The Board of Appeals held a regular meeting on Tuesday evening, June 20,2000 at 7:30 PM upon the
application Steven P.Dawe,44 Lisa Lane,North Andover,MA. Petitioner is requesting a Variance from
the requirements of Section 7 Paragraph 7.3 for a relief of a side setback within the Watershed Protection
District,to construct a 2 stall garage.
The following members were present: William J. Sullivan,Walter F. Soule,Robert Ford,John Pallone,
George Earley.
Upon a motion made by Walter F. Soule and 2°d by John Pallone,the Board voted to GRANT a
dimensional Variance for an East side setback of 2',in order to construct a 2 stall garage,on the condition
that the garage be constructed according to the plan of land by: Scott L. Giles,PLS, #13972, 50 i
Deermeadow Road,North Andover,MA,dated: 4/6/2000. The Board finds that the petitioner has
satisfied the provisions of Section 10,Paragraph 10.4 of the Zoning Bylaw and that the granting of these
variance will not adversely affect the neighborhood or derogate from the intent and purpose of the Zoning i
Bylaw. Voting in favor: William J. Sullivan, Walter F. Soule,Robert Ford,John Pallone,George Earley
Furthermore,ifthe rights authorized by the variance are not exercised within one(1)year ofthe date of the grant,they shall lapse,and j
maybe re-established only after notice,and anew hearing. Furthermore,if a Special Permit granted under the provisions contained i
herein shall be deemed to have lapsed after a two(2)year period from the date on which the Special Permit was granted unless
substantial use or construction has commenced,they shall lapse and may be re-established only after notice,and a new hearing. j
