On November 13, 2000 an agreement was signed with the Board of Health and yourself concerning the sewer connection of the home on this property. The agreement stated that a waiver to Title V would be granted under the condition that; 1) "the premises will be connected to the Town of North Andover public sanitary sewer as soon as possible" 2) "the premises will not be occupied as a residential dwelling following the sale unless and until the premises are connected to the Town of North Andover public sanitary sewer" The Health Department has not received any notification of the septic system abandonment and/or sewer connection since you pulled the permit last November 3`d. In addition, a recent drive by your property found that a"for sale" sign has been placed on the lawn. Please be advised that a second waiver will not be considered on this property. The home must have an active sewer before it can be sold again. The goal of this letter is to make sure that any prospective buyers are not caught unaware and caused additional stress, as you were in your sale, and to remind you of your agreement. SOME INTERNAL PLUMBING WAS INSTALLED TO BRING THE SEWER OUTLET TO THE FRONT OF THE HOUSE. THE PREVIOUS OUTLET WAS LOCATED IN THE REAR OF THE HOUSE, HEADING TOWARDS STEVENS POND. I ASKED KEVIN GRASSO WHERE THE OLD SEPTIC TANK WAS, HE SAID HE DIDNT KNOW. HE THOUGHT MAYBE THE HOUSE HAS A CESSPOOL. I TOLD HIM IT HAD TO BE ABANDONED UNDER TITLE FIVE REGULATIONS, BUT HE'S CLAIMING HE DOES NOT KNOW WHERE THE TANK OR CESSPOOL 1S. HE MAY HAVE TO DO SOME EXPLORATORY DIGGING. As you know, the single-family house on the property has not been occupied since 1996, and the house has not yet been connected to the Town sewer. I intend to close on the purchase of this property as soon as possible -- most liklely before the end of the year, and I will promptly notify the Board of Health when the closing takes place. The house will remain unoccupied until the closing, but the house will be connected to the sewer as quickly as possible following the closing. However, because I am not yet the owner of the property, I am unable to install the sewer connection prior to the closing. I am therefore requesting a temporary waiver from the Board of Health --for a period of sixty days following the closing -- of the requirement that the house be connected to the sewer. As this is an unusual situation, please see the following list of actions that must be completed by you, the buyer of this property, to initiate this request. As this property was given reprieve of the sewer tie-in due to the hardship of the deceased owner, please be aware that it is still non-compliant to the Board of Health's regulation. The Board of Health Regulation regarding sewer tie-ins was designed to protect North Andover's ground water supply and the environment. Decisions concerning waivers are only given in specific situations where the applicant is experiencing hardship. The Board is under no obligation, rather they have the ability to provide you with a more flexible option if you choose to accept the conditions. The most important condition is that the sewer to 430 Pleasant Street must be functioning and the existing septic tank (if any) must be properly abandoned, before any occupation of the house or any additional transfer of ownership. The seller will not have to be involved in this process as long as #1 below is followed as written, accepting the financial and legal responsibility of this sewer tie-in. Also, the following steps must be completed. 1) Submit a notarized document to the Board of Health accepting the burden and noting the conditions, ie. No occupancy and no transfer of title until sewer hook-up. 2) Pull the sewer tie-in permit at the Department of Public Works,complete with the sign off from the Conservation Department and submit it to this office. 3) Provide the Health Department with a signed contract for the installation of the sewer and a date for installation. Again, please note that there will be no need to attend the Board of Health meeting to discuss this matter. Once the above items are addressed and submitted, this office will review the documents and render a decision. Please call this office if you have any additional questions or concerns. Thank you. Question —Does this home have to tie into sewer? Answer—Yes,per the NA Board of Health's regulation, this home is on the list of properties that have sewer available and will be required to hook into sewer. The BOH allowed the elderly previous owner a waiver of time due to his health problems. The new buyer will be required to hook into sewer. A few months ago letter was sent to the Real Estate office to inform the realtor of this information. Question —Is sewer definitely available? The DPW says that there may be a problem with The Conservation Dept. Answer—The Health Department cannot speak for the Conservation Department. You must contact them at 688-9530. I do know that Conservation is responsible for all projects within 100' of a wetland and 200' of a river. Most projects within their jurisdiction will require the filing of a"Notice of Intent". FYI This process can take weeks and cost upwards of$2000. Question —What about the new sewer that will be going in front of the property? Answer—Please check with DPW on the availability of this new sewer for a gravity connection to 430 Pleasant. A sewer connection out of the front of the house may not need as much Conservation Dept. involvement. Question —What if it turns out that I do not have sewer? Answer—If you find this property can not hook up to sewer as previously thought, the owner should petition the Health Department to be removed from the list. Also please note that I have had this conversation with another prospective buyer. That person asked if the sewer tie-in could wait until after the sale. I responded, that the mortgage company will need one of the following;a passing title V, the house connected to sewer, or a waiver from the Board of Health due to the imminent sewer tie in. A waiver can be requested from the BOH by attending the monthly meeting. A request to be on the agenda for this meeting must be made in writing at least 1 week prior to the meeting. The next meeting is scheduled for Nov. 16th. At the meeting you must show that you have sewer available and will commit in writing to tying in ASAP after the purchase. The Health Department has no other information on file about this septic system Sue Papalia Remax Dear Ms. Papalia, This correspondence is in regards to the property listed by you known as 430 Pleasant Street. As you may know, I phoned your office yesterday regarding this property and spoke with your assistant. I informed her that I noticed your sign in the yard and thought you might not know of the connection of the Health Department and this property. I am sure you are aware that 430 Pleasant has an active septic system, but also has access to municipal sewer. As the attached letter indicates,the Health Department has a regulation regarding properties with access to sewer. Because of the past occupants personal situation this requirement was temporarily waived. Now that it is up for sale, any new prospective owner has the right to know that they will be subject to this requirement. It is incumbent of you to pass on this information as well. Most likely, any new owner will be thrilled to have access to sewer, because as well as protecting the environment it also adds value to the home. As previously published at a Public Hearing on March 17, 1994, the Board of Health has adopted regulations concerning the required sewer tie-in. The following timetable concerning your property status was adopted: 4.1 All establishments that currently do not have municipal sewer available to them must connect to the sewer as soon as it becomes available, with a maximum time limit of six months. The purpose of these regulations is to safeguard North Andover's drinking water, surface waters, groundwater and surrounding environment. Sanitary sewer is believed to be the most effective form of wastewater treatment. A copy of the entire regulation can be obtained at our office. Your property is in violation of this Board of Health regulation. Please contact the Health Department regarding this matter immediately. If we do not hear from you by May 10, 2000 your name will be placed on the regularly scheduled Board of Health meeting agenda and placed on public notice. On November 13, 2000 an agreement was signed with the Board of Health and yourself concerning the sewer connection of the home on this property. The agreement stated that a waiver to Title V would be granted under the condition that; I 1) "the premises willbe connected to the Town of North Andover public sanitary E sewer as soon as possible" 2) "the premises will not be occupied as a residential dwelling following the sale unless and until the premises are connected to the Town of North Andover public sanitary sewer" The Health Department has not received any notification of the septic system abandonment and/or sewer connection since you pulled the permit last November 3`�. In addition, a recent drive by your property found that a"for sale" sign has been placed on the lawn. Please be advised that a second waiver will not be considered on this property. The home must have an active sewer before it can be sold again. The goal of this letter is to make sure that any prospective buyers are not caught unaware and caused additional stress, as you were in your sale, and to remind you of your agreement.
