The subject violation consisted of regrading within the buffer zone of a Bordering Vegetated Wetland(BVW). This Department is issuing an Enforcement Order and a Violation Notice(attached)mandating that all activity Cease and Desist immediately and requiring the submittal of a Notice of Intent (NOI)prior to any further work. Brecher, Applicant The principal points upon which I base my application are as follows: A. I am seeking a Special Permit in order to renovate a currently abandoned single family dwelling that is an "prior-existing, non-conforming structure." The proposed renovation will restore the currently abandoned house to the same habitable condition as the four other neighboring houses - all of which are also prior-existing, non-conforming structures in the R-3 zone. The floor area of the currently abandoned house totals 2,412 square feet. The proposed renovations as shown on the attached floor plans (and as described in the attached Description of Work) include the addition of a new garage and a small deck, totaling 603 square feet. The proposed interior renovations do not increase the size of the structure, nor do the additions (the garage and the deck) as shown on the floor plans exceed 25% of the current floor area. With respect to the deck however, I am seeking additional relief up to a maximum of 172 square feet so that the deck could fill in more of the "L" at the rear of the house, overlooking Stevens Pond; but the deck would not be visible from any neighboring house. B. I am seeking a Variance of 4' from the 20' side yard requirement on the Northern side of the Premises in order to accommodate the proposed garage, the Northwest corner of which would be located 16' from the property line. Because the current house (a prior-existing, non-conforming structure) is not lined up perpendicular to the street, the Northwest corner of the proposed garage will encroach 4' into the Northern side yard of the Premises. The Northern side yard of the Premises is adjacent to a driveway on the Southern side of the immediately abutting property.
