RE: Update on 433 Marbleridge Road
The attached packet details the chronology of the Health Department's interaction with Mr.
Richard Querci of 433 Marbleridge Road. The last actual contact was my letter of June 11,
2001. As far as I am aware there has been to date no additional letters, applications, telephone
conversations, etc., concerning this project.
Sometime in December of 2002 or January 2003, I was contacted by Assistant Town Manager,
Ray Santini, about a letter that he had received from Mr. Querci generally alleging that he was
treated unfairly by the Health Department because his project was denied but his neighbor was
allowed to build a sunroom. I have never received a copy of this letter so am unable to include
it in this package.
Mr. Santini also informed me that Mr. Querci stated he would be willing to move out of the
house and not re-occupy it until he received an occupancy permit and the house was connected to
sewer, if he could get permission to start his addition now. I explained to Mr. Santini that the
occupancy of the house has little if anything to do with how Title 5 has been written or is
enforced. Determinations about size of the septic facility are directly related to the number of
rooms that the system is designed for and whether the system meets current Title 5 regulations.
(The system was installed in 1956.)
I also stated that if it were solely up to me, I would have no problem with signing off on an
updated application for the project, but it would be a direct violation of Title 5 and is outside
my and the Board's legal authority. In answer to Mr. Santini's question of how Mr. Querci
could appeal, I stated he could placed on the meeting agenda to talk to the Board, if he sent a
brief letter requesting a place on the agenda. To date no such correspondence has been received;
however, Mr. Santini directed me to put him on the agenda regardless.

In your packet there are copies of the pertinent state and local regulations; the DEP
response about adding flow to a failed system; the procedure for requesting a variance of
this type from the Board and from DEP; and Title 5 requirements and options for a septic
system that is and has been in failure for over the maximum limit of two years.
In order for the Board to grant a variance from Title 5 requirements, other than an extension of
time for the failed system, the applicant must request the specific variance in writing, advertise the
hearing time and date in the newspaper, and notify all abutters in writing by certified mail of the
hearing time, purpose, date and location. If the Board grants the variance request, then the
applicant must apply to DEP for their review and approval. There is a fee connected to this
application.
If the Board is willing to entertain a variance to allow construction on an addition before the
house is connected to sewer, then a hearing may be held at the beginning of the meeting on March
27, 2003. Mr. Querci can pick up a written procedure and a copy of the defining section of Title
5 at the Health office.

Dear Mr. Querci:
I have attempted to reach you by telephone on several occasions with no success. Therefore,this letter comes as a
follow-up to our recent telephone discussion concerning your desire to build an addition to your home at 433
Marbleridge Road.
As promised,I have spoken to both the North Andover Department of Public Works(DPW)and the Department of
Environmental Protection,Division of Water Pollution Control(DEP). Mr.Bill Hmurciak,DPW Director,assures
me that the sewer for Marbleridge Road will be in operation by July 1,2002. Unfortunately,the date that sewer
will be available for tie-in at your address does not affect the answer to your question. The DEP stated that under
no condition could an addition be built unless the septic system fully complies with Title 5 or is tied in to a
functioning sewer. I have attached the e-mail to this letter for your review.
Please understand that the Board and I will do everything I can to help you solve your space problems as soon as
possible,but we must abide by the laws of the Commonwealth. Should you wish to discuss this matter further with
the Board of Health,please drop me a line requesting a spot on the agenda of their next meeting. The next
meeting will be held on June 28,2001 at 7:00 P.M. at the DPW building on Osgood Street.

Any addition of bedrooms to that home over the exisitng approved capacity of
the failed system(or if no info is available regarding the exisitng sytem,
the assessors'bedroom count), the system needs to be replaced with a fully
complying system complying with new construction standards in the Code.
Although sewer is coming to this area within the next few years, no design or
actual flow may be added to this existing failed system even with binding
agreements, etc. If this homeowner wants to expand the number of bedrooms in
the dwelling and he is unable to construct a fully complying system then he
needs to wait until the sewer is available.

wants to add an addition onto his home. It's currently on septic and it's
failed. The sewer is supposed to coming out to his street in the next year
(or two?) He wants to put on the addition now since the baby has no
intention of waiting until sewer is available. I doubt there's room on his
lot for a fully complying system since he installed an inground swimming pool
a while ago without the benefit of permits. It's large and his lot really
isn't. Once I get a date from DPW on the sewer being available, can I let
him put on his addition if he puts money in escrow for the tie-in? I'd
appreciate a clear, written response so I can better explain to him what the

NOTES ON 433 MARBLERIDGE—R. QUERCI
In early December of 2000 the departments of Building and Health were notified that a
complaint had been lodged with the Town Manager about an addition on 433
Marbleridge Road. Files were reviewed and no applications were found. At that point,
both departments wrote to the complainant, Mr. Richard Querci, and informed him that
there was a procedure in place for obtaining building permits and that he should make a
formal application. Mr. Querci applied for a building permit to add a second floor on to
his existing single-floor home at the end of the year 2000. Health reviewed.his proposal
and sent a form letter denying his application because of missing information. He was
asked to supply a complete floor plan of the existing house and the proposed addition
along with a passing Title 5 inspection report. This information has to date not been
supplied.
Mr. Querci and I have had a number of telephone conversations about his desire to
construct an addition. Most recently we discussed the possibility of his beginning
construction of the addition since municipal sewer will be coming to that end of
Marbleridge Road, possibly by the fall of 2002. It was this possibility that I proposed to
the DEP and stated that Mr. Querci was willing to sign a binding agreement and place
funds in escrow for the sewer connection. As seen by her e-mail, reply this is not possible
under Title 5 regulations.
I have no recommendations since there does not seem to be anywhere to go. I asked Ms.
Golden how strict the Department was on this particular regulation and she responded
that she has not seen this particular section waived by the DEP. However, Mr. Querci
can always apply to DEP for a waiver from this rule.

Re: 433 Marbleridge Road
When Health Department personnel first saw this application for an inground pool
our file was checked and found to have insufficient information for a decision to be
made. The homeowner was asked to locate his septic system and have it drawn to scale
on a scaled plot plan. He stated that he had both Bateson Septic and engineer, Bill
Dufresne, out to look at the system. Upon discussing the site with Mr. Dufresne, I was
told that his septic system is in failure. After discussing the problem with the BOH
chairman, I attempted to contact the homeowner to discuss the issue of the failed septic
system and the possibility that constructing a large pool in his rear yard could severely
limit his options with respect to his sanitary waste disposal. Before I was able to make
contact, however, I learned that he had already installed the pool. At that point I
discontinued attempts to reach him.

RE: Phase 4A Sewer Project
Status update
Dear Mr. Querci:
Please be advised that the Phase 4A Sewer Project, which includes a new sewer line to be installed in
front of 433 Marbleridge Road, is now an active project. Attached is a copy of the Notice to Proceed
signed by the Director of Public Works and accepted by the contractor, RM Pacella, Inc., on December
5, 2002.
RM Pacella, Inc. has begun work on Great Pond Road near Bonny Lane with the installation of a new
water main, and sewer lines on Great Pond Road will be installed thereafter. The project also includes
sewer lines on Osgood Street near Great Pond Road, a small section of Abbott Street, and Marbleridge
Road from Abbott Street to Dale Street. RM Pacella will continue to work on Great Pond Road as
long as weather permits. It is very likely that winter weather will force the contractor to shut down for
a few months and return next spring. We expect RM Pacella to complete the project sometime during
next summer.

Re: 433 Marbleridge Road
When Health Department personnel first saw this application
for an inground pool our file was checked and found to have
insufficient information for a decision to be made. The
homeowner was asked to locate his septic system and have it
drawn to scale on a scaled plot plan. He stated that he had both
Bateson Septic and engineer, Bill Dufresne, out to look at the
system. Upon discussing the site with Mr. Dufresne, I was told
that his septic system is in failure. After discussing the problem
with the BOH chairman, I attempted to contact the homeowner to
discuss the issue of the failed septic system and the possibility that
constructing a large pool in his rear yard could severely limit his
options with respect to his sanitary waste disposal. Before I was
able to make contact, however, I learned that he had already
installed the pool. At that point I discontinued attempts to reach
him.

APPLICATION FOR SEWAGE DISPOSAL USTALLATION \
HEALTH DEPARTIMT--NORTH AIMOVER, MASS.
I hereby make application for a permit for a sewage disposal installation at
Marbleridge Rd. . I will, install this system in
accordance with all the laws of the CoLmonwealth of Massachusetts and regulations
of the Board of Health of the Town of North Andover.
Furthers I will construct the house sewer of bell and spigot pipes the minimum
diameter being 4 inchest and will maintain a minimum grade of 11% until 10 feet
preceding the septic tanks where the grade shall not exceed ;4,1,. I will install a
concrete septic tank of JPO gal. in size. A manhole (s) permitting easy
cleaning will be provided with removable cover (s) of iron or concrete within 12
inches of the ground surface. I will provide subsurface disposal field with open
jointed bell and spigot Ackron pipe at least 4 inches in diameter and laid in a
series of trenchesp the bottom of which will provide a minimum of 200 lineal
(d4ffdW) feet of effective absorption area. The pipes will be laid on a 6 inch
Layer of washed gravel or crushed stone ranging in size from 3/4 to 1.1/2 inches
(dia.) and the pipes ,will be surrounded by similar material to a .height of, 2 inches
above the crown of the pipe. The joints of these pipes will be protected from
clogging and before filling the trench,, 2 inches of gravel or stone 1/80 to 1/4t'
(dia.) will be placed over the course gravel or stone. The disposal field will be
installed at a grade of 4 to 6 inches/100 feet. No single the line will exceed
100 feet in length and in any case., two lines of tile will be installed. A minimum
of 6 feet will be maintained between the center lines of the disposal field trenches
and the average depth of trench shall not' exceed 36 inches. No part of the in-
stallation will be less than 100 feet from any private water supplyt 25 feet from
any streams 20 feet from any dwelling or 10 feet from any property line. I further
agres not to cover anv portion of thisisinstallation until pMroved,.by the inspection
officer, as provided below, and to incorporate any additional requirements that
may be attached to the permit. Plot Plans must be submitted with application.

Dear Miss Sheridan:
An examination has been made relative to
the suitability of the soil for the sub-surface
disposal of sewage on the proposed Marbleridge Road
building site of Mr. grant Houle.
The soil in the areaconsisted of clay,
below which was a mixture of sand and gravel. No
percolation test could be made at the time.
It is recommended that a 750 gallon tank
be insta.11.ed torrether i�Titha minimum of 200 lineal
feet of drain pipe. The clay material below the
loam should. be removed and replaced with two feet
of bank gravel.

Re: Proposed addition
Dear Mr. Querci:
I have attempted to reach you by telephone on several occasions with no success. Therefore,this letter comes as a
follow-up to our recent telephone discussion concerning your desire to build an addition to your home at 433
Marbleridge Road.
As promised,I have spoken to both the North Andover Department of Public Works(DPW)and the Department of
Environmental Protection,Division of Water Pollution Control(DEP). Mr.Bill Hmurciak,DPW Director,assures
me that the sewer for Marbleridge Road will be in operation by July 1,2002. Unfortunately,the date that sewer
will be available for tie-in at your address does not affect the answer to your question. The DEP stated that under
no condition could an addition be built unless the septic system fully complies with Title 5 or is tied in to a
functioning sewer. I have attached the e-mail to this letter for your review.
Please understand that the Board and I will do everything I can to help you solve your space problems as soon as
possible,but we must abide by the laws of the Commonwealth. Should you wish to discuss this matter further with
the Board of Health,please drop me a line requesting a spot on the agenda of their next meeting. The next
meeting will be held on June 28,2001 at 7:00 P.M. at the DPW building on Osgood Street.
