Re: 440 Great Pond Rd. ,Sewer tie in. .-- � Dear Ms.Starr and Members of theBoard of Healtt I regret that due to a change of shift at work,I will be unalbe to attend the Board of Health meeting on Thursday February 27,1997. I have,however,enclosed some items to demonstrate that we have complied with your instructions,and are proceeding with the design to complete the tie in of town sewer. Inclosed you will find copies of the septic pump out and inspection,property tax bill,water bill,plot plan, and declaration of covenants. On 10-18-96 both of the 1500 gallon tanks were pumped out and inspected.The inspection showed the system is working perfectly.The water bills demonstrate the small amount of water that is being used in this residence. The property tax bill demonstrates that there are betterments and liens on the property,and that there exists a financial hardship.The plotplan shows the location of an existing town water pipe easement,which is the approximate location we are trying to use to run the new sewer line to tie in to the forced main used by the water treatment plant. The declaration of covenants has not been recorded. On 2-7-97,my father Albert P.Manzi passed away and his estate is now being probated. This will cause a slight delay in the design of the sewer ,however we expect to have the residence in compliance by September 1997. If you require I will appear before you at the March meeting, otherwise I will proceed with the design and permitting process. I thank you for your consideration and forebearance. The mold is one of the items that he was investigating. They informed Mr. Brown that they had hired North Ridge Environmental, LLC.The proposal is to treat all areas identified with a"biocide and encapsulate(mold inhibitor)to all surfaces." I spoke with Mr. Costa. He will be signing a contract for work in excess of$15,000 to get the job done correctly for his client. In response to the Environmental companies observation on his first proposal, he has agreed that some of the newly completed work will be exposed to allow proper application of the chemicals. He has assured us that his client's health and safety is the utmost of importance. There will be a final report done by North Ridge submitted to the Building Dept. and I will be cc'd. The wetlands were recently re-delineated by a wetland consultant and wetlands and watershed jurisdiction was discussed with the contractor regarding what could and could not be done. For conservation he was told that no work within 100' of the wetlands could be done without contacting the conservation department first and that any cutting in jurisdiction would need to be filed for,other than the mowing of the field,grass mowing only, no woody vegetation and nothing that would require anything beyond a mower(no brush-hogging). And Judy explained the watershed restrictions(which keep him even further away from wetlands/lake than conservation jurisdiction). At this time no work should be occurring within the jurisdiction of watershed or conservation. Jennifer and I will visit the site today. The contractor is Schuyler of Land Cleaners,the home owner is Anthony DiNapoli (I have not spoken to the home owner). Schuyler has been very proactive in communicating with Judy and I. 1 am expecting the home owner to attempt to submit a filing for work within jurisdiction (not sure if it will be only in watershed jurisdiction or in both), but we have not seen anything come in as of yet. Dear Andy: At your request, I met with you this past Thursday December 22, 2005 to visually observe the condition of the wood framing at the above referenced property. Destructive testing and testing of materials are not included in this scope of service. This report does not address mold or mildew or related issues as you have a separate report prepared by a specialist in that field. The intent of this report deals solely with the structural condition of the wood framing members. At the time of my visit, framers were on site erecting the roof framing system. I visually observed in general the exterior wall plywood sheathing, first floor, second floor and attic floor framing systems. I randomly performed closer observations of suspect areas that exhibited weathering. With a knife I probed suspect areas for signs of delaminating regarding plywood sheathing and surface softness due to deterioration of wood framing members. Based upon my visual observations and random probing, I feel that the wood framing system in general, is in acceptable condition. It is strongly recommended that any free standing water or ice be removed from the interior floor areas. As we have discussed, any suspect sub-flooring will be removed and replaced on an as need basis as the project progresses. Industrial Hygiene samples and testing data is a snap shot of the conditions present at the time of the survey. Concentrations of airborne contaminants will vary based on site conditions, occupant activities, environmental and weather conditions present when the testing is actually completed. SERVICES Preliminary Indoor Air Quality(IAQ) Survey; An RPF EH&S Specialist will conduct a preliminary indoor air quality(IAQ)investigation of the accessible living spaces of the building or in isolated areas as designated in the Agreement. Visual observations of accessible building surfaces and heating, ventilation, and air conditioning (HVAC) equipment for signs of causes or contaminants related to poor IAQ, expressed symptoms and complaints. A summary letter report describing the methodology, findings and preliminary recommendations will then be prepared and reviewed by our Certified Industrial Hygienist. An in-depth hazard assessment is beyond the scope- of-work for this preliminary survey; however, for each specific location, the inspector will note visible indicators of IAQ concerns observed. This preliminary survey will not include the collection and analysis of soils,surface dust,air or other testing unless specifically indicated herein. HVAC balancing, testing or designs, and assessment of inaccessible spaces are not included in this initial scope of work. Recommendations will be made as it relates to visible fungal contamination of the building and recommendations to remediate accessible fungal contamination,to be completed by others. There are currently no State or federal standards for the remediation of fungal. RPF references the current New York City Guidelines on Assessment and Remediation of Fungal in Indoor Environments and the Institute of Inspection, Cleaning and Restoration Certification (IIRC) recommended standard, IIRC 5520, Standard and Reference Guide for Professional Mold Remediation when preparing work plans. Industry guidelines require that porous building materials which have moisture damage and mold contamination be properly packaged and disposed of by trained personnel with appropriate personal protective equipment (PPE) and engineering controls. Porous materials which are contaminated and left in place can become a reservoir for future fungal growth if exposed to moisture or high levels of humidity. Non-porous materials may be cleaned, disinfected and thoroughly dried. All sources of water or moisture incursion onto interior building materials must be addressed, controlled and/or rectified or fungi growth will recur. Porous interior building materials such as carpeting, ceiling tiles, sheetrock and other wall coverings allowed to sit wet for more than 72 hours should be discarded and replaced, as applicable. *Below are additional options that can be added to base scope of services described above. Client is solely responsible for providing legal access and authorization for access to space and sampling in areas not owned or operated by Client. Contaminants may be present in inaccessible areas above and behind fixed ceilings and walls, respectively, and may not be identified without further extensive destructive testing. Hazard Communications RPF understands that, as applicable, Client will be making appropriate notifications and hazard communications to all.employees, contractors and others in accordance with US OSHA regulations and other applicable requirements. Te inspection service does not include labeling of any materials identified or building space. Schedules RPF and Client will mutually agree upon the schedule for on-site services. RPF reserves the right to postpone or cancel scheduled services at any time and for any reason. Client shall notify RPF at least 48 hours in advance of any schedule changes. Payment Total payment to RPF by Client will be made in accordance with the fees and total cost as stated in the Agreement. Payment for Services shall be due in full at the time of site work. Client agrees to pay interest on late payments to the RPF Associates, Inc. equal to 2%per month. In the event of default in any terms of this agreement, Client will be responsible for all the collection costs for RPF,including all related court costs and attorneys'fees. OTHER TERMS& CONDITIONS These Terms and Conditions, together with RPF Associates, Inc. (RPF) proposals, agreement letters, and other contract documents(herein after referred to as Agreement)make up the Agreement between RPF and Client. Before countersigning the Proposal or other Agreement document(s),be sure you read and understand this document. 1. Services: RPF will perform the services set forth in the Agreement and any amendments or change orders signed by both parties. Any request or direction from you that would require extra work or additional time for performance or would result in an increase in RPF costs, including expert witness services and unanticipated meetings, will be the subject of a negotiated amendment or change order. 2. Standard of Care: RPF will perform the services with the degree of skill and care ordinarily exercised by qualified professionals performing the same type of services at the same time under similar conditions in the same or similar locality. The foregoing standard of care is in lieu of all other standards and warranties express or implied, including warranties of marketability or fitness for a particular purpose. You will notify RPF with reasonable specificity of any deficiencies in the services within 20 days of discovery but in no event later than 45 days after substantial completion of the services,and will give RPF a reasonable opportunity to correct the deficiencies. You acknowledge that conditions can vary from those encountered at the times and locations of inspection and data collections, and that the limitation on available data may result in some level of uncertainty with respect to the interpretation of these conditions, despite due professional care. RPF therefore cannot guaranty specific results such as in identification of all environmental or occupation hazards or other conditions or problems nor their resolution. 3. Payment: Except as otherwise stated in the Agreement, you will compensate RPF for the services at it standard rates, reimburse its expenses, and pay any sales or similar taxes thereon. RPF may terminate its services at anytime your payment is overdue on this or any other project with RPF, and you will pay for all services through termination,plus termination costs. Client's Responsibilities: You will designate to RPF in writing a person to act as your representative, as applicable. Client will secure the approvals,permits, licenses and consents necessary for performance of the services. You will provide RPF with all documents and other information that are pertinent to the services and are reasonably available to you,including information related to hazardous materials and other environmental conditions at the facility. Unless otherwise indicated in writing, RPF will be entitled to rely on documents and information you provide. 5. Right of Entry: You grant RPF and its subcontractor(s)permission to enter the facility to perform the services. If you do not own the facility, you represent and warrant that the owner has granted permission, and you will provide reasonable written verification of such on request. 6. Facility Restoration: Although RPF will act to minimize damage to the facility, you acknowledge that some damage may occur even with the exercise of due care, and you agree to be responsible for all such costs, labor and materials to complete repairs,or to compensate RPF for any restoration it is asked to perform unless otherwise indicated in the Proposal. RPF will not be responsible for repairs of materials or building systems that are damaged in the process of extracting environmental samples. 7. Lab Tests and Samples: RPF is entitled to rely on the results of laboratory tests using generally accepted methodologies. RPF may dispose of samples in accordance with applicable laws 30 days after submitting test results to you unless you request in writing for them to be held longer or to be returned to you, in which case you will compensate RPF for storage beyond 30 days and/or shipping. 8. Hazardous Materials: RPF will not be the generator or owner of, nor will it posses, take title to, or assume legal liability for, any hazardous or contaminated materials at or removed from the site. RPF will not take responsibility for or control of the site or of operations or activities at the site other than its own. RPF will not undertake, arrange for or control the handling, treatment, storage, removal, shipment, transportation or disposal of any hazardous or contaminated materials at or removed from the site,other than any laboratory samples it collects or tests. 9. Changed Conditions: You recognize the uncertainties related to environmental and industrial hygiene services, which often require a phased or exploratory approach, with the need for additional services becoming apparent during the initial services. You also recognize that the actual conditions encountered may vary significantly from those anticipated based on existing information, that laws are subject to change, and that the requirements of regulatory authorities are often unpredictable. If changed or unanticipated conditions or delays make additional services necessary or results in additional costs or time from performance,RPF will notify you and the parties will negotiate changes to the scope of services, compensation and schedule. If the parties are unable to reach agreement, RPF will be entitled to terminate its services and to be equitably compensated for services already performed. RPF will not be responsible for delays or failures to perform due to weather, labor disputes, intervention by or inability to get approvals from public regulator agencies, acts or omissions on your part, or any other causes beyond RPF's reasonable control,and you will compensate RPF for any resulting increase ease in its costs. 10. Documents and Information: All documents, data, calculations and work papers prepared or furnished by RPF are instruments of service and will remain RPF property. Designs, reports, data and other work product delivered to you are for your use only, for the limited purposes disclosed to RPF. Any delayed use,use at another site,use on another project,or use by a third party will be at the user's sole risk, and you agree to indemnify and defend RPF against any liabilities resulting therefrom. Any technology,methodology or technical information learned or developed by RPF will remain its property. 11. Confidentiality; Subpoenas: Information about this Agreement and RPF services, and information you provide to RPF will be maintained in confidence and will not be disclosed to others without your consent, except as RPF reasonably believes is necessary (a) to perform its services, (b) to comply with professional standards to protect public health, safety and the environment and(c) to comply with laws and court orders. RPF will make reasonable efforts to give you prior notice of any disclosure under (b) or (c) above. Indemnification: You agree to hold harmless and indemnify RPF and its affiliates and subcontractors and their employees, officer, directors and agents against all claims, suits, fines and penalties, including mandated cleanup costs and attorneys' fees and other costs of settlement and defense, which claims, suits, fines, penalties or costs arise out of or are related to this Agreement or the services,except to the extent they area caused by the indemnified party's negligence or willful misconduct. 13. Limitation of Liability: To the fullest extent permitted by law and notwithstanding anything else in this Agreement, the aggregate liability of RPF and its affiliates and subcontractors and their employees, officers, directors and agents (collectively referred to in this paragraph as"RPF")for all claims arising out of this Agreement or the services is limited to the compensation received by RPF under this Agreement. The limitation applies to all injuries, damages, claims, losses, expenses and defense costs, whether based in contract,negligence, strict liability,warranty,trespass, indemnity,misrepresentation or any other theory of liability, except intentional misconduct. Any claim will be deemed waived unless received by RPF within 45 days of substantial completion of the services or, if shorter, the applicable statute of limitations period. RPF will not be liable for lost profits,loss of use of property, delays,or other special, indirect,incidental,consequential or punitive damages.
