Dear Mr. Long :
The Board of Appeals held a public hearing on Monday evening ,
November 14 , 1983 upon the application of_Thompson ' s' Restaurant ,
Inc . The hearing was advertised in the Citizen on October 27 and
November 3 , 1983 and all abutters were notified by regular mail .
The ..follow-ing members were present and voting : Frank Serio , Jr . ,
Chairman ; William J . Sullivan ; and Associate Members Walter F .
Soule ; -Maurice -S . Foul ds ; and Raymond A . Vivenzio , Esq .
The petitioner seeks - a variance from the provisions- -of Section--7 ,
Paragraph 7 . 3 and Table 2 of the Zoning - By Law to- allow the con-
struction of :a prefabricated kiosk. to house an Automated Teller
14achine for banking purposes ; which will not meet the setback re -
quirement of the Zoning By Law on premises located at -435 Andover
Street .
The petitioner- testified through counsel that the kiosk will be
located in the parking lot on the site of the former garage . One
to one and a half parking spaces will be lost if the variance is
granted and the kiosk is constructed . The income . from the kiosk
will help finance the -proposed renovations to the restaurant .
Upon a motion made by Mr . Vivenzio and seconded by Mr . Soule , the
Board voted unanimously to deny the variance --as-.requested for - the-
reason that the petitioner failed to show - that owing to any par-
ticular circumstances affecting. that lot in - particualr but not
affecting the zoning district in which the lot is located., that
a -literal enforcement of the Zoning By Law- would involve a .financial
hardship sufficient to--justify a variance ..from the 100 foot set-
back required along Route 114 .

The Board further finds that relief from the 100 foot setback
requirement would create a detriment to the public good and
would substantially derogate from the intent and purpose of the
Zoning .¢y Law . since the requested variance would place the kiosk
five feet from the lot line .

Sec. 1 APPLICATION FORM
Every application for action by the Board shall be made on a form
approved by the Board. -These forms shall be furnished by the clerk
upon request . Any communication purporting to be an application
shall be treated as mere notice of intention to seek relief until

Interest" which list shall include the petitioner , abutters , owners
of land directly opposite on any public or private street or way ,
and abutters to the abutters within three hundred feet of the property
line of the petitioner as they appear on the most recent applicable
tax list , notwithstanding that the land of any such owner is located
in another city or town , the Planning Board of the city or town , and
the Planning Board of every abutting city or town .

DESCRIPTION OF RELIEF SOUGHT ON THIS PETITION
Variance from Section 7, Paragraph 7.3, and Table 2, Yard Set-Back
Requirements, so as to allow the construction of the proposed pre-fabricated
kiosk to house a BayBank's Express 24 Automated Teller Machine for banking
purposes.
SHEET B
BASIS OF APPLICATION
The Zoning Board of Appeals in its Decision dated August 29, 1983 in
Petition 42 - '83 required the Petitioner to raze the garage shown on the Plan
as a condition to the granting of the Variance requested thereunder.
The Petitioner had originally contemplated placing the proposed kiosk
containing the Automated Teller Machine in said garage.
As a result of the condition that the garage be razed, Petitioner now finds
it necessary to locate the kiosk in one of the proposed parking spaces.
If the Zoning By-Law is literally enforced, the Petitioner will be unable
to locate the kiosk in the location most suited to its function, and will
subsequently suffer a financial hardship.
The proposed kiosk will have a negligible effect on lot coverage, which is
currently at 18.45% (with the additions allowed under Petition 42 - '83) , well
below the allowed coverage limit of 35%.

Dear Mr. Chairman:
I would like to take this opportunity to go on record
with regar your hearing on Monday, t 74th of ber
as being posed to the application by hompson' s Restaura t
to install kiosk on their propert .
The fact that a restaurant wants a free standing money
machine is preciously the reason for my opposition. These
money machines should be permitted on bank property, in super-
markets , inside restaurants or in other businesses . But if
the Town allowed these money machines virtually anywhere and
by any bank, they would soon become as unsightly as bill
boards . Therefore, prior to issuing a free standing money
machine permit , I would like to suggest that the proper zoning
authority be instructed to draft kisok zoning.
This problem is not only something which we must consider
now, but with the computer age already upon us , no one knows
how many and for what reason these facilities will be proposed
in the future. In other words , lets take a good hard look
at how this affects the Town before it is allowed and not
take a good hard look after the fact .
Also , I fail to see any hardship in this particular
matter.
