Dear Mr. Vaughn:►
The Board of Appeals held a regular meeting on Tuesday evening, October 11,
1988, at which time Mr. Robert Nicetta, Building Inspector presented the
Board with a question regarding the decision rendered to you on September
131 1988 for an addition of a family suite.
The building plans presented to the Board at that meeting and those presented
to Mr. Nicetta do not agree.
The Board of Appeals requests that you come to our regular meeting on the
1st of November, 1988 to explain why these two sets of plans are not as
required before a building permit is issued.

North Andover, MA 01845 DECISION
The Board of Appeals held a public hearing on Tuesday September 13, 1988
upon the application of Lawrence W. & Lorna L. Vaughn requesting a Special
Permit under Section 4, paragraph 4.121 (17) of the Zoning Bylaw so as to
permit the addition of a family suite to provide dwelling quarters for parents
on the premises located at 439 _Winter Street. The following members were
present and voting: William Sullivan, Acting Chairman; Augustine Nickerson,
Clerk; Walter Soule; Raymond Vivenzio and Louis Rissin
The hearing was advertised in the North Andover Citizen on August 25 and
September 1, 1988 and all abutters were notified by regular mail.
There was no opposition to the proposal.
Upon a motion by Raymond Vivenzio and seconded by Walter Soule, the Board voted
unanimously to GRANT request for SPECIAL PERMIT in accordance with plan presented,
subject to the following conditions:
1. The premises be occupied by Mr. & Mrs. Joseph Cascone.
2. The Special Permit shall expire at the time Mr. & Mrs. Cascone
cease to occupy the family suite.
3. The Special Permit shall expire at the time the premises are conveyed
to any person, partnership or corporation.
4. The applicant, by acceptance of the Certificate of Occupancy. issued
pursuant to the Special Permit, grants to the Building Inspector or
his lawful designee the right to inspect the premises anually.
5. Correction to be made to the petition to reflect dimensions of the
addition as noted on submitted plan.
The Board finds that the petitioner has satisfied the provisions of Section 4,
paragraph 4.121 (17) of the Zoning Bylaw and the granting of this Special Permit
in particular will not derogate from the intent and purpose of the Zoning Bylaw
nor will it adversely affect the neighborhood.

Family Suite, 439 Winter Street
Please be advised that staff has reviewed the above cited matter
with the Building Inspector and that we have come to the following
conclusions:
1. Family suites under the Bylaw (Section 2.37.1) cannot
"exceed 1200 sq.ft or not more than 25% of the gross
floor area of the principal unit, whichever is lesser."
The area so allowed under this provision applies to any
new or existing square footage utilized as a family
suite. We think the intent of the Bylaw to provide
large 'family suites from being constructed utilizing the
existing square footage of the original house, which
would have the practical effect of allowing existing
homes in the R-1, R-2 and R-3 Districts to be converted
into duplexes.
2. The family suite must contain the facilities necessary
to allow the suite to function as an independent living
unit (i.e. must contain a kitchen and bathroom). The
area utilized for these functions are included in the
allowed square foot limit. They cannot share common
facilities with the principal household. Otherwise,
there is not point in having a family suite regulation,
which would just allow individuals to build additions
which contain a bedroom and sitting room.
Staff is available for further assistance to the Board in its
attempt to clarify the purposes and intent of the family suite bylaw.
