Sign Center,agent for Banknorth Group,for premises at: 457 Andover Street—Jason M. Kahn,Sign Center,40 Orchard St.,Haverhill,MA represented the petition. Mr. Kahn— Banknorth acquired Ipswich Bank early in the year,and had their conversion in the month of July The Ipswich Bank signs were permitted in 1995. That code allowed our site 162 sq.ft.; we needed and installed 42 sq. ft.,a much smaller sign than the maximum allowable in the 1995 code. The pylon sign was also a legal conforming sign in 1995. This is a 43 sq.ft sign,which could have been 175 sq.ft. Again,recognizing where this is,Andover Street and Rte. 114,a corner lot,this is a tasteful sign,gold leafed and built within the height restriction of that time,20'. Mr.McGuire denied it for current compliance reasons,which brings it into pre-existing signs,which is General Law ch.4?even though we are just changing the sign faces from Ipswich Bank green to Banknorth blue. Banknorth,being a good corporate citizen has provided the application, a site survey,at expense, as well as extra meetings. We've had Atty.Tinke talk to Mr.Urbelis, who,in fact,suggested to Mr.Nicetta that permits be issued,and my meeting with Mr.Nicetta,supports our petition,and follow through by just asking us to come before the Board to get the granting of the Special Permit. The law states we don't need to do that,but Banknorth's position is trying to be a good corporate citizen. This is simply a face change from green letters and logo to blue letters and logo. Didn't change anything,they are contemporary signs, so we request to move forward now on the corporate purchase of another bank's assets,which included these physical dimensions of the building. Mr. Sullivan—The Bylaws try to standardize signs,can you make the sign closer to 25'?We ask you to use the standard in town for height,area,and distance back from the lot line. What did the bank say about shrinking the pole sign? Mr. Kahn—I would like to hear the Board's point of view before I present the Bank's position.We have presented our case,even though it[sign regulations] is not what has been upheld in Land court and district court as well as U.S.District Court,and I have all the cases with me. Mr. Kahn—Though I would prefer to hear from the Board first,the bank doesn't want to remove these signs,you asked us to remove one panel,which would make it 30 sq.ft., downsize the pole sign;yet it is part of the acquired assets. Mr.Sullivan—If you make it closer to 25 sq.ft.,then you don't have to do anything. Mr.Kahn—They are incredibly expensive cabinets, covered with gold leaf. The revised sign area is just over 30sq.ft.now,while the current pylon is 44 sq. ft. Mr. Sullivan—No internal illumination is allowed in the bylaw. Mr. Karpinski—The goal of the sign bylaws is as change comes,then more and more signs will be externally illuminated,like Kohl's. Mr. Kahn—Local law cannot supersede state or Federal. Mr.Pallone— If bank will comply,if law says that we can allow name changes. Mr.Earley—This question has been before us before;how do we know,can we ask Atty.Urbelis? Mr.Kahn—The law states that we don't need to do that,but Banknorth is a good citizen. Mr.Nicetta and Atty.Urbelis agree. Mr.Earley—You might be correct,they aren't here. Mr. Soule—Where does the court stand on light pollution? Mr. Kahn—That is irrelevant. Mr. Karpinski—We need Atty.Urbelis to instruct us. Mr. Sullivan—We will write him. Mr. Kahn—The bank is willing to forgo illumination,if they can get the decision tonight. Mr.Sullivan—The Board needs a signature block on the Mylar. Enforcement - The Building Inspector is hereby designated as the Sign Officer and is hereby charged with the enforcement of this Bylaw. a.
