entrance to the parking lot, in honor of
the late Raymond Ryan who "lived and worked in the Old Center for many years.

Subject: Parking Lot in the Old Center
Last fall the Selectmen authorized a site survey of the Town-
owned property on Johnson Street between the Cochichewick Lodge and the
Community Center. (See attached news article. ) Using the results of
this site surveys the Old Center Study Committee engaged Peter Hornbeck,
a professional landscape architect, to determine the optimum layout of
a parking lot on the property, as well as associated street improvements,
and to draw a detailed plan for the Town to consider.
Such a plan was first circulated among the Town Departments and
received approval except for minor changes suggested to facilitate snow-
plowing and pedestrian access. - This plan also was submitted to the Board
of Appeals to obtain F3 special permit. This permit was granted based
on the submitted plan. (See attached Notice of Decision.)
The Old Center Study Committee met on December 3, 1985 and approved
the final version of the plan, which was then forwarded to the Selectmen.
(See attached minutes. ) Buddy Cyr attended this meeting, voted to approve
the plan, and did not mention any disagreement with any feature of the plan.
He received copies of the plan at that meeting.
Karen Nelson forwar9ed the plan to James D. D'Angelo, who had
offered to provide additional engineering specifications, but Mr. D'Angelo
never responded. Thus, nothing was done over the winter to prepare for
construction.
Several weeks ago, Mr. Cyr began the street work indicated on the
plan associated with the parking lot (relocation of street drains and
telephone poles, and installation of granite curbing). Two weeks ago,
Karen asked Buddy if he would also construct the parking lot, and she
told me that Buddy said "No". Karen and I then called Keith Bergman to
suggest that he speak to Buddy on behalf of the Selectmen to see if the
Highway Department would construct the parking lot according to the
approved plan in return for a transfer of the funds for this purpose
voted at the 1985 Town Meeting.
Last week, the granite.curbing for the parking lot was installed,
but it was not installed according to the plan (copy attached). Four
basic features are wrong: 1) The plan calls for two double-width entrances
from the -street centered on each of the two parking bays. Only one
entrance has been installed, in the middle, which presents an awkward
circulation pattern. '2) The curb near the Cochichewick Lodge was supposed
to be located 5 feet away from the property boundary,which is 20 feet
from the Lodge building. Thus this curb was to be 25 feet from the
building. This curb has been installed 18 feet from the building, and
therefore is located on Lodge property. The reason for the location of
this curb was to allow the row of tall evergreen trees along the Lodge
property to remain undisturbed. Instead, all of these trees have been
removed (from property not owned by the Town) by the North Andover Tree
Department. 3) The plan showed no curbing separating the two double
parking bays. Painted lines. were specified instead. Contrary to the plan,
a four foot wide granite curbed strip has been installed, which is too
narrow for any tree planting, The curb near the Lodge may have been
moved over to make room for this unnecessary dividing strip. 4) The
plan has a 45-50 foot setback for lawn and trees between the street
and the parking lot. The curbing that has been installed reduces this
to about 20 feet. There are other miscellaneous problems: so much fill
has been brought in that the grade near Johnson Street is higher than
.. the street rather than lower as specified in the plan; the base and the
underground wiring for a light near the rear of the parking lot has
not been installed; there are large rocks and other debris at the rear
of the lot that probably should be removed.
It seems to me that the Selectmen should require that the approved
plan be followed. The changes listed below might be considered.
a) Lower grade to drain away from street.
b) Remove the present middle entrance and install two entrances
alligned with the two parking bays according to the plan, and maintain the
45-50 foot setback specified in the plan.
c) Remove -center strip. Install underground wiring and post
for light.
d) Relocate curb near Lodge as shown on plan (25 feet from building
instead of 18 feet).
e)Plant new row of trees to replace those removed contrary to plan.
f) Remove large rocks and debris as necessary at rear of site.

Last week Buddy CVF started work on the parking lot in the Center.
By Saturday it became apparent that he was not following the plan approved
unanimously by-this Committee at a meeting last December 3rd, and by the
North Andover Zoning Board of Appeals.
Yesterday, Gene and I met with Selectmen Charles Salisbury and
Kenneth Crouch, Executive Secretary Keith Bergman, Leo Lafond, and Buddy
to find out why the plan was not being followed.
Buddy had not agreed with our Committee, although he did not say
so at our meetings. Two weeks ago he took a copy of the approved plan
and marked it as he thought it should be, presented it to the Selectmen,
and received permission to start the work.
He had ordered the black top to be delivered on Wednesday of this
week. We discussed the possibility of cancelling the order, and Buddy
said that if we asked him to do that, he would have no more to do with
the project.
Buddy's alternative plan must now go to the Appeals Board. If
the Board approves of it, vire must accept the design of the parking lot
as it is now built. If the Board does not approve, then Buddy will be
asked to change at least part of what he has done. We may have to call
another meeting of this Committee and, if so, in fairness to both Buddy
and advocates of the approved plan, it would by very i.nportant for all
members to attend.
There was not time to alert the Committee for the hastily arranged
meeting yesterday. Karen Nelson, who now acts as Chairman, was out of
town, as was our Treasurer, Tom Leavitt. I represented you as Secretary
and as the Improvement Society's representative; Gene participated as
one who has worked on the parking lot plan and as a representative of the
Center Realty Trust and Brick Store Company.
This is to keep you informed of recent happenings in case you are
surprised to see what is being constructed on the site of the former
Swan House.

Dear Mr. Long:
The . Board of Appeals held a public hearing on Monday evening,'
March 11, 1985 upon the application of the Towr , of North Andover .
The hearing was advertised in the Lawrence E_�gle Tribune on
February 23 and March 2, 1985 and all abutters were notified by
regular mail . ' The following members were pL?sent and voting:
Frank Serio, Jr . , Chairman Alfred E. Fr_zei ? e, Esq. , Vice
Chairman; William J . Sullivan; and Associate Merber Walter F.
Soule .
The Petitioner seeks a variance from the provisions of Section 7,
Paragraph 7 . 2 and Table 2 of the Zoning By Law so as to permit
relief from the frontage requirement to allow the erection of a
Water Treatment Plant on premises locted on the North side of
Great Pond Road known as 420 Great Pond. Road, located in the
Residential-2 (R-2 ) and Watershed zoning districts .
Mr. Joseph Borgesi , Superintendent of Public Works , testified that
the lot in question contains 2. 24 acres with 51 feet of frontage .
The town is proposing to construct a Water. 'Treatment Plant on the
parcel , which is the site of the existing South pumpingstation.
The property was deeded to the town- in 1898. ..11 other. require-
ments of the Zoning By Law will be satisfied.
lie further testified that the plant is necessary if the town is to
continue . supplying water to the community. It is expected that
funding wi1l be approved at the 1985 Annual To-n Meeting and the
plant will be completed within three years .

Upon a motion made by Mr . Frizelle and seconded by Mr . Sullivan, _
the Board voted unanimously to grant the variance as requested .
In granting the variance ; the Board finds that Section 10. 4 of the
Zoning By Law has been satisfied. In particulz.r , the. Board finds
that the lot in question with 51 feet of front.3ge on Great Pond
Road has existed for many years and has been utilized by the town
with no apparent detriment to the neighbonco-)d .
In addition, the . Board finds that denial of tY,c variance would
create a substantial hardship to the town since the town would be
forced to seek an alternative site for the proposed Water
Treatment Plant and that desirable relief may be granted without
nullifying or substantially derogating from the intent and purpose
of the Zoning .By Law.
